Biologists with the North Carolina Wildlife Resources Commission have reviewed the
subject pre-construction notification. Our comments are provided in accordance with provisions
of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Stat.
401, as amended; 16 U.S.C. 661-667d), and North Carolina General Statutes (G.S. 113-131 et
seq.).
Applicant proposes to impact 0.2415 acres and 558 linear feet of stream and wetlands
with culverts and fill for access roads, two storm water treatment basins, and lot fill on a 63-acre
tract of land for a residential development, Governor's Forest Subdivision. The stream that runs
through the project is a tributary to Morgan Creek and flows into Jordan Lake of the Cape Fear
River drainage basin.
We recommend that the following conditions be incorporated into the permit to reduce
impacts to 1-ish and wildlife resources.
Straightening and placing the stream in a pipe renders that segment devoid of lile and
may increase flows and flooding downstream. There are many lots proposed for this
subdivision, and according to the site map, lot numbers 4 and 5 will impact the stream
with lot fill. It does not appear that the applicant attempted to avoid or minimize impacts.
We request that lot numbers 4 and 5 either not be developed, be reduced in size, or that
an alternate lot configuration be designed, and that the stream be allowed to remain in its
natural channel. As a lesser-preferred alternative, reroute and reestablish the stream to
the edge of the proposed lots, utilizing bioengineering methods, rather than permanently
impacting stream channel.

2. Use bridges for all permanent roadway crossings of streams to eliminate the need to fill
and culvert. If culverts must be used, the culvert should be designed to allow for fish
passage. Generally, this means that the culvert or pipe invert is buried at least one foot
below the natural streambed. If multiple cells are required, the second and/or third cells
should be placed so that their bottoms are at stream bankfull stage (similar to Lyonsfield
design). This will allow sufficient water depth in the culvert or pipe during normal flows
to accommodate fish movements. If culverts are long, baffle systems are required to trap
gravel and provide resting areas for fish and other aquatic organisms. If multiple pipes or
cells are used, at least one pipe or box should be designed to remain dry during normal
flows to allow for wildlife passage. In addition, culverts or pipes should be situated so
that no channel realignment or widening is required. Widening of the stream channel at
the inlet or outlet of structures usually causes a decrease in water velocity causing
sediment deposition that will require future maintenance. Finally, riprap should not be
placed on the streambed.
A minimum 50-foot undisturbed, forested buffer should be maintained along all
intermittent streams and wetland areas, while a minimum 100-foot undisturbed, forested
buffer should be maintained along all perennial streams within the project area.
Maintaining undisturbed, forested buffers along these areas will minimize impacts to fish
and wildlife resources, water quality, aquatic habitat both within and downstream of the
project area, and help prevent the extirpation of endangered and threatened species. In
addition, wide riparian buffers are helpful in maintaining stability of stream banks and for
treatment of pollutants associated with urban stormwater.
4. Locate sewers and other utilities as far away from streams as functionally possible and
minimize stream crossings. It is preferable that sewers be located outside the riparian
buffers.
A 4-6-foot wide littoral shelf, planted in native herbaceous aquatic plants, should be
constructed along the edge of the water quality ponds to help mitigate some of the lost
wetland functions and aquatic habitat. In addition, native trees and shrubs should be
planted around the upper portion of the detention structure to provide avian and terrestrial
habitat and to reduce exposure of the water surface to sunlight.

APPROVAL of 401 Water Quality Certification and Additional Conditions
Dear Ms. Jennesse:
You have our approval, in accordance with the attached conditions, to place fill in 0.2415 acre of wetlands (including
0.0152 acre of temporary impacts) and 558 linear feet of streams (including 45 linear feet of temporary impacts) to construct the
Governor's Forest Subdivision in Chatham County, as you described in your application received by the Division of Water
Quality on August 10, 2000. After reviewing your application, we have determined that this fill is covered by General Water
Quality Certification Numbers 3287 and 3288. This Certification allows you to use Nationwide Permit Numbers 39 and 12
when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in
the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and the additional condition listed below.
1. Deed restrictions or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50
of all streams and ponds in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put
place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification
be found on our web site at hupllh2o.enr. state. nc. us/nc wetlands .
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B
of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

The purpose of this letter is to request the use of Nationwide Permits 39 isn rid a 401
Water Quality Certification for the construction of the proposed Governor's Forest
Subdivision located in Chatham County on the northeast side of the intersection of Old
Farrington Road (S.R. 1726) and Whippoorwill Lane (S.R. 1727) (see site vicinity map)
(UTM Coordinates; Zone 17, 679200 E, 3969400 N). Proposed wetland impacts for the
proposed construction of the residential subdivision will total &U13, '.atres! (including
0,0152 acres of temporary impacts d 558 11. of unimportant channel (45 linear feet
of temporary impact) for the construction of roads and utility lines needed to service the
proposed home lots. Construction of the subdivision will comply with the general
conditions stated within Nationwide Permits 39 and 12.
S&EC, Inc. believes that no mitigation will be required for this project. Proposed impacts
totaling 0.2263 acres and 513 linear feet of unimportant channel will utilize Nationwide
Permit 39 for the purpose of constructing a road, two storm water treatment basins
(required by the local municipality), and lot fill. The impacts are not in the floodway and
the road impact crosses the wetland / unimportant channel feature at a point, according to
the engineer's calculations, that drains approximately 27 acres (i.e. less than 1 cfs). The
remaining proposed temporary impacts of 0.0152 acres and 45 linear feet will utilize
Nationwide Permit 12 for the purpose of sewer line connection. Jean Manuele of the U. S.
Army Corps of Engineers evaluated the site and signed off on the delineation on August
18, 1995. Although no stream importance calls were made at the time of the sign off,
S&EC does not believe the features on site to be considered "important." Also, the NC
Division of Water Quality has not made determinations as to whether the features are
perennial or not, however S&EC does not believe that the features are perennial. If
wetland and/or stream mitigation is required for some unexpected reason, our client
proposes payment into the North Carolina Wetland Restoration Fund.
Road crossings were placed in areas where the least amount of impact would occur.
Woods Edge Bend perpendicularly crosses the main wetland feature at a point where it is
the narrowest.

A buffer has been placed around a portion of the wetlands on property (see impact map).
Designated open space on the property totals 6.187 acres. The open space areas should
help to reduce and control erosion and run-off. Also, weirs will be installed on the
drainage features to treat the stormwater before it exits the property.
Included are: (1) a completed Pre-Construction Notification Application, (2) Agent
Authorization Form, (3) USGS Site Vicinity Map, (4) Construction Plans, (5) Upland and
Wetland Data Sheets and (6) a check for $475.00 to cover the 401 certification fee.

SUBJECT: Pro-construction Notification Application t Governor's Forest Subdivision,
Chatham County, North Carolina. DWQ 001051
Biologists with the North Carolina Wildlife Resources Commission have reviewed the
subject pre-construction notification. Our comments are provided in accordance with provisions
of the Clean Water Act of 1977 (as amended), the Fish awl Wildlife Coordination Act (48 Stat.
401, as amended; 16 U.S.C. 661-667d), and North Carol a General Statutes (G.S. 113-131 et
seq.). J
Applicant proposes to impact 0,2415 acres and 55P linear feet of stream and wetlands
with culverts and fill for access roads, two storm water treatment basins, and lot flit on a 63-acre
tract of land Ior a residential development, Governor's Subdivision. The stream that runs
through the project is a tributary to Morgan Creek and flos into Jordan Lake of the Cape Fear
River drainage basin. S
We recornnund that the following conditions be i corporated into the permit to reduce
impacts to fish and wildlife resources.
1. Straightening and placing the stream in a pipe ren ? ers that segment devoid of life acid
may increase flows and flooding downstream, re are many lots proposed 1'or this
subdivision, and according to the site trap, lot n bers 4 and 5 will impact the stream
with lot fill. It does not appear that the applice.-• ^?*"nted to avoid or minimize ini?acts.
We request that lot numbers 4 and 5 either not be evelfoped, be reduced in size, or that
an alternate lot configuration be designed, and tha the stream be allowed to remain in its
natural channel. As a lesser-preferred alternative, route and reestablish the stream to
the edge of the proposed lots, utilizing bioengineering methods, rather than permanently
impacting stream channel.

2. Use bridges for all perrna=t roadway crossings bf streams to eliminate the need to fill
and culvert. If culverts must be used, the culvert 1?hould be desi4ned to allow for fish
passage. Generally, this means that the culvert (W,nipe invert is buried at least one foot
below the natural strcambed. If multiple cells are required, the second and/or third cells
should be placed so that their bottoms are at stye bankfull stage (similar to Lyonsficld
design). This will allow sufficient water depth in the culvert or pipe during normal flows
to accommodate fish movements. If culverts are ?ong, baffle systems arc required to trap
gravel and provide resting areas for fish and o aquatic organisms. If multiple pipes or
cells are used, at least one pipe or box should be esigaed to remain dry during normal

flows to allow for wildlife passage. In addition, vents or pipes should be situated so
that no channel realignment or widening is req ' d. Widening of the stream channel at
the inlet or outlet of structures usually eausea a ddcrease in water velocity causing
sediment deposition that will require future maint6nance. Finally, riprap should not be
placed on the strcambcd.
3. A minimum 50-foot undisturbed, forested buffer hould be maintained along all
intermittent streams and wetland areas, while a 'mum 100-foal undisturbed, forested
buffer should be maintained along aUal ams within the project area,

4. Locate sewers and other utilities as far away fro nt streams as functionally possible and
minimize stream crossings. It is preferable that abwers be located outside the riparian
buffers.
5. A 4-6-foot wide littoral shelf, planted in native h I aceous aquatic plants, should be
constructed along the edge of the water qualitt nds to help mitigate some of the lost
wetland functions and aquatic habitat. In addiyy tio , native trees and shrubs should be
planted around the upper portion of the detention tructurc to provide avian and terrestrial
habitat and to reduce exposure of the water surf c to sunlight.
