Box 444 Elizabeth City, NC, 27906 APPROVAL of 401 Water Quality Certification Dear Dr. and Mrs. Griffin You have our approval, in accordance with the attached conditions, to place fill material in 0.125 acre and shade 0.37 acre of non-vegetated wetlands in order to renovate and reconfigure an existing dockage, place a breakwater pier, replace a bulkhead, and convert an existing parking area into three 4-unit condominiums on your property in Pasquotank County, as described in your application received by the Division of Water Quality on October 30, 2000. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. -2- 4. No vegetated wetlands will be excavated or filled. 5. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 6. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 7. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 8. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 9. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. PROJECT SUMMARY: This project is located at the Elizabeth City Ship Yard and involves the renovation and re-configuration of existing dockage, the placement of a breakwater pier enclosure to provide a safe harbor for this dockage, the replacement of 1,019 ft of bulkhead shoreline stabilization and the conversion of existing parking area into three 4-unit condominiums. . Griffin and Mary Hadley Griffin, Elizabeth City Shipyard, Elizabeth City FIELD INVESTIGATION REPORT Page 2 PROJECT SETTING The Elizabeth City Shipyard is owned by Lloyd E. and Mary Hadley Griffin and is located along the Elizabeth City waterfront on the southern bank of the Pasquotank River on Riverside Avenue. The Shipyard site is bounded by Charles Creek to the west and Butler Lane to the east and occupies approximately 2,000 feet of shoreline. The Shipyard actually consists of two separate parcels divided by _ property owned by the College of the Albemarle. This proposal concerns the eastern 2.77 acre parcel that is actually bounded by College of the Albemarle property on the west side and Butler Lane (City of Elizabeth City) on the east side. This entire vicinity of the river is developed with commercial, residential and public uses. The shipyard site has historically been used for boat fabrication and maintenance, and is currently being utilized in this capacity. Although an area of typical urban waterfront land use, this site has not been designated as an Urban Waterfront by the City of Elizabeth City and is not located within any National Registered Historical District. Almost the entire shoreline is stabilized with riprap or concrete seawall bulkhead structures. Adjacent areas are also stabilized with riprap or bulkhead structures. Most of the structures at the shipyard need either repair or replacement. Currently 10 piers are located on the eastern portion of the tract. The existing pier structures extend perpendicular into the river and range between 150 and 200 ft in length and between 8 and 16 ft in width. An eight ft wide concrete boardwalk also exists along much of the existing shoreline and concrete seawall alignment. Water depths range along the shorelin&NWL between 8 ft and 17 ft in depth. Water depths range between 19 and 37 ft, 200 to 300 ft offshore. The pier and platform to the far west appear to extend across the neighboring riparian alignment. It is estimated that the shipyard has approximately 72 existing slips available and includes approximately 22,110 sf of dockage area. Most of the pier structures need repair or replacement. Other structures or features on this tract include a rail style haul-out boatlift, a slip, a 90' x 40' (approximately) basin/boat ramp/boat lift area and a 20 ft. wide travel lift style boatlift. The site also includes existing mechanical shops, storage buildings and parking areas. Site elevation is approximately 5 ft. MSL. Existing vegetation includes some grass areas and some trees along Riverside Avenue. The site is predominately covered with buildings, asphalt, gravel or compacted surfaces. The applicant reports that approximately 77 % of the entire site is impervious, with 65 % of this area located within the Estuarine Shoreline AEC. This project will require a Storm Water Management Plan. The Pasquotank River is approximately 2,000 ft wide at this location. The federally maintained channel of the Intra-coastal Waterway begins approximately 600 ft 4 Lloyd E. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of this portion of the Pasquotank River as Joint Waters. These waters also are designated by the Coastal Resources Commission as Public Trust Area and Estuarine Waters. These waters are not open to any commercial shellfish harvests. Although submerged aquatic vegetation (SAV) are present in many areas of the Pasquotank River, there did not appear to be any SAV patches in the vicinity of this proposal and water depths in this vicinity of the river probably restrict their habitat. Upstream sections of the river are noted as spawning areas for anadromous fish species. PROTECT DESCRIPTION This proposal only concerns work on the part of the shipyard that lies to the east of the College of the Albemarle property. This project involves the replacement and re-configuration of the existing pier dockage and the placement of a breakwater pier enclosure perpendicular to the existing pier alignments, approximately 250 ft offshore. This proposal also includes the replacement of approximately 1,000 linear ft of existing rip rap or concrete/wood bulkhead shoreline stabilization with new wood or vinyl bulkhead, as well as the enlargement of the 20 ft wide travel lift. This proposal also includes the filling of an existing basin and the replacement and upgrade of fuel storage and dispensing equipment. This project also involves the conversion of existing pervious area and a parking area into three 4-unit condominiums and associated parking. Pier re-configuration includes the removal of 5 existing piers and the replacement of 5 remaining piers within their existing alignment. Two of these five piers will also include a breakwater structure that would extend around the existing marina footprint and would enclose approximately 212,500 sf (4.9 acres) of the Pasquotank River and provide a total of 67 slips. These slips would range in size to accommodate 30 ft to 100 ft vessels. The proposed pier walkways would be 8 ft in width with the exception of the pier closest to the travel lift. This pier would be 12 ft in width and also include an approximately 40 ft by 60 ft, irregular shaped, platform located at the landward end of the pier. The breakwater structure would be constructed of 12 ft wide concrete panels and would extend to an average depth of 18 feet below the NWL except in those areas where the bottom is shallower. A minimum of a 3 ft opening along the bottom of the breakwater structure would be incorporated to accommodate flushing and water quality concerns. The breakwater panels would also be constructed to allow a 12 ft gap for every 108 linear feet of breakwater structure alignment, again to address flushing and water quality concerns. This proposal also includes the replacement of 1,019 ft of existing shoreline stabilization with either treated wood or vinyl bulkhead. While most of the proposed bulkhead alignment would be an average of 2 ft waterward of the NWL Lloyd E. One of these `maximum' areas is required to provide a straight bulkhead alignment, while the other area involves the filling of an existing 3,600 sf basin and ramp area. The bulkhead construction and basin backfill will be supplied from an upland site, most probably from a location in Pasquotank County. The fill would result in 1,105 cy of material to be placed at or below the NWL. Other proposed work includes the enlargement of an existing travel lift from 20 ft to 24 ft in width, as well as the construction of two 10,000 gal. above-ground fuel tanks. The tanks would be located where the basin was previously situated, be a minimum of 40 ft from the shoreline and include a containment dike. The fuel dispensing pumps would be placed on the existing 12 ft wide pier after this pier has been renovated. The applicants also propose to construct three 4-unit condos within an existing parking area near the eastern-most portion of this tract. These units would be three stories in height with the first floor allocated to parking and storage. The foot- print of these structures would be 30 ft landward of the NWL. Each unit would have a 6 ft wide concrete walkway to access the boardwalk along the shoreline. The applicant reports that total overall site development would result in 0.94 acres of upland land disturbance and grading and that 67 % of the site would be covered in impervious type surfaces, 61 % would be within the Estuarine Shoreline AEC. ANTICIPATED IMPACTS The proposed work would result in some temporary elevated turbidity levels associated with pile placement and site disturbance. The proposed development would also result in shading of approximately 16,160 s£ (0.37 acres) of Estuarine Waters and Public Trust Area of the Pasquotank River and the filling of 5,445 sf (0.125 acres) of the same. Although this project would result in the placement of a pier and breakwater structure some 250 feet into the Pasquotank River, it would only extend slightly (approximately 50 ft) beyond the existing pier alignment and should not present any significant interference to navigation and should be well landward of the Intra-coastal Waterway and well within one fourth the width of the Pasquotank River. This proposal would also result in a net decrease in the total number of slips, as well as a net decrease in impervious surfaces within the Estuarine Shoreline of the Pasquotank River and would not result in any non- conforming uses within the Coastal Shoreline Buffer Area of Environmental Concern. In turn, this project would result in the removal of a significant amount of derelict structures from this shoreline and provide a more favorable mooring facility than currently exists. 1 Submitted By: Dennis W. Hawthorn Date: October 24, 2000 PROJECT NARRATIVE Subject Property: The subject property is located on the south banks of the Pasquotank River in the City of Elizabeth City, North Carolina. The property is bounded to the north by the Pasquotank River, to the east by Butlers Lane (unimproved city street), to the south by Riverside Avenue (improved city street), and to the west by property owned by College of The Albemarle. The subject property has historically been utilized as a boat fabrication, maintenance and storage facility and is currently being used in this capacity. Existing Conditions: The subject property currently consists of a 2.77 acre parcel of land lying on the south banks of the Pasquotank River. The parcel occupies approximately 540 linear feet of shoreline along the southern banks of the Pasquotank River. Shoreline conditions consist of approximately 180 feet of rip-rap stabilized shoreline and approximately 540 feet of bulkhead/concrete seawall stabilized shoreline. There are three boatlifts associated with this parcel, one being a 20' wide travel-lift and the other two being older railway-style lifts. There are ten existing piers associated with this parcel, extending approximately 150 feet to 220 feet in a northerly direction from the shoreline. The easternmost pier also protrudes approximately 60 feet to the east at its northernmost point, taking advantage of the skew of the parcel's eastern property line. This parcel contains some pervious area, but is also occupied by four buildings; a railway house, associated shed and generator buildings, and a 2446 sf stockroom. Additional coverage within the eastern half of the parcel consists of an existing gravel driveway and parking associated with the stockroom, a gravel parking lot running alongside Riverside Avenue, a concrete walkway running along the seawall, and concrete base for the two boatlifts. Proposed Conditions: Due to damage to the existing piers incurred repeatedly from large storms sending energy from the Pasquotank River into the shoreline of the easternmost parcel, this project proposes the reconfiguration of the piers to provide a sheltered docking area. The perimeter of the proposed docking area would consist of a pier with an attached outer wall (breakwater), extending from the pier surface to a point below the water surface (not to the river bottom, thus allowing flushing of the boat docking area). The purpose of this wall is to prevent upper wave action from entering the boat docking area. The perimeter pier will run the length of the parcel and will extend to the east to match the easternmost point of the existing piers, and to the north to match the northernmost point of the existing piers. Interior to the perimeter pier will be boat slips as follows; 4 - 100' slips A. II - 60' slips 12 - 50' slips 24 - 40' slips 16 - 30' slips In addition to the proposed pier reconfiguration. this project proposes the following site modifications: • Bulkheading of the project shoreline which is currently rip-rap stabilized. • Removal of one existing boat lift / railway and bulkheading and filling of the associated boatlift area. • Installation of above-ground fuel storage tanks beside existing stockroom with an _ associated fuel dispenser for boat access on the adjacent dock. • Replacing the existing 20 foot travel lift with a 24 foot travel lift. • Construction of (3) 4-unit condominiums on the eastern half of the eastern parcel with associated parking and pedestrian facilities. • Removal of existing impervious area adjacent to the existing shop to account for impervious area being added with the proposed condominiums. It should be noted that the site coverage within the 75' AEC for existing conditions is approximately 64.7%. This proposal reduces the site coverage within the 75' AEC slightly to 61.1%. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site.
