Dear Ms. Jackson
On December 7, 1999 the Division of Water Quality (DWQ) was notified by receipt of the
completed Pre-construction Notification Application (PCN) dated 12/6/99 and construction drawings
regarding your plan to impact Turkey Creek and the Neuse River Riparian Buffers (15A NCAC 2B
.0233) for the purpose of constructing the proposed Winchester Road. Approval and written
authorization from the NC Division of Water Quality (DWQ) is required for the proposed impacts.
The PCN states that the proposed road crossing will pipe 149.5 linear feet of Turkey Creek,
disturb greater than 150 linear feet of buffer (0.057ac of Zone1 and 0.448ac of Zone 2), and relocate
228.7 linear feet of Turkey Creek upstream of the crossing. The PCN states that your client
proposes payment into the Riparian Buffer Restoration Fund to mitigate for the riparian buffer
impacts. The proposed relocation of Turkey Creek lies outside the footprint of the road crossing and
therefore will need to be considered as a separate use. The buffer regulations (15A NCAC 26
.0233) do not list "stream relocation" as a use. Therefore, this use would be considered prohibited
and would require a Major Variance from the buffer regulations (15A NCAC 2B .0233).
Until a variance is received for the stream relocation or modifications are made to the
proposed road crossing so as not to require the relocation of Turkey Creek, we will have to move
toward denial of your 401 Certification and Neuse River Buffer Impacts as required by 15A NCAC 2B
.0233 and will place this project on hold as incomplete until we receive this additional information.
We are requesting (by copy of this letter) that the U.S. Army Corps of Engineers (USACE) place
your project on administrative hold.
Please respond in writing within three weeks of the date of this letter. If we do not hear from
you in three weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn. Please call Bob Zarzecki at 919-733-9726 if you have any
questions or require copies of our rules or procedural materials.

RE: Winchester Road Crossing / Turkey Creek Relocation
The project proposes to cross Turkey Creek (B NSW) with a 149.5-foot wide road
crossing. They claim that this crossing will require the relocation of approximately 228.7
feet of Turkey Creek downstream of the footprint of the crossing. This is almost identical
to the Varsity Drive project. I think that they need a variance for the stream relocation
outside of the footprint of the road crossing. They also need to provide us with a stream
restoration plan with the variance request.

Dear Mr. Tugwell and Dorney,
Soil & Environmental Consultants (S&EC) is submitting on behalf of Mr. Robert Park and the
City of Raleigh a Pre-Construction Application (PCN) for proposed impacts to wetlands/surface
waters located within the proposed Winchester Road alignment. The wetland impact will result
from the construction of a proposed perpendicular road crossing of Turkey Creek. The road
crossing will link a designated City of Raleigh collector street from Lake Ann Drive to Ebenezer
Church Road. This road has been designed to reduce traffic and driveway accesses on Glenwood
Avenue (ilighway 70). The stream crossing will be located approximately 800 feet south of
Glenwood Avenue. The USGS topographic map of the project location is enclosed.
The proposed work in wetlands/surface waters will be confined to Turkey Creek and a 0.131-acre
section of associated wetland. The client proposes 4o construct a road across Turkey Creek 'by
placing four individual 10-foot by 11-foot box culverts and four wing walls at the current
strcambed invert elevation. Two of the box culverts will be place3within the wetland/Neuse
buffer area for the purpose of accommodating floodflows. In addition to placement of the box
culverts into the stream and wetland area, approximately 230 feet of the upstream portion (i.e.
from the culverts) of Turkey Creek is proposed for realignment. S&EC does not consider the
realignment of the stream to be a permanent impact. Realignment of the creek is being proposed
for the purpose of reducing shear stress along the western portion of the box culverts and the
roadbed, which could potentially undermine the structural integrity of the road crossing. The
realigned stream channel will be reconstructed based on the original channel profile. A stream
restoration plan will be provided to the agencies if requested for the constructed stream channel.
The Neuse buffer Zones 1 and 2 will shift with the realigned channel and will be preserved. No
impacts outside of the immediate 149.5-foot stream crossing are being proposed except for the
wing wall extensions associated with the culvert build design. The total buffer impact in Zone 1
and Zone 2 is 0.057-acre (2,494 square feet) and 0.448-acre (19,522 square feet), respectively.
Zone 2 outside of the immediate roadbed will be revegetated after grading is complete. S&EC
realizes that the entire impact is calculated if the impact exceeds the 150-foot wide threshold so
our client proposes to pay into the N.C. Wetland Restoration Fund to mitigate for impacts as
determined by DWQ.

S&EC completed the wetland delineation along this portion of Turkey Creek 4 August 1999. The
wetland flagged encompasses approximately 0.182-acre. S&EC discussed and evaluated
alternatives with the design engineers for the purpose of reducing and minimizing impacts.
Following the review of the initial design, S&EC suggested that the road crossing be redesigned
by reducing the elevation of the road, reducing the length of the box culverts and increasing the
height of the headwall supporting the 'fill, and roadbed. This modification resulted in the
reduction of box culverts to allowable thresholds. The wing walls however do extent beyond the
150-foot threshold. Therefore, S&EC believes that impacts have been minimized and avoided to
the greatest extent practical (See attached letters from project engineers for more justification).

Description of Activity: This permit authorizes mechanized landclearing, excavation, and the placement

ou have our approval, in accordance with the attached conditions, to place fill material in 0.21 acres of water for th
purpose of developin;, a commercial shopping center at US 70 and "Turkey Creek, as you described in your application dated
May 27. 19')9. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certil ication number 3105. This Certificate allows you to use Nationwide Permit Number 26 when the Corps of Engineers
issues it. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 213 .033), In addition, you should get an
other federal. state or local permit before you go ahead with your project including (but not limited to) Sediment and Erosior
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or LAMA expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project. You must notify us and send us a new application. If the property is sold, the new owner must be given a copy of thi
Cerilication and approval letter and is thereby responsible for complying wit all conditions. If total wetland fills for this
project (now or in the fu(ure) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H
.0506(h). For this approval to be valid, you must follow the conditions listed in the attached Certification. This approval shi
expiry when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification.
1. Deed notification or similar mechanisms shall be placed on all lots with remaining juridictional wetlands and waters or
areas within 50 feel of all streams and ponds to notify the state in order to assure compliance for future wetland and/or
water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permit (whichever comes first).
2. An additional condition is that stormwater shall be directed to sheetflow at nonerosive velocities through the protected
stream huffers.
3. A final. written stormwater plan including a wet detention hasin niust be approved by DWQ before wetland (or stream)
impacts occur. Als( before any building is occupied at the subject site, the approved stormwater treatment facilities sha
he constructed and operational and the approved stormwater management plat! shall be implemented.
If you do not accept any of the conditions of this Certification, you may ask for an adjudicatory hearing. You must
act within 6n days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 15013 of the North Carolina General Statues to the office of Administrative Hearings, PO Box 27447, Raleigh, NC
2761 1-7447 This Certification and its conditions are final and binding unless you ask for hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Reference: Proposed Box Culverts Under Winchester Drive in Turkey Creek
Dear Mr. Jelenevsky:
Four ten feet (10') wide by eleven feet (11') feet tall culverts are being designed to pass
the one hundred year FEMA floodwaters of Turkey Creek under the proposed
construction of Winchester Drive. In designing the culverts the roadway has been lowered
as much as possible and the roadway cross section minimized over the culvert to reduce
the impacts on the stream by the culvert length and extent of roadway fill.
Turkey creek in the vicinity of Winchester Drive has an average channel bottom width of
twelve feet (12'), top width of twenty-one feet (21'), and a depth of approximately two
feet (2'). The stream is located in a broad floodplain. Soil borings indicate that the depth
to bedrock is approximately seven feet below the valley floor.
The land in this area has severe topographic relief with an elevation difference from the
ridge crest to the stream valley floor of approximately forty feet (40'). The fill over top of
the culverts even with the roadway lowered still has a substantial twenty three feet (23') of
fill overtop. The culvert wing walls had to be designed with an extended length to retain
the roadway fill placed at a 2:1 slope.
Turkey Creek changes horizontal alignment through a significant bend in the creek at the
proposed roadway location. The normal flow of Turkey Creek enters and exists the
roadway fill area at an approximate forty-five (45) degree angle to the road. If the culverts
were placed at this angle the culverts would be very long and the stream overall length
would be notably shortened. The culverts have been placed in a ninety-seven degree angle
to the roadway to avoid conflicts with the northwest wing wall and the existing sanitary
sewer casement. The proposed new stream alignment will maintain the overall length of
the stream to within 5% of the original distance.
The culvert location also minimizes impacts ul the proposed channel configuration
transition downstream of the culvert to the adjacent property. The fill over the top of the
culverts has also been limited by, placing the crossing at the lowest part possible of the
vertical curve.

Initially consideration was given to place two culverts at the channel elevation and the
second two culverts at the floodplain elevation two feet higher. For construction
economics and FEMA modeling conventions the four culverts were placed all at the same
elevation equal to the natural channel bottom. The stream most likely will silt in it's own
path through the four (4) box culverts as it recreates it's natural channel pattern and
dimensions for bank full flow in this widened stream channel.

RE: WINCHESTER DRIVE CROSSING
over TURKEY CREEK
CITY OF RALEIGH
Winchester Drive is a City of Raleigh designated collector street that will
link Ebenezer Church Road with Lake Anne Drive and will parallel Glenwood
Avenue (Highway 70). The purpose of this road is to reduce traffic on the over.
crowded Glenwood Avenue and to reduce the number of driveway openings
onto Glenwood Avenue.
This portion of Winchester Drive that we are proposing to construct is
the last link in the construction of Winchester Drive. The project cost of design
and construction will be jointly shared by the City of Raleigh and the adjoining
property owners.
The roadway design has been sensitive to the Impacts on Turkey Creek.
Winchester Drive has been lowered over 6 feet from the original design and the
roadway width crossing the creek has been revised from 60 ft. width to 54 ft.
width. These and other design considerations will assist in minimizing the
impacts on Turkey Creek.
