APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. Plott:
You have our approval, in accordance with the attached conditions, to place fill in 0.05 acre of vegetated wetlands in order
to construct a single-family residence and bulkhead on your property in New Hanover County, as you described in your
application dated 20 July 2000. After reviewing your application, we have determined that this work is covered by General
Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when the NC Division of
Coastal Management issues it. In addition, you should get any other federal, state or local permits before. you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and the additional condition listed below.
1. A deed notifications or similar mechanisms shall be placed on the property so that all jurisdictional wetlands and will
be protected from future wetland and/or water impact. These mechanisms shall be put in place within 30 days of
the date of this letter or the issuance of the 404/LAMA Permits (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

9. PROJECT DESCRIPTION
Figure 8 Island is a private residential barrier island located in the northeast corner of New Hanover
County, adjacent to the Atlantic Ocean and Middle Sound, between Masons and Rich Inlets. The island
is accessed.from the mainland at the end of Edgewater Club Road (SR 1402), by a private bridge over
the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway which traverses Middle Sound.
The project site is located at 423 Beach Road North. The tract is approximately .56 acre in size,
approximately 210 feet long and 90 feet wide, averaging 4' - 10' in elevation. The lot is vegetated
primarily with dune grasses, briars, wax myrtles and an occasional red cedar. There are three areas that
have been designated as "404 type" wetlands by the U. S. Army Corps of Engineers. These wetlands are
low areas in the topography between sand ridges/dunes, with no surface connection to the nearby waters.
Along the shoreline there is a broad expanse of coastal wetlands. This marsh border consists primarily
of Smooth Cordgrass (Spartina alterni, flora) with high coastal marsh plant species transitioning to the
highground. The high marsh includes: Glasswort (SalicorWa spp.), Sea Lavender (Limonium spp.), Spike
Grass (Distichlas spicata), sea oxeye (Borrichia frutescens) and Saltmeadow Grass (Spartina patens).
The Wilmington-New Hanover County Land Use Plan classifies the area as Resource
Protection/Conservation. The waters of Middle Sound.behind Figure 8 Island are classified SA-ORW,
by the NC Division of Water Quality. The waters adjacent to the project area are designated as Primary
Nursery Area by the NC Division of Marine Fisheries, as well as, being open for the harvesting of
shellfish.
The applicant is proposing to construct a single family residence on this lot. In order to do so, he is
proposing to fill 2076 square feet (.05 acre) of the total 4217 square feet of wetland area on the lot. The
applicant has received approval from the New Hanover County Health Department to install a septic tank
and drainfield to provide wastewater disposal for the residence. The future house and-dfiveway would
conform to the 25 % impervious surface coverage limitation for lots adjacent to ORW class waters. The
applicant proposes to construct a bulkhead along the property's shoreline. The vertical wooden wall would
be constructed landward of the high coastal marsh on the west side of the lot. The bulkhead would be
approximately 140 feet long and would include an additional 231 feet of return walls up the property lines

10. ANTICIPATED EMPA IS
The proposal would cause the loss of a 2076 square feet of "404 type" wetlands. Another 19,000 square
feet of high ground will be graded and filled during the construction and landscaping of the residence.

Disposal Systems ' (1 SA NCAC 18A .1900), including the following:
1.) Fill material must be sand or loamy sand (Soil Group I) and free of debris and organic material.
2.) The final six inches of fill used to cover the system must have a texture of loam to sandy clay
loam (Soil Group II and III), for the establishment of vegetative cover:
3•) Vegetative cover or organic Iitter must be removed before the fill material is incorporated. The
