Dear Mr. Crowley:
On October 21, 2000, the NC Division of Water Quality received your application for a Neuse Buffer
Rule approval for the Wyatt Quarles Seed Company site on US 70 West in Wake County. Please provide the
following information so that we can complete our review of your proposal:
1. A vicinity map clearly illustrating the location of this property with respect to surrounding
municipalities and named streams. The site map provided only shows local roads, and does not
clearly depict the project location within Wake County.
2. A local map illustrating and quantifying the proposed impacts with respect to surface waters,
wetlands and vegetated buffers. It may be easiest for you to use a small-scale copy of a USGS topo
map or Wake County Soil Survey with your property boundaries and proposed work area clearly
indicated. The site map provided does not indicate where the proposed impacts are located, and your
property is not clearly identified.
3. Please describe all types of structures and impervious surfaces proposed within the Neuse Buffer.
Also describe all measures taken to avoid and minimize those impacts.
4. Please describe how stormwater will be directed into the buffer.
You may wish to contact Mr. Bob Zarzecki in the DWQ Central Office at (919) 733-1786, or Mr. Steve
Mitchell of the DWQ Raleigh Regional Office at (919) 571-4700 to discuss the Neuse Buffer Rules with

Dear Mr. Crowley,
On December 22, 2000, the Division of Water Quality received the additional information required for your request for a "No
Practical Alternatives" analysis and authorization certificate from the Neuse River Riparian Area Protection Rules (15A NCAC 2B
.0233). Insufficient evidence is present in our files to conclude that your project must be built as planned in the protected riparian
buffers in accordance with 15A NCAC 2B .0233. Therefore, unless modifications of the proposal are made as described below, we will
have to move toward denial of your authorization certificate as required by 15A NCAC 2B .0233(8) and will place this project on hold
as incomplete until we receive this additional information.
Please provide us with information supporting your position that states your project must be constructed as planned and that you
have no practicable alternative to impacting the protected riparian buffers. Specifically;
1. As stated within Mr. Steve Mitchell's letter to you dated June 5, 2000, "...the corner of the new storage building within the riparian
buffers... is a prohibited activity ...within the protected buffers". This activity would require a Minor Variance, however it appears
that to this building can be constructed without impacting the protected buffers. Please either provide additional information as to
why this building must be constructed as planned with a completed Minor Variance request form or reconfigure the plans such that
this building does not impact the protected buffers.
2. The proposed road impact will require mitigation per 15A NCAC 2B .023 3(6) [("road impacts other than crossings of streams and
other surface waters subject to this rule"(allowable w/ mitigation)]. We estimate this impact to be approximately 700 square feet of
impact to Zone 2 of the protected buffers. The area of mitigation required for this impact will be equal to 1,050 square feet per 15A
NCAC 2B .0242. Please provide a mitigation plan per 15A NCAC 2B .0242 to satisfy the 1,050 square foot required area of
mitigation.
Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our
review of your buffer authorization certificate.
Please respond within three weeks of the date of this letter by sending a copy of this information to me and to Mr. Steve Mitchell,
Raleigh Regional Office at (919) 571-4700. If we do not hear from you in three weeks, we will assume that you no longer want to

We are responding to your October 27, 2000 request for additional information for the
Wyatt Quarles Seed Company rear entrance and storage facility, DW project #00-1366.
We have added a vicinity map as requested. A portion of the Town of Garner area map
and the USGS quad for the area is also included. Please also see the composite map of
the area compiled from Wake County Cadastral, Topo, and soils maps. Please note that
this stream does not appear on the Quad map, the Town of Garner map, nor does it
appear on the Wake County maps. Please review this as it appears that this stream is not
subject to the buffer rules.
The structures proposed in the outer zone of any applicable buffer would be the roadway
shown on the plan, and a corner of the proposed storage shed. Impacts are minimized by
reducing wherever possible any encroachment into applicable buffers with the proposed
facilities. As you can see from the site plan, we have few options with regard to the
placement of the roadway. The right of way stub to our property is within 50' of the
stream. The storage shed was placed as shown to avoid excessive grading that would
have more severe impacts to the area adjacent to the stream.
Storm water is currently collected in inlets spaced around the paved area. We are not
anticipating changing the existing storm water network, however, covering the materials
that are currently stored outside will eliminate runoff from these materials.
We look forward to hearing from you. Based on the maps presented with this letter, we
are in doubt as to the application of buffer standards to this area. Should the stream not
be subject, we would be willing to propose a buffer area outside of the proposed impacts.

Dear Steve:
We have spoken several tunes about the enclosed plan for the Wyatt-Quarles Seed
Company in Garner. We have two issues for which the enclosed Pre-Construction
Notification form is being submitted to you.
Presently, the Wyatt-Quarles has an outdoor storage area for certain hard good and
bagged items. The rear of the parking area, adjacent to the stream depicted on the
enclosed plan, is used for outdoor storage of potting soils, fertilizers, plastic goods, and
other items for which there might be no room to store inside the building. We are
proposing to construct a 50' x 150' storage shed to allow trucks to unload and store these
materials under cover. Following construction of the shed,
would be no need for outdoor storage. As you can see from the plan the comer of the
shed protrudes into the buffer. As we discussed, the impacts to the buffer would be
minimal and much smaller issue that the continued outdoor storage of these materials.
The second issue is the proposed roadway at the back of the site. This roadway would
allow Wyatt-Quarles truck traffic to enter and exit the site from behind the building, as
opposed to directly flour US 70. The existing Barnhill Road was stubbed to the property
line making access to this road possible. Unfortunately, the right of way extension falls
the buffer area. We propose to extend the roadway as shown until we have cleared the
buffer, and then turn into the site. In this way, impacts to the buffer would be kept to a
minimum
