You have our approval. in accordance with the attached conditions and those listed below, to place till material in 0. Is

September 28. 2000. This approval is valid for the Tar-Pamlico River buffer rules (15A NCAC 2B .0259). In addition.
you should get any other federal. state or local permits before you go ahead with your project including (but not limited to i
Sediment and Erosion Control. Coastal Stormwater. Non-Discharge and Water Supply Watershed regulations. This
approval will expire when the accompanying 404 or CANIA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except as modified belm%. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold.
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with
all conditions. If total wetland tills for this project (now or in the future) exceed one acre, compensatory mitigation ma%
be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding
Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid. you must
follow the conditions listed in the attached certification and any additional conditions listed below.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447. Raleigh.
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Dear Mr. Dorney:
Please find attached seven (7) Pre-Construction Notification (PCN) applications
requesting authorization to impact the Tar-Pamlico River Buffer with a boardwalk
(extension of City's greenway system) as discussed in our September 13°i phone
conversation (NO FEE REQUIRED). We n e? a determination to made by your

submit to CAhTV for a major permt. I your office will not authorize the
construction wit in the buffer, there is no need for the City to apply for a CAMA
permit. The third page of the PCN applications is a copy of a faxed signature from
the City in order to get the review started. An original will be mailed to your
office by the City.

We will be impacting approximately 1,230 lineal- feet of buffer (0.18 acres) with a
boardwalk. Note that the boardwalk will not create impervious area as all
stormwater will drain off the boardwalk directly in to the newly constructed
Stormwater wetland. The Stormwater wetland has been permitted by Land Quality
(permit no. NPDES - NCGO10000) and Stormwater (permit no. SW7000706)
sections of NCDENR. The wetland construction within the buffer was authorized
by NCDENR in a letter to the City of Washington dated August 1, 2000 (DWQ
Project # 000984). The construction of the boardwalk will not require additional
erosion control measures nor will it modify the existing stormwater permit.
However, the addition of the boardwalk will be submitted to Land Quality and
Stormwater for their records.

A boardwalk is to be constructed adjacent to / along the Pamlico River using a backhoe, pile driver, and

maintaining the newly constructed stormwater wetland.

Activity: Construction of Boardwalk (Extension of Greenway)
Location: County: Beaufort Specific: Located along waterfront off of Water Street on the east
side of the North Carolina Estuarium

Explanation: The boardwalk is to be an extension of the City's waterfront boardwalk which
extends from the west side of the Estuarium. The boardwalk will connect to an
existing deck located over the water in front of the Estuarium (which will be
extended to the property line under a "letter a refinement" from LAMA) and run
over the river to just beyond the emergency bypass and then over into the buffer
area and down the edge of the river and eventually terminate at Water Street. The
total length of the boardwalk is approximately 1,890' with approximately 1,230'
of the boardwalk located within the Pamlico River buffer. Please see the attached
drawing. The boardwalk will serve both as part of the City's reg enway system, an
extension to the Estuarium's educational facility, and as a means for maintaining
the wetland. Locating the walk anywhere other than where proposed will sacrifice
its total use potential.
Controlling Impacts: Standard erosion control measures will be used to minimize any land
disturbances during construction. The boardwalk will not create additional
ous area.
