Dear Mr. Burdette,
On November 17, 2000, I met with you at the subject property consisting of approximately 96 acres located
east of Ebenezer Church Road (SR 1647) and northeast of US Route 70 (Glenwood Avenue) excluding the
Carmax Property, Wake County. The purpose of this meeting was to determine the applicability of a
stream feature located on the property to the Neuse River Riparian Buffer Protection Regulations (15A
NCAC 2B .0233). This was the second buffer confirmation meeting held on the property (DWQ 6/14/00).
As a result of this meeting, in addition to information provided within your letter dated 11/17/00, it was
determined that the stream feature "CHA" indicated on the attached "Almo Property / S&EC Project No.
00-5268" map provided as an attachment to your letter dated 11/17/00 and initialed by me on 11/20/00 is
subject to I5A NCAC 213 .0233. The map indicates streams (CHA to CHD), including the approximate
location of the start of two streams (NRB 101 & NRB301), subject to the buffer regulations as confirmed
and flagged in the field on 6/14/00. These streams were reviewed during the site meeting conducted on
6/6/00. It was later determined that stream feature "CHA" was indicated as extending further up the
drainage and within the property on the USGS topo and Soil Survey. This led to the site meeting
conducted on 11/17/00. It was determined during this meeting that "CHA" begins at the culvert below the
stormwater management structure located on the CarMax Site. This office recommends that these streams
be properly located and identified prior to any site design to ensure compliance with 15A NCAC 2B .0233.
This letter only addresses the applicability of 15A NCAC 2B .0233(3) and does not authorize any activity

Dear Bob:
We request written confirmation of the Neuse River Basin Riparian Buffer and channel
determination that you made on the Almo Property during our June 6, 2000 meeting on
site. The subject property consists of approximately 96 acres and is located east of
Ebenezer Church Road (SR 1647) and northeast of US Route 70 (Glenwood Avenue)
excluding the Carmax property. Figure 1 - Location Map depicts the location of the
property on the Bayleaf, NC USGS topographic quadrangle.
Five individual channel features (CH A - E) are depicted on the soil survey map, two of
which also appear on the USGS map. The property and the aforementioned channel
features are shown on Figure 2 - Wake Co. Soil Survey Map.
During the field meeting one stream feature was examined, and the buffer call at flag
NRB 101 completed by S&EC was evaluated. The stream origin point was determined by
you to correspond with flag NRB 101. The stream origin point of one other feature shown
on the soil survey occurs below where the end of the feature is mapped (Flag NRB301).
The start point of this feature was not evaluated during our site visit. The drainageway
above this stream origin point does not possess a bed and bank, the bottom is covered
with pine needles, and facultative plants, such as Lycopodium clavatum and Vitis
rotundifolia, are growing in the bottom of the drainage way. Photographs 1, 2, and 3
were taken in sequence starting downstream at the stream origin point (Flag NRB301).
The remaining three features on-site were not contested and therefore determined by
S&EC as subject to the buffer rule. Figure 3 - Site Map shows the locations of the
channel features subject to buffer rule and flags NRB 101 and NRB301.
