HomeMy WebLinkAbout20000585 Ver 1_COMPLETE FILE_20000502REPLY TO ATTENTION OF: Regulatory Division DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403 October 17, 2000 Action ID No. 200001085 and State Permit No. 123-00 Ms. Loren Dickey Southern Lifestyles, LLC Post Office Box 10476 Wilmington, North Carolina 28405 Dear Ms. Dickey: Reference your application for a Department of the Army (DA) permit to construct a nine (9) slip community pier with five (5) finger piers and to construct a sanitary sewer line extension with fill place in wetlands adjacent to the Intracoastal Waterway, in the Windy Hills Subdivision, south of Wilmington, New Hanover County, North Carolina. Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. 198000291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. Please be advised that the following are conditions of this DA permit: 1. No portion of the community pier will be located nearer than 80 feet from the near bottom edge of the Federally maintained Atlantic Intracoastal Waterway. To ensure compliance with this condition, an as-built survey of the pier will be submitted to the Corps of Engineers within 30 days of the completion of pier construction. 2. The permittee shall properly record restrictive covenants, approved by the District Engineer, with the Register of Deeds for New Hanover County, so that they appear in the chain of title for the described property, prior to the sale or development of any lots within the Windy Hills subdivision, and within thirty days of the date of this authorization. The permittee shall provide the Corps of Engineers with a copy of the recorded restrictive covenants as soon as possible. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. The plans depict the revision of the pier's floating T-head from a width of 8 feet to 6 feet. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 4. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 5. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6. No excavated or fill materials will be placed at any time, including temporarily, in any vegetated wetlands or waters outside the footprint of fill as shown in the permit plans. 7. Preconstruction substrate and wetland bottom contours will be restored and all excess material will be removed to a high ground retention area immediately following completion of the wetland portion of the utility crossing. 8. This permit does not authorize any dredging. 9. The permittee shall properly record restrictive covenants, approved by the District Engineer, with the Register of Deeds for New Hanover County, so that it appears in the chain of title for the described property, prior to the sale or development of any lots within the Windy Hills subdivision, and within thirty days of the date of this authorization. The permittee shall provide the Corps of Engineers with a copy of the recorded restrictive covenants as soon as possible. Greater than four slips requires a Special Use Permit from New Hanover County. This request was heard by the County Commissioners on May 8, 2000 and was denied. Since then, Southern Lifestyles has re-designed the system with only four slips. Copies of these revisions were mailed to your office on May 17, 2000 and additional copies are enclosed with this letter. Essentially, the ability to concentrate boat slips in one location has been prevented at the local level. This is due to the fact that New Hanover County defines a marina as greater than four slips and has approved a new Land Use Plan which prohibits new marinas in ORW waters. The County's definition of a marina is inconsistent with NC DCM's definition of a marina (greater than ten slips). Therefore, subdivisions with more than four waterfront lots on ORW waters can obtain CAMA General permits for each individual lot but can not obtain permission from the County to concentrate these slips in one community dock location. In addition, nearly all of the waterfront lots have since been sold. At least one individual pier has already been permitted under a CAMA General Permit. PROJECT SUMAIIARY: The applicants propose to develop an eighteen (18) lot subdivision, construct a sanitary sewer line extension to become part of the New Hanover County Sewer System, and a nine (9) slip community pier. PROTECT DESCRIPTION The project area is located adjacent to the Atlantic Intracoastal Waterway, on Myrtle Grove Sound, at the northeast end of Windy Hills Drive, in New Hanover County, NC. The 9.36 acre tract is approximately 659 feet wide along the shoreline and approximately 900 feet in depth, narrowing to 252 feet in width on the west end of the tract. This portion of Windy Hills Drive is a private road which borders the south side of the property as it enters the subdivision, until turning parallel to the waterway (north) and ending in a cul-de-sac. The old road is paved with asphalt, but is in need of resurfacing. The existing subdivision includes eighteen (18) lots, and one (1) amenity parcel. The majority of the upland property is wooded, including mature Pine (Emus taeda), Oaks (Quercus virginiana), Red Cedar ( Juniperus virgin. iana), and Holly (Ilex vomitoria). The property is maintained by mowing and is devoid of any understory shrub vegetation. The property is bordered by a tidal embayment on its north side and the Atlantic Intracoastal Waterway on its east side. The marsh vegetation is primarily Smooth Cordgrass (Snartina altern'flora), but at the transition to highground, there is high coastal marsh, intermixed with Black Needle Rush (Jun us roema ianus), Spike Grass (Distich_lpicata), Sea Oxeye (Borrichia fn t acens), Sea Lavender (Limonium, spp.) and Salt Meadow Grass (Spartina patens). There are non-tidal wetlands (404 type) adjacent to the salt marsh on the property's northern shoreline where vegetation includes Pine, Red Cedar, Wax Myrtle, Yaupon, Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharus halimifolia). The border of intertidal saltmarsh along the waterway shoreline (east side) is approximately 150 to 200 feet wide. In the northeast corner of the property there is a narrow highground peninsula extending toward the waterway. Historically, it may have been originally created by placing fill through the marsh to provide a primitive boat ramp and/or water access. In the project area, the NC Division of Water Quality's water classification for Myrtle Groove Sound is SA-ORW. The Atlantic Intracoastal Waterway is approximately 700 wide at this location. The waters at this location on Myrtle Grove Sound are designated as primary nursery area (P. N. A.) by the NC Division of Marine Fisheries and they are open for shell fishing.. The applicant proposes to develop the existing 18 lot subdivision. Many of the lots have already been sold and some individual lot owners have obtained permits for lot improvements and private bulkheads and piers. The applicant has received subdivision approval from New Hanover County Planning and Zoning, as well as, an approved Sedimentation and Erosion Control Plan from New Hanover County Engineering Department. The applicant has also submitted the plans and specifications for this addition to the New Hanover County Wastewater System which have been approved by the NC Division of Water Quality (Permit #WQ0017830). The project consists of the construction of the construction of 1,108 linear feet of 8" gravity collection line, and 1,316 linear feet of 10" gravity collection line. The sewer line extension will connect Windy Hills Subdivision to the lift station at the end of Loder Ave. The project would require a subaqueous crossing of the tidal creek and marsh on the north side of the tract. The wetland crossing would be approximately 230 feet in length, with a disturbance corridor 20 feet wide. A trench, 5 feet wide, would be excavated for pipe installation and excavated material would be stockpiled on highground to either side of the wetland crossing. The work would be accomplished by mechanical equipment working from mats. At completion, the original contours would be restored and the area would be sprigged with Spartina alter i ora, if necessary. By ordinance, New Hanover County requires any new subdivisions to install the sanitary sewer system as part of the development costs. At completion, it becomes part of the County's system. The remainder of the sewer collection and pressure lines would be installed within the Windy Hills Dr. right-of-way and utility easements. The existing road would be repaved.. The 9 slip residential dock would consist of 5 nw&ting dock , 8 feet wide X 146 feet long, with five (5) perpendicular finger piers, each 4.5 feet wide and 30 feet long. The finger piers would be constructed at approximately 30 feet on center, creating 9 boat slips on the east side of the main dock. Each of these boat slips would contain an uncovered boat lift (14 ft. X 11 ft.). Water depths at the waterward end of the structure would be approximately -2.0 to -2.5 feet at mean low water (MLW). Access to the docking system would be provided by an elevated wooden pier, 200 feet long and 6 feet wide, extending from the peninsula on Lot 30 (common amenity lot). The pier would tenninate with a covered gazebo (10 ft, X 10 ft.) and ramp down to the floating docks.. The applicant is also requesting to fill a pocket (.05 acre or 2,335 sqft.) of "404 type" wetlands on lots #19 and #20. The small depressional area is not connected to the larger wetland system. 10. ANTICIPATED A T The proposed sewer line extension from Windy Hills Subdivision to the Loder Ave. lift station would create approximately 48,480 square feet of ground disturbance, of which, approximately 4,600 square feet of disturbance would be through intertidal saltmarsh. With subsequent construction of individual residences on the individual lots there will be future ground disturbance and a corresponding increase of impervious surfaces and built upon area. There will be accumulative and secondary adverse impacts to the area's water quality and coastal resources, resulting from continued residential and commercial development throughout the county in response to growth and increasing population. The proposed community docking facilities would incorporate 5,648 square feet of ORW classified estuarine waters and public trust area. The portion of the pier walkway over marsh will shade approximately 1,200 square feet of coastal wetlands. Short term increases in turbidity can be expected during piling placement. The project would provide water and boating access for nine (9) of the inland subdivision lot owners. Brooks Date: 4/27/00 Office: Wilmington PROJECT NARRATIVE Windy Hills S/D, New Hanover County, NC D &CEJJ?v7.E 117 MAR 0 3 2000 LL DIVISION OF COASTAL MANAGEMENT Purpose: Southern Lifestyles, LLC proposes work within the Windy Hills subdivision that includes (1) extension of County sewer into the subdivision (2) construction of a 9-slip, community dock system and (3) a request to fill a 0.05-acre, 404 wetland pocket for the purpose of lot development. Current Conditions: The Windy Hills subdivision abuts Myrtle Grove Sound and the AIWW in southern New Hanover County. In this area, Myrtle Grove Sound and its surrounding waters are classified as Outstanding Resource Waters (ORW). The property is accessed by Windy Hills Drive which intersects Myrtle Grove "loop" Road. Windy Hills Drive extends onto the property, ending with a cul-de-sac on the property. The tract totals 9.36 acres and contains 19 undeveloped, residential lots. These lots have been platted since 1959 and remain unchanged from the original subdivision. The site is bounded to the north by a semi-diurnal tidal creek and its associated salt marsh. This creek was, at one time, dredged near its intersection with the sound. However, there has been no recent dredging. With apparent silt deposition, the creek has gained elevation and is not inundated during low tide. Nearly all of the creek bed is now vegetated with Spartina alterniflora. The southern property edge abuts Mr. Bruce Jackson's property and an existing ditch is located along this property line. Other man-made features include a previous boat ramp, or water access, site located within lot # 30. It appears that fill (sand) was placed over coastal marsh at this location in order to provide access to the sound. Of the 9.36-acres, 2.56 acres is jurisdictional wetland. Fringe wetlands are found along the tidal creek to the north and Myrtle Grove Sound to the east. A continuum from low tidal marsh, to upper tidal marsh, to contiguous non-tidal wetlands exists along these boundaries. Typical tidal marsh vegetation is present and includes Spartina alterniflora, Spartina patens, Distichlis spicata, and Juncus roemerianus. Vegetation in the adjacent, non-tidal wetland areas includes Pinus serotina, Juniperus virginiana, Myrica cerifera, Ligustrum sinense, and Osmunda cinnamomea. Upland vegetation includes Pinus taeda, Quercus virginiana, Juniperus virginiana, and flex vomitoria. Excepting the coastal marsh, the tract is currently maintained in a mowed condition, so that an understory is largely absent. Proposed Sewer Extension: As guided by the County's master plan for sewer extension, the applicant is requesting to install a gravity sewer line that would connect to a pump station on Loder Avenue (to the north). This plan necessitates a subaqueous installation in the tidal creek to the north of Windy Hills. Installation would involve excavating a 5' wide trench in the creek bed, installing the pipe, and returning the area to the original grade. Efforts to minimize environmental damage will include CAMA Major Application, Windy Hills SID, New Hanover County, NC (1) reducing the width of the disturbed area to 20'(2) the use of equipment matting within the disturbed area (3) installation of a silt fence downstream of the work area, and (4) an attempt to complete the work within one low tide. All excavated material will be temporarily stored on upland portions of the property during work. If necessary, plugs of Spartina alternij7ora will be re-located after the area has been returned to grade. It is noted that directional boring does not offer the level of accuracy needed for a gravity sewer line and, therefore, could not be used in this circumstance. Within the Windy Hills property, sewer will be installed in upland portions along the road. Sift fences will serve as a temporary erosion control and seeding will serve as permanent erosion control. Since this work will involve grading more than 1 acre, a Sedimentation and Erosion Control Plan has been prepared by Cape Fear Engineering. This plan was submitted in February 2000 and is currently under review. Proposed Community Dock System: A 9-slip community dock system, with no excavation, is proposed within the riparian corridor of lot #30 (the amenity lot). Access would be provided by a fixed wooden pier, beginning on the upland portion of the lot and connecting to a floating dock spine with an aluminum ramp. Five finger piers would provide nine boat slips. In order to offer protection, boat lifts are proposed. Riparian property lines have been determined and recorded, as seen on the enclosed figure. The dock structure, as proposed, would completely abut the adjacent riparian property lines. The applicant is seeking waivers from these lot owners. Requested Wetland Fill: The applicant requests to fill a 2,335 ft2 (or 0.05-acre) wetland pocket. The wetland is a depressional area, half of which is on lot # 19 and half of which is on lot 420. Although it is below headwaters and considered to be "adjacent" wetland by the ACOE, it is physically and hydrologically disconnected from the larger wetland system. The location of this pocket on the lots would require a somewhat awkward house design, especially for lot # 19. The applicant is investigating the possible use of restrictive covenants for the remaining adjacent wetlands. PROJECT SUMMARY: The applicants propose to develop an eighteen (18) lot subdivision, construct a sanitary sewer line extension to become part of the New Hanover County Sewer System, and a nine (9) slip community pier. PROTECT DESCRIPTION The project area is located adjacent to the Atlantic Intracoastal Waterway, on Myrtle Grove Sound, at the northeast end of Windy Hills Drive, in New Hanover County, NC. The 9.36 acre tract is approximately 659 feet wide along the shoreline and approximately 900 feet in depth, narrowing to 252 feet in width on the west end of the tract. This portion of Windy Hills Drive is a private road which borders the south side of the property as it enters the subdivision, until turning parallel to the waterway (north) and ending in a cul-de-sac. The old road is paved with asphalt, but is in need of resurfacing. The existing subdivision includes eighteen (18) lots, and one (1) amenity parcel. The majority of the upland property is wooded, including mature Pine (Pious taeda), Oaks (Quercus virginiana), Red Cedar ( Juninerus virgin iana), and Holly (Ilex vomitoria). The property is maintained by mowing and is devoid of any understory shrub vegetation. The property is bordered by a tidal embayment on its north side and the Atlantic Intracoastal Waterway on its east side. The marsh vegetation is primarily Smooth Cordgrass (Spartina alterniflora), but at the transition to highground, there is high coastal marsh, intermixed with Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Oxeye (Borrichia frutescens), Sea Lavender (Limonium, spp.) and Salt Meadow Grass (Sppartina patens). There are non-tidal wetlands (404 type) adjacent to the salt marsh on the property's northern shoreline where vegetation includes Pine, Red Cedar, Wax Myrtle, Yaupon, Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharus halimifolia). The border of intertidal saltmarsh along the waterway shoreline (east side) is approximately 150 to 200 feet wide. In the northeast corner of the property there is a narrow highground peninsula extending toward the waterway. Historically, it may have been originally created by placing fill through the marsh to provide a primitive boat ramp and/or water access. In the project area, the NC Division of Water Quality's water classification for Myrtle Groove Sound is SA-ORW. The Atlantic Intracoastal Waterway is approximately 700 wide at this location. The waters at this location on Myrtle Grove Sound are designated as primary nursery area (P.N.A.) by the NC Division of Marine Fisheries and they are open for shell fishing.. The applicant proposes to develop the existing 18 lot subdivision. Many of the lots have already been sold and some individual lot owners have obtained permits for lot improvements and private bulkheads and piers. The applicant has received subdivision approval from New Hanover County Planning and Zoning, as well as, an approved Sedimentation and Erosion Control Plan from New Hanover County Engineering Department. The applicant has also submitted the plans and specifications for this addition to the New Hanover County Wastewater System which have been approved by the NC Division of Water Quality (Permit #WQ0017830). The project consists of the construction of the construction of 1,108 linear feet of 8" gravity collection line, and 1,316 linear feet of 10" gravity collection line. The sewer line extension will connect Windy Hills Subdivision to the lift station at the end of Loder Ave. The project would require a subaqueous crossing of the tidal creek and marsh on the north side of the tract. The wetland crossing would be approximately 230 feet in length, with a disturbance corridor 20 feet wide. A trench, 5 feet wide, would be excavated for pipe installation and excavated material would be stockpiled on highground to either side of the wetland crossing. The work would be accomplished by mechanical equipment working from mats. At completion, the original contours would be restored and the area would be sprigged with Spartina alterniflora, if necessary. By ordinance, New Hanover County requires any new subdivisions to install the sanitary sewer system as part of the development costs. At completion, it becomes part of the County's system. The remainder of the sewer collection and pressure lines would be installed within the Windy Hills Dr. right-of-way and utility easements. The existing road would be repaved.. Southern Lifestyles, LLC/Windy Hills Subdivision Page 3 The applicant proposes to construct a community pier and dock to provide water/boating access to the subdivision's interior property owners. The 9 slip residential dock would consist of a floating dock , 8 feet wide X 146 feet long, with five (5) perpendicular finger piers, each 4.5 feet wide and 30 feet long. The finger piers would be constructed at approximately 30 feet on center, creating 9 boat slips on the east side of the main dock. Each of these boat slips would contain an uncovered boat lift (14 ft. X 11 ft.). Water depths at the waterward end of the structure would be approximately -2.0 to -2.5 feet at mean low water (MLW). Access to the docking system would be provided by an elevated wooden pier, 200 feet long and 6 feet wide, extending from the peninsula on Lot 30 (common amenity lot). The pier would terminate with a covered gazebo (10 ft, X 10 ft.) and ramp down to the floating docks.. The applicant is also requesting to fill a pocket (.05 acre or 2,335 sqft.) of "404 type" wetlands on lots #19 and #20. The small depressional area is not connected to the larger wetland system. 10. ANTICIPATED IMPACTS The proposed sewer line extension from Windy Hills Subdivision to the Loder Ave. lift station would create approximately 48,480 square feet of ground disturbance, of which, approximately 4,600 square feet of disturbance would be through intertidal saltmarsh. With subsequent construction of individual residences on the individual lots there will be future ground disturbance and a corresponding increase of impervious surfaces and built upon area. There will be Xtumulative and secondary adverse impacts to the area's water quality and coastal resources, resulting from continued residential and commercial development throughout the county in response to growth and increasing population. The proposed community docking facilities would incorporate 5,648 square feet of ORW classified estuarine waters and public trust area. The portion of the pier walkway over marsh will shade approximately 1,200 square feet of coastal wetlands. Short term increases in turbidity can be expected during piling placement. The project would provide water and boating access for nine (9) of the inland subdivision lot owners. Brooks Date: 4/27/00 Office: Wilmington PROJECT NARRATIVE Windy Hills S/D, New Hanover County, NC D C E z VF MAR 0 3 2000 COASTAL 1MAONAGEME NT Purpose: Southern Lifestyles, LLC proposes work within the Windy Hills subdivision that includes (1) extension of County sewer into the subdivision (2) construction of a 9-slip, community dock system and (3) a request to fill a 0.05-acre, 404 wetland pocket for the purpose of lot development. Current Conditions: The Windy Hills subdivision abuts Myrtle Grove Sound and the AIWW in southern New Hanover County. In this area, Myrtle Grove Sound and its surrounding waters are classified as Outstanding Resource Waters (ORW). The property is accessed by Windy Hills Drive which intersects Myrtle Grove "loop" Road. Windy Hills Drive extends onto the property, ending with a cul-de-sac on the property. The tract totals 9.36 acres and contains 19 undeveloped, residential lots. These lots have been platted since 1959 and remain unchanged from the original subdivision. The site is bounded to the north by a semi-diurnal tidal creek and its associated salt marsh. This creek was, at one time, dredged near its intersection with the sound. However, there has been no recent dredging. With apparent silt deposition, the creek has gained elevation and is not inundated during low tide. Nearly all of the creek bed is now vegetated with Spartina altern flora. The southern property edge abuts Mr. Bruce Jackson's property and an existing ditch is located along this property line. Other man-made features include a previous boat ramp, or water access, site located within lot # 30. It appears that fill (sand) was placed over coastal marsh at this location in order to provide access to the sound. Of the 9.36-acres, 2.56 acres is jurisdictional wetland. Fringe wetlands are found along the tidal creek to the north and Myrtle Grove Sound to the east. A continuum from low tidal marsh, to upper tidal marsh, to contiguous non-tidal wetlands exists along these boundaries. Typical tidal marsh vegetation is present and includes Spartina alterniflora, Spartina patens, Distichlis spicata, and Juncus roemerianus. Vegetation in the adjacent, non-tidal wetland areas includes Pinus serotina, Juniperus virginiana, Myrica cerifera, Ligustrum sinense, and Osmunda cinnamomea. Upland vegetation includes Pinus taeda, Quercus virginiana, Juniperus virginiana, and flex vomitoria. Excepting the coastal marsh, the tract is currently maintained in a mowed condition, so that an understory is largely absent. Proposed Sewer Extension: As guided by the County's master plan for sewer extension, the applicant is requesting to install a gravity sewer line that would connect to a pump station on Loder Avenue (to the north). This plan necessitates a subaqueous installation in the tidal creek to the north of Windy Hills. Installation would involve excavating a 5' wide trench in the creek bed, installing the pipe, and returning the area to the original grade. Efforts to minimize environmental damage will include CAMA Major Application, Windy Hills SID, New Hanover County, NC (1) reducing the width of the disturbed area to 20'(2) the use of equipment matting within the disturbed area (3) installation of a silt fence downstream of the work area, and (4) an attempt to complete the work within one low tide. All excavated material will be temporarily stored on upland portions of the property during work. If necessary, plugs of Spartina alterniflora will be re-located after the area has been returned to grade. It is noted that directional boring does not offer the level of accuracy needed for a gravity sewer line and, therefore, could not be used in this circumstance. Within the Windy Hills property, sewer will be installed in upland portions along the road. Silt fences will serve as a temporary erosion control and seeding will serve as permanent erosion control. Since this work will involve grading more than 1 acre, a Sedimentation and Erosion Control Plan has been prepared by Cape Fear Engineering. This plan was submitted in February 2000 and is currently under review. Proposed Community Dock System: A 9-slip community dock system, with no excavation, is proposed within the riparian corridor of lot #30 (the amenity lot). Access would be provided by a fixed wooden pier, beginning on the upland portion of the lot and connecting to a floating dock spine with an aluminum ramp. Five finger piers would provide nine boat slips. In order to offer protection, boat lifts are proposed. Riparian property lines have been determined and recorded, as seen on the enclosed figure. The dock structure, as proposed, would completely abut the adjacent riparian property lines. The applicant is seeking waivers from these lot owners. Requested Wetland Fill: The applicant requests to fill a 2,335 ftz (or 0.05-acre) wetland pocket. The wetland is a depressional area, half of which is on lot #19 and half of which is on lot 420. Although it is below headwaters and considered to be "adjacent" wetland by the ACOE, it is physically and hydrologically disconnected from the larger wetland system. The location of this pocket on the lots would require a somewhat awkward house design, especially for lot # 19. The applicant is investigating the possible use of restrictive covenants for the remaining adjacent wetlands.
