I met with you at the subject property located along Hodge Road (SR2516). north of Mingo (.Nlango Creek and west of the Neuse River. Knightdale. Wake County. The purpose of this meeting was to determine the applicability of stream features located on the property to the Neuse River Riparian Buffer Protection Reuulations (I5A NCAC 213 .0233). As a result of this meeting. in addition to information provided within your letter dated 11115100. it was determined that the stream features indicated on the "W&W Partners / Knightdale Site Project #00-5705- map provided as an attachment to your letter dated 11115100 and initialed by me on 11/27/00 are subject to 15A NCAC 2B .0233. The map indicates streams "1, 2 and 3", including the approximate location of the start of two streams ( I and 2), subject to the buffer regulations as confirmed and flagged in the field on 11115100. The stream indicated as ••3" is subject from somewhere north of the northern property line to the southern property line. The drainage features "A, D, E. F. G and I" on the attached Wake County Soil Survey are indicated containing streams within them. However, it was determined during our site visit that no "surface waters" subject to the riparian buffer protection rules actually exists within them. This office .recommends that the subject streams be properly located and identified prior to any site design to ensure compliance with 15A NCAC 2B .0233. This letter only addresses the applicability of 15A NCAC 213 .0233(3) and does not authorize any activity within the protected buffers. It was determined that Mingo Creek and features 1, 2, and 3 as shown on the attached map are subject to the Neuse River Buffers. Although other features were shown on the Wake County Soil Survey Map, no other features were determined to be subject to the Neuse Buffer Rules. Project # 00-5705 W&W Partners Attn: Michael Hunter 150 Cornerstone Drive, Suite 102 Cary, NC 27513 Re: Division of Water Quality (DWQ) Verification Meeting of the Neuse Buffer Determination for the property known as the Knightdale (Hodge Road) Site, Wake County, North Carolina Dear Mr. Hunter: On November 15, 2000, Mr. Bob Zarzecki of the DWQ, and I reviewed the channel features on the property. It was determined that Mingo Creek and features 1, 2, and 3 as shown on the attached map are subject to the Neuse River Buffers (see Neuse River Buffer Rules below). Although other features were shown on the Wake County Soil Survey Map, no other features were determined to be subject to the Neuse Buffer Rules. Mr. Zarzecki will be sending written confirmation of his findings. Neuse River Buffer Rules The Neuse River Buffer rules, which came into effect on 7/22/97, protect up to 50 feet from the edge of existing "surface waters" (intermittent streams, perennial streams, lakes, ponds and estuaries) found within the Neuse River Basin. The 50-foot buffer basically consists of two zones. The first zone is measured 30 feet landward from the top bank of streams and intended to contain an undisturbed-forested area. The second zone is measured 20 feet from the edge of the first zone and is intended to contain a vegetated buffer. A couple of notable points of the rules include; the allowance of grading with re- vegetating within Zone 2 (the outer 20 feet) and the requirement of mitigation for road crossings greater than 150 feet in width and utility lines running parallel and within the buffers. Additional Services If you choose to have us perform additional work, the following is a listing of additional services: (1) Request that the USACE verify our delineation and (2) Notification to the USACE and DWQ regarding impacts to wetlands and permitting issues, if required.
