This plan is submitted to meet the conditions of the Section 401, Water Quality Certification Project No. 000760, and Corps of Engineers Permit No. 200030834. This plan uses a wet detention pond as the BMP to meet the water quality requirements for the 401 certification. The pond has been designed in accordance with the "Stormwater Best Management Practices," April 1999 guidance document. We use riprap at the outlet pipe as both erosion protection and as a level spreader for the discharge prior to the final vegetative filter, before leaving our project site. The executed and notarized Operation and Maintenance Plan is included with the calculations. The wet detention basin worksheet is provided with the calculations for the basin. Please note that the final grading and internal storm drainage design for this development is not yet finalized, pending minor revisions to the land plan. The basins, however, will be constructed in accordance with these plans at the lines, grades, and elevations shown; with final grading adjustments being made in the land plan to match the pond grading. We trust this information is sufficient for your review and approval of the Stormwater Management Plan. Bryson, Chief Financial Officer Phone: 704-563-5966 Fax: 704-563-6250 t I The facility includes one (1) stormwater management wet detention basin serving approximately 4.86 acres of proposed commercial development in southeastern Charlotte, Mecklenburg County, NC. The wet detention basin is sized in accordance with "Stormwater Best Management Practices," NC Department of Environment and Natural Resources, Division of Water Quality, dated April 19, 1999. In addition, all discharge from the pond is routed through adjacent wetlands to provide additional filtering prior to discharge into the receiving stream. Inspection and Maintenance for the pond includes: 1. Monthly Inspections, or after every run-off producing rainfall event, whichever occurs first. A. Remove debris from all trash racks. B. Check and clear drawdown orifices of any obstructions. C. Check side slopes of the pond and forebay basin. Remove trash and repair any eroded or damaged areas before next rainfall event. D. Check outlet pipes. Repair or replace any dislocated riprap in discharge spreaders. Remove any trash or accumulated sediment. II. Quarterly Inspections and Maintenance: A. Inspect collection systems (storm drains, catch basins, swales, etc.) Clear accumulated trash from basin grates and boxes; check piping for obstructions. B. Check pond inlet pipes for undermining or undercutting of pipes. Repair broken pipes' replace riprap as necessary. C. Re-seed any grassed swales or slopes and repair eroded areas immediately. t t t Keffer Management - Independence Boulevard Site Stormwater Maintenance Plan Page 2 III. Every Six Months: A. Remove accumulated sediment from outlet structure(s). B. Check pond depths at at least six locations in the basin. If depth of pond is reduced to 75% of original design depth (i.e., 25% of volume loss due to sediment), remove accumulated sediment to provide at least original design depth in each pond. C. Open and close all valves on each drain line completely to insure proper operation. IV. General Maintenance: A. Mow all side slopes (interior and exterior slopes) and tops of berms, not including the submerged vegetative shelf of each pond, including al forebay basins. Mow grass to proper height for the season, but in no case higher than six inches. B. Cattails and indigenous wetland aquatic plants are encouraged along the pond perimeters and in forebay basins (on submerged vegetation shelf). Remove excess aquatic vegetation only if it completely covers surface area of any pond. C. Evaluate drawdown time of excess runoff storage volume in ponds at regular intervals. Ponds should drawdown (de-water to normal pool water surface elevations) in a minimum of two (2) days, and a maximum of five (5) days. If drawdown is not accomplished within these time parameters, inspect, clean, and repair or replace drawdown orifice(s) as required to meet the criteria. D. Maintain all ponds, piping, and structures in good working order. REQUIRED ITEMS CHECKLIST t L_! The following checklist outlines design requirements per the Stormwater Best Management Practices manual (N.C. Department of Environment, Health and Natural Resources, November 1995) and Administrative Code Section: 15 A NCAC 2H.1008. Initial in the space provided to indicate the following design requirements have been met and supporting documentation is attached. If a requirement has not been met, attach an explanation of why. The temporary pool controls runoff from the 1 inch storm event. The basin length to width ratio is greater than 3:1. The basin side slopes are no steeper than 3:1. A submerged and vegetated perimeter shelf at less than 6:1 is provided. Vegetation to the permanent pool elevation is specified. An emergency drain is provided to drain the basin. The permanent pool depth is between 3 and 6 feet (required minimum of 3 feet). The temporary pool draws down in 2 to 5 days. The forebay volume is approximately equal to 20% of the total basin volume. Sediment storage is provided in the permanent pool. Access .is provided for maintenance. A minimum 30-foot vegetative filter is provided at the outlet. A site specific operation and maintenance (O&M) plan is provided. A vegetation management/mowing schedule is provided in the O&M plan. Semi-annual inspections are specified in the O&M plan. A debris check is specified in the O&M plan to be performed after every storm event. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater. Non- Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that a final, written stormwater management plan shall be approved by this Office before the impacts specified in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. Also, before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and operational, and the stormwater management plan, as approved by this Office, shall be implemented. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. I know that you are extremely busy, and I appreciate your making me aware of the items missing from our application regarding our plan to fill a portion of wetland on the property mentioned above, which is owned by my client, Keffer Management. Please find enclosed seven (7) copies of the required documents, i.e. vicinity maps, site plans, etc. Also as we discussed, I am writing you to state my client's intent behind this request. As we have tried to sell the parcel of land in question, it has been our experience that the topographical challenges facing the potential buyer are too complex to consider moving toward purchase. It is our desire, upon approval from the State, to rough grade the entire parcel and come back to the market with a piece of real estate that has had its challenges mitigated. We are obviously willing to work with whatever requirements that might be assigned to such an endeavor in hopes of ultimately selling this parcel. At this time, we do not have any development plans. The channel on their property is mostly stormwater and intermittent. I found one crayfish in a pool near the lower end of their property. Just across the property line the stream becomes perrenial. John D. said that he had talked to these folks and said they had no site plans. True, avoidance and minimization should be done, but based on filling the upper 250 linear feet, I no objection if they do stormwater treatment for everything coming into the property. Also, do you (WU) have the application? I found what appears to be the original and the copies of the location map and property survey. The wet detention basin is sized in accordance with "Stormwater Best Management Practices," NC Department of Environment and Natural Resources, Division of Water Quality, dated April 19, 1999. In addition, all discharge from the pond is routed through adjacent wetlands to provide additional filtering prior to discharge into the receiving stream. Inspection and Maintenance for the pond includes: 1. Monthly Inspections, or after every run-off producing rainfall event, whichever occurs first. A. Remove debris from all trash racks. B. Check and clear drawdown orifices of any obstructions. C. Check side slopes of the pond and forebay basin. Remove trash and repair any eroded or damaged areas before next rainfall event. D. Check outlet pipes. Repair or replace any dislocated riprap in discharge spreaders. Remove any trash or accumulated sediment. 1 II. Quarterly Inspections and Maintenance: A. Inspect collection systems (storm drains, catch basins, swales, etc.) Clear accumulated trash from basin grates and boxes; check piping for obstructions. i B. Check pond inlet pipes for undermining or undercutting of pipes. Repair broken pipes' replace riprap as necessary. C. Every Six Months: A. Remove accumulated sediment from outlet structure(s). B. Check pond depths at at least six locations in the basin. If depth of pond is reduced to 75% of original design depth (i.e., 25% of volume loss due to sediment), remove accumulated sediment to provide at least original design depth in each pond. C. Open and close all valves on each drain line completely to insure proper operation. IV. General Maintenance: A. Mow all side slopes (interior and exterior slopes) and tops of berms, not including the submerged vegetative shelf of each pond, including al forebay basins. Mow grass to proper height for the season, but in no case higher than six inches. B. Cattails and indigenous wetland aquatic plants are encouraged along the pond perimeters and in forebay basins (on submerged vegetation shelf). Remove excess aquatic vegetation only if it completely covers surface area of any pond. C. Evaluate drawdown time of excess runoff storage volume in ponds at regular intervals. Ponds should drawdown (de-water to normal pool water surface elevations) in a minimum of two (2) days, and a maximum of five (5) days. If drawdown is not accomplished within these time parameters, inspect, clean, and repair or replace drawdown orifice(s) as required to meet the criteria. D. Maintain all ponds, piping, and structures in good working order.
