DWQ ID. 000742 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject Section 401 Certification application. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and North Carolina General Statutes (G.S. 113- 131 et seq.). The applicant proposes to culvert and fill approximately 105 linear feet of an unnamed tributary to the North Fiat River in the Neuse River Basin. The purpose of this proposed disturbance is to gain access to a parcel of property in order to construct Timberlake Commons, a residential subdivision. We hesitate to concur with the piping of any stream due to the potential negative impacts to downstream areas and the elimination of fish and wildlife habitat in the culverted section. Use bridges for all permanent roadway crossings of streams to eliminate the need to fill and culvert. If culverts must be used, the culvert should be designed to allow for fish passage. Generally, this means that the culvert or pipe invert is buried at least one foot below the natural streambed. If multiple cells are required, the second and/or third cells should be placed so that their bottoms are at stream bankfull stage. This will allow sufficient water depth in the culvert or pipe during normal flows to accommodate fish movements. If culverts are long, baffle systems are required to trap gravel and provide resting areas for fish and other aquatic organisms. In addition, culverts or pipes should be situated so that no channel realignment or widening is required. Widening of the stream channel at the inlet or outlet of structures usually causes a decrease in water velocity causing sediment deposition that will require future maintenance. Finally, where rock energy dissipaters are necessary, we prefer the use of natural river stone to rip rap. We are unable at this time to effectively comment on the proposed project impacts due to lack of information included in the permit application. Specifically, we request detailed design of the culvert crossing, energy dissipater, and sediment and erosion control structures. Stevens, Director A,* D E N R September 15, 2000 DWQ# 00-0742 Person County Howard Whitfield 6962 Burlington Road Hurdle Mills, NC, 27541 APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules with Additional Conditions Dear Mr. Whitfield: You have our approval, in accordance with the attached conditions, to construct a road crossing impacting 120 linear feet of an unnamed perennial tributary to the North Flat River in Person County, as you described in your application received by the Division of Water Quality on June 6. 2000 and in follow-up correspondence dated August 2, 2000. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3239. y This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse River Buffer Rules (15A NC AC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 401 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands . If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and Neuse Buffer Rules. The section of road that is being proposed extended from the main area of land that is known as Timberlake Commons. The part of the devPopmcnt that is not under the owner's control is the new Timberlake Commons Shipping Center. The shopping center is being designed by Ballentine and Associates of Chapel Hill. They have designed three detention/retention facilities on their property. Thesd basins meet the requirements of Person County and the State ofNorth Carolina. The remaining areas of the subdivision have not been designed and the density has not been determined. At the time of final design the stormwater will be managed per the rule.. °Person County and the State of North Carolina. The proposed 16 lot residential subdivision has a pro? Nam local residential strip pavement road. The ditches will be destned to die the water. The water from the ditches will not flow directly into the Neusc River b ers. Prior to the water entering the buffers, the water will be diverted from the ditch lie into a level spreader. This spreader will reduce the velocity and allow the water to shed w into the buffer area. Please attach this information to the previously submitted materials. The only encroachment of this creek will be at the location of crossing. All other areas along the stream that are controlled by the property owner Will not be affected. As seen by the lot layout the lot buildable areas do not encroach into the buffer areas. Our comet is are provided in accordance with provisions of the Clean Water Act of 1977 (as amended),fthe Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and Nolih Carolina General Statutes (G.S. 113- 131 et seq.).
