Stevens Division of Water Quality June 12, 2001 Cumberland County DWQ Project # 001100 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Erich Hoffman Public Works Business Center Department of the Army XVIII Airborne Corps & Fort Bragg Fort Bragg, NC 28907-5000 Dear Mr. Hoffman: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 118 linear feet of streams for the purpose of constructing the POV 41877 Heavy Drop Rigging Facility at Fort Bragg as described in your revised application dated February 21, 2001. After reviewing your revised application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that a final, written stormwater management plan including a constructed wetland shall be approved by this Office before the impacts specified in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. This is also the most secure route as it affords a threat the least opportunity to interfere with its transport to its point of embarkation. Design Criteria The location of the proposed Heavy Drop Rigging Facility is based upon multiple conditions, such as the proximity to the loads to be rigged, the proximity of the loading area for the rigged loads, and the required explosive distance from adjacent facilities. One of the requirements for the Heavy Drop Rigging Facility project is for a direct roadway connection between the proposed facility and Rifle Range Road. This is needed for the efficient transportation of rigged loads to the loading ramps adjacent to the flight line. On the Rigging Facility end, the road needs to connect to the center of the proposed hardstand since rigged loads are prepared on both sides of the facility. On Rifle Range Road, the most direct connection point is the existing drive in front of the current rigging facility, which extends about 500' from Rifle Range Road and therefore reduces the required length of the proposed road. The proposed route between these two points as shown in the construction plans is the most direct, as it connects the two points in the shortest distance with the minimum amount of horizontal curvature. Since this road is to serve tractor trailers carrying rigged loads, the horizontal curves on this route are of great importance due to the limited maneuverability of the tractor trailer vehicles. The proposed location of the crossing of McPherson Creek is dependent on the location of the roadway. Based upon all of the above information, the proposed road and the dependent creek crossing are already in the most logical location given the use of the facility and the purpose of the road. These changes reflect our application DWQ# 001100. The design modification resulted in a net loss of stream impacts of approximately 118 feet as opposed to the original 197 linear foot impact. Design changes reflect box culvert and access road relocation on McPherson Creek. In the original design the box culvert involved the meandering portion of McPherson Creek. However, the new box culvert location is south of the meander. In summary, approximately 112 feet of stream will be culverted. The designs show the project layout plan and new plans depict new box culvert location. Since the linear stream impacts are less than 150 feet, we understand no compensatory mitigation is required. Approval from DWQ is required to disturb these acres. The following questions will need to be addresses before we can process this application: 1. What length of stream will be culverted? If the length to be impacted exceeds 150 feet (as indicated on page 2 of the form), then compensatory stream mitigation will be required at a 1:1 ratio. 2. Please discuss why the existing roads cannot be used instead of constructing a new road. You responded with a concurrence letter on February 13, 1995. The latest project design indicates approximately five additional acres of pines in stand 9034 will be removed for construction of a building and fenced compound (enclosure 1). This stand consists of 54 year-old loblolly pines which occur within a half-mile of red-cockaded woodpecker (RCW) cluster 260. A surplus of forage habitat will remain (enclosure 2). Endangered plants do not occur in the affected area. St. Francis' Satyr habitat does not occur in the affected area. Based on the information provided above, the project will have "no effect" on endangered plants or on the Saint Francis' Satyr; and will "not likely adversely affect" the endangered RCW. Design changes reflect box culvert and access road relocation on McPherson Creek. In the original design the box culvert involved the meandering portion of McPherson Creek. However, the new box culvert location is south of the meander. In summary, approximately 112 feet of stream will be culverted. The revised information indicates that an additional five acres of pines in stand 9034 will be removed for the construction of a building and fenced compound; however, the foraging analysis indicates that a surplus of foraging habitat will still exist post project. Based on the Service's February 13, 1995 concurrence letter, the surplus of foraging habitat and the fact that no active red-cockaded woodpecker cluster sites will be impacted, we concur that this project is not likely to adversely affect the red- cockaded woodpecker (Picoides borealis) or any other Federally- listed species. We believe that the requirements of Section 7 of the Act have been satisfied.
