Dear Mr. Buck:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 145 linear feet of streams located
at East 5T" Street Ditch in Beaufort County for pipe installation to reduce flooding potential. Insufficient evidence is present in our files
to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore,
unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as
required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be constructed as planned and that
you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically you will need to obtain a Major Variance
from the Tar-Pamlico buffer rules to leave this pipe in place. This variance will include stormwater management and buffer mitigation.
Please see our web site at http://h2o.enr.state.nc.uslncwetlands/ for a copy of the application and call Bob Zarzecki to coordinate
this effort. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be
helpful in our review of your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H
.0506(h). Your mitigation proposal is insufficient because your proposal is not stream restoration and would be of little benefit to Toby
Creek.
Please respond within three weeks of the date of this letter by sending a copy of this information to me and one copy to
Mooresville Regional. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we

I have just put the subject project (01-0790) into the tracking system. This is a violation (NOV sent from
WaRO with requirement to apply for 401 or restore). It is the recommendation of the WaRO that the cert.
be issued if and only if the city applies for and receives a Major Variance from the Tar-Pam Buffer Rules.
If they do not receive this Major Variance then the 401 should be denied and the pipe removed and the area
restored. -
The reason for the recommendation to allow the pipe to remain is that it was const. to protect a church
(questionable) from flooding. It appears to me that the church may be protected but the pipe may just back
up water worse upstream. The 54' pipes connect to an existing pipe which is under the road. This pipe is an
extension (at approx a 90 degree angle) of an existing pipe.
Due to the removal of the buffer (function), it is my opinion that a Major Variance be required. It is also
the recommendation of the WaRO that mitigation be required for the buffer impacts. I won't notified the
city of the requirement to apply for the Major Variance until I receive concurrence from the C.O. Please
notify me ASAP of the decision so that I can get them working on the application and Bob can schedule
them for the EMC.

This is an after-the fact- The pipe was t in by the city to protect a church from flooding. Because
the pope is connected to an existing _pine under the road (at and angle) this office will recommend that
a 401 Cert be issued to allow the pine to remain as constructed under the following condition:
- Applicant must apply for a Maior Variance from the Tar-Pamlico Buffer Rules with the EMC.
If the EMC grants the Major Variance then the 401 Cert should be issued. Mitigation for the

The City of Washington has made application for section 401/Wetland Permit after-the-fact.
We also plan to restore approximately 0.78 acres of buffer destroyed during a routine ditch
inaintenance;project. The planting rate calculates to 240 trees per acre.
The City of Washington proposes to reseed existing temporary ground cover and plant the
trees as specified in the guidelines for riparian buffer restoration. Native tree species will probably
be as follows: southern sugar maple, black gum, short leaf pine, water oak, southern wax myrtle. We
will make every effort to restore the buffer to its natural state.
Will you please provide comments on planting times for. these trees. Once this information
is received we will proceed with restoration at the appropriate, time for planting. If you have any
questions, call me at 975-9302.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available 1t
http://h2o.enr.state.nc.us/ncwetiands/strmgide.html.

and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)

2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that

will be notified early in the review process by the 401/Wetlands Unit if payment into the

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
