APPROVAL OF 401 Quality Certification and ADDITIONAL CONDITIONS and Tar-Pamlico River

Dear Mr. Bradley:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.12 acres of wetlands, for
the purpose of developing this Spring Garden (Baker Track) Subdivision at US 64 and NR Winsted Avenue, as you described in your application
dated January 30, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number
3287, This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. This approval is also valid for the
Tar-Pamlico River buffer rules (15A NCAC 213 .0259). In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the
future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire
when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must
follow the conditions listed in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet
of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall
be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
2. An additional condition is that stormwater shall be directed to sheetflow at non-erosive velocities through the protected stream buffers.
3. Impacts to wetlands and protected stream buffers on lot 20 are not approved by this certification. The purchaser or developer of Lot 20 must
be given a copy of this Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the
date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 4Q1 of the Clean Water Act. If you have any questions,

To install the sewer line a twenty-foot easement is required with an additional temporary ten-foot
construction easement on the north side of the line. Trenches will be excavated using a trackhoe.
Any wetland disturbance in this 10' construction easement in Unit 1 will be graded to the pre-
existing elevation and allowed to regenerate to its previous state (0.0108 acres). After construction
the wetland areas along the twenty-foot easement will be graded to the pre-existing elevation and
seeded for grass (0.0523acres). Additional areas for road crossings (Units 2&3) will fill 0.0539
acres of wetlands. The road including the right-of-way will be 50 feet wide. The ditch that extends
south from Springflower Dr. terminates before the wetland line and no wetlands are impacted. The
ditch ends with a rip rap gravel sedimentation basin outside the edge of the wetlands.
13. PURPOSE OF PROPOSED WORK: The construction of the sewer line will be necessary
in sustaining the development of the proposed subdivision and the roads will provide access to the
area.
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN
WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) :
The proposed path of the sewer line was selected to avoid as many wetlands as possible. One of
the roads and the sewer line have been moved to avoid 0.3759 acres of wetlands. The sewer line
at Unit 1 on the map was also moved from the property line and placed along the proposed road
and lot line to avoid wetlands.

To install the sewer line a twenty foot easement is required with an additional temporary ten foot
construction easement on the north side of the line Trenches will be excavated using a trackhoe.
Any wetland disturbance in this 10' construction easement in Unit 1 will be graded to the pre-
existing elevation and allowed to regenerate to its previous state (0.0108 acres) After construction
the wetland areas along the twenty foot easement will be graded to the pre-existnq elevation and
seeded for grass (0 0523acres) For Unit 2 (0.3070 acres) the trenches will be installed with a road
filled in over the sewer line The road including the right-of-way will be 50 feet wide. Additional
areas for road crossings only (Units 3,4&5) will fill 0 1225 acres of wetlands.
13. PURPOSE OF PROPOSED WORK: The construction of the sewer line will be neccesary
in sustaining the development of the proposed subdivision and the roads will provide access to the
area.
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN

The proposed path of the sewer line was selected to avoid as many wetlands as possible_ by
installing the line along the the path of the proposed road. The line was moved out of the wetlands
and placed along the property line near Unit 1 on the map.

your consultant has flagged a wetland line on the property, Corps staff will review it,
and, if it is accurate, we strongly recommend that you have the line surveyed for final
approval by the Corps. The Corps will not make a final jurisdictional determination on
your property without an approved survey.

Army permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311).
A permit is not required for work on the property restricted entirely to existing high ground. If

Reference is made to the application of December 19, 2000, submitted on your behalf by
Mr. Steven of Appian Consulting Engineers, PA for Department of the Army (DA) permit
authorization for the proposed discharge of fill material associated with the construction of road
and sewer crossings for Spring Garden Subdivision, located on the south side of Hunter Hill
Road (SR 1604), 2000 feet west of Winstead Avenue (SR 1615), in Rocky Mount, Nash County,
North Carolina. The proposed work will result in adverse impacts to 0.4926 acre of
jurisdictional waters of the United States, including wetlands, adjacent to an unnamed tributary
of Stony Creek.
Nationwide Permit General Condition 19 mandates that projects must be designed to
avoid and minimize adverse effects to waters of the United States to the maximum extent
practicable at the project site (i.e., onsite). Following a review of your permit application, it was
determined that there may be alternate site development plans which may result in reduced
impacts to jurisdictional wetlands. Please indicate all that you have done, especially regarding
the modification of plans and proposed construction techniques, to minimize adverse impacts
(i.e., to reduce the discharge of fill material into waters of the United States as much as
practicable). Specifically, your response should provide justification as to why the proposed road
alignment does not utilize upland areas on the property.
General Condition 19 also states that mitigation will be required when necessary to
ensure that the adverse effects to the aquatic environment are minimal, and it requires
compensatory mitigation at a minimum 1:1 ratio for all wetland impacts requiring a
preconstruction notification application (any impact in excess of 0.1 acre for nationwide permit
39). Currently, your application does not include a mitigation plan. In your response, please
provide a detailed plan of proposed mitigation for our consideration for any impacts in excess of
0.1 acre, or describe alternative measures to mitigate for impacts to aquatic resources (which may
include wetland preservation on and off site).
Your response to the above concerns is required to complete your application and to
facilitate our expeditious processing of your request. Also, a copy of this information should be
sent to the North Carolina Division of Water Quality to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act.
Please be reminded that issuance of DA authorization must precede any placement of
excavated or fill material within any waters of the U.S. on your property. Should you have any
