After reviewing'your application, we have decided that this fill is covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150E of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The proposed Windy Ridge Subdivision is located south of NC 16 in northwest Charlotte, Mecklenburg County (NC Grid X-1432500, Y-560000). The site is shown on the attached plans and USGS Topo Quad vicinity map. Proposed impacts to jurisdictional waters will total 0.208 acres for Iroad crossing and lot fill. Construction of the subdivision will comply with all of the general conditions stated within Nationwide Permit 39. Proposed stream channel impacts total 264 linear feet. Proposed impacts to important streams total 100 linear feet and involve a single perpendicular crossing (see construction plans). Although not confirmed by NC DWQ or USACE, S&EC believes that no stream mitigation will be required for this project because impacts to significant channels are unavoidable, perpendicular, minimized, and less than 150 linear feet. If for some reason mitigation is required, our client proposes payment into the North Carolina Wetland Restoration Fund. S&EC can meet with either agency on-site if needed for confirmation. Please allow a couple of days for scheduling. This letter has been issued to illustrate the justification for the wetland impacts requested in the permit being submitted by S&EC for the aforementioned project. We respectfully request that the USACE and NCDENR-DWQ issue the requested permit due to the following reasons: • The project boundary contains 0.696 acres of wetlands. The layout of the subdivision was intentionally designed to avoid wctland impacts as much as possible. 13.2 acres of common area have been incorporated into the site plan to avoid wetland disturbance to the 100, 400, and 500 series of wetlands. The total area of disturbed wetlands, shown as impact number 1 on the Wet/und Lnpuct Mal) is 0.197 acres. • The 0.197 acres of disturbed wetlands have been determined by S&EC personnel to be a low quality wetland feature. • The 163.91 l.f. of channel through the impacted wetlands has also been determined by S&EC personnel to be an insignificant feature. • Significant channel disturbance has been avoided at all but one location. The three significant channels on site have a combined length of 4,365 I.f. with a requested impact length of' 100 11. The westerly flowing channel disturbance shown as impact number 2 on the 14'el/und ImInicl Mup is necessary to provide access to the portion of the property on the south side of this channel. This portion of property is land- locked and has no other access available due to the surrounding channels and railroad tracks.
