You have our approval, in accordance with the attached conditions, to place fill material in 2,900 square feet of
wetlands and waters for the purpose of constructing a public boat ramp at Town Creek, as you described in your
application dated April 5, 2000. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre,,compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

9. PROJECT DESCRIPTION
Brunswick County is applying to construct a public boat ramp with parking. The site is located off of
Highway 17 near the Town Creek Bridge in the Winnabow area of Brunswick County. The site is
approximately 6.4 acres in size and borders Town Creek. Much of 6.4 acres have been delineated as
federal wetlands. That wetland delineation is included on the plans submitted for review and is currently
under review by the U. S. Army Corps of Engineers..
Presently the tract is wooded. There has been a small amount of fill material deposited near Highway
17 and two light posts have been installed on the tract. There are no other man-made features or
development on the tract.
Federal 404 wetlands separate the high ground portion of the tract from the waters of Town Creek. This
wetland, riverine fringe ranges in width from 30' - 100' along the entire shoreline. One of the more
narrow wetland sections has been chosen for the boat ramp location. Much of the tract is located within
the flood plain of Town Creek. Proposed wetland fill and excavation impacts include a 20' by 40' area
for the boat ramp and side slopes and a 10' by 60' isolated wetland area near the Highway 17 right-of-
way, for a total impact of 1400 square feet. Additionally there would be approximately 700 square feet
of impact to the shallow bottom resource of Town Creek.
The applicants plan to construct a public boat ramp facility by excavating through the wetland fringe and
into the bottom sediments of Town Creek to prepare a slope for a concrete slab. The slab or ramp is
proposed to be 15' wide by 35' long. 21' of the ramp would be through the federal wetlands with 14'in
the water. Once in place, the side slopes of the ramp will be stabilized by riprap. One. tie piling is
proposed to hold boats going out and coming in. Water depths in Town Creek range in depth from 7'
to 14', based upon the soundings taken of the area. See sheet labeled "Depth Soundings".
A portion of the high ground (about .85 acres) area is to graded level and gravelled for a parking area
and boat ramp access. A total of nine parking spaces are proposed.
The waters of Town Creek have been classified as C SW by the Division of Water Quality. They are
Inland Waters, closed to shellfishing as determined by Shellfish Sanitation. Town Creek is not a primary
nursery area as determined by the Division of Marine Fisheries. This area has been identified as a habitat
for He i om euc osmiu , the Greenfield Rams-Horn snail , a species listed as special concern by the State
of North Carolina.
10. ANTICIPATED EAPACTS
This project, if approved, would result in the disturbance of approximately 1.2 acres of high ground
forested land within a flood plain. Also, approximately .05 acres of wetlands and open water would be
filled and/or excavated in conjunction with the proposal. Temporary turbidity could result from the
fill/excavation in the water and along the shoreline. Native vegetation will be removed during
construction.
Potential impacts to the Greenfield Rams-Horn snail species are unknown.

PROJECT NARRATIVE
The County of Brunswick proposes to construct a public boat ramp on Town Creek, in the
Winnabow area. A 6.4-acre tract which is bounded by Town Creek and US HWY 17 would be
purchased by the County for the ramp facility. An NC DOT approved entrance from the highway
and an on-site gravel entrance/parking area would provide access to the ramp.

Current Conditions:
The 6.4-acre tract has a roughly semi-circular shape as Town Creek wraps around the property,
meeting HWY 17 on either side of the property. Town Creek is classified as freshwater at this
location, so that a Public Trust AEC is the only AEC applicable to the site. At the interface of
Town Creek and'the land, riverine wetlands are found. The wetland is a typical bottomland
hardwood community and is largely dominated by Taxodium distichum and Nyssa sylvatica. A
minimal understory exists, but herbaceous species such as Osmunda cinnamomea and Rhus
radicans are found. The continuity of this wetland fringe is somewhat interrupted on the
southeast portion of the tract (as seen on the wetland survey enclosed). In these areas, historic fill
is present and is thought to be part of the old HWY 17 road bed. Two physically isolated
wetlands naturally exist on the site and are labeled "Wetland B" and "Wetland C" on the wetland
survey. The central portion of the tract is upland with trees such as Pinus taeda, Sassafras
albidum, Quercus nigra, and Liquidambar styracflua. Again, an understory is largely absent and
a few trees are currently down as a result of Hurricane Floyd. The only existing man-made
features on the site are the historic road bed, a single lamp post, and some fill or wash-out
material adjacent to HWY 17 (as seen on the aerial photograph enclosed).
Proposed Project:
The project proposes to construct a 15' wide, concrete boat ramp on the northeastern property
edge. The ramp would begin at the wetland edge, and would extend 35' in length. This would
place 21' of the ramp length in the wetland and 14' of the ramp length on public bottom. The
proposed ramp would have a 5:1 slope. To achieve this slope, an average T of excavation
below the existing grade would be needed (this is an average across the length of the ramp). Side
slopes would be stabilized with rip-rap or gabions at a 3:1 slope. Although the width of rip-rap
from the ramp to the top of the slope will be dependent on the depth excavated, the width is
expected to be 9' on the western side and 6' on the eastern side. A hydrographic survey has been
completed and depths at the end of the proposed ramp are roughly -5' NLW. All proposed upland
development is based upon providing access to the ramp. An entrance from Hwy 17 would be
asphalt for 15', at which point the entrance would become gravel. A gravel access area to the
ramp would include nine gravel parking spaces. Total upland development including the entrance,
parking, and ramp access would cover 0.85 acres.
Avoidance and Minimization of 404 Wetland Impacts:
Impacts to jurisdictional 404 wetlands have been avoided and minimized to the greatest extent
practicable. Plans situate a single ramp at narrowest point of wetland fringe. The possibility of

11 elevating the ramp on a piling supported structure was investigated by the engineer, but was
infeasible due to the gradual slope between the upland and the creek. Parking and turn/around
areas have been planned around the wetland labeled "Wetland C" in order to avoid additional
wetland impacts. The project does propose to fill the 0.02-acre wetland labeled "Wetland B".
This wetland has been determined to be isolated by the ACOE, and has been previously impacted
from the construction of HWY 17. Even with the minimal wetland impact proposed here, a
public ramp and park may be the best usage of this floodplain-adjacent property.
Construction Methods:
Standard construction methods would be used to create the 6" concrete ramp and framework.
Rip-rap side slopes would be lined with filter fabric to enhance stabilization. Silt fencing would be
installed around the project area prior to excavation and grading within the ramp area. Permanent
ground cover would be installed at the completion of construction to prevent transport of
sediment off-site. Conditions of an approved Sedimentation and Erosion Control Plan, as well as
a Low Density Stormwater Permit would be followed. All construction activities would be
reviewed and supervised by a licensed engineer.
Sedimentation/Erosion Control and Stormwater Permit applications:
An estimated 1.2 acres of the tract would be disturbed through grading in the proposed parking
and entrance areas (only 0.85 will be "built-upon"). A Sedimentation and Erosion Control Plan
was submitted to NC Division of Land Resources in December 1999. A Stormwater Permit
application for a Low Density Project was submitted to NC Division of Water Quality in
December 1999. Efforts to minimize stormwater run-off from the ramp include slightly sloping
the ramp access area away from the ramp.

At its Regular Meeting on August 16, 1999, the Brunswick County Commissioners approved an
offer that it would extend to Young's Gas and Grocery of Winnabow, Inc. It approved a
contingent purchase of the 6,11 acres of property, identified as Lots 1-6, Whitlock Landing, as
shown on a plat recorded in Map Book 17, 445, and including all the property shown on a map
recorded in Map Cabinet 17, Page 108. The purchase price is $140,000.00. The sale is
contingent upon the County seeking and obtaining a CAMA Major Development Permit. The
County will proceed expediently in attempting to acquire the said Permit in its name, but must
acquire approval before consummating the safe.

9. PROJECT DESCRIPTION
Brunswick County is applying to construct a public boat ramp with parking. The site is located off of
Highway 17 near the Town Creek Bridge in the Winnabow area of Brunswick County. The site is
approximately 6.4 acres in size and borders Town Creek. Much of 6.4 acres have been delineated as
federal wetlands. That wetland delineation is included on the plans submitted for review and is currently
under review by the U. S. Army Corps of Engineers..

Presently the tract is wooded. There has been a small amount of fill material deposited near Highway
17 and tw is have been installed on the tract. There are no other man-made features or
developme t''? - d- tract.
Federal 404 wetlands separate the high ground portion of the tract from the waters of Town Creek. This
wetland, riverine fringe ranges in width from 30' - 100' along the entire shoreline. One of the more
narrow wetland sections has been chosen for the boat ramp location. Much of the tract is located within
the flood plain of Town Creek. Proposed wetland fill and excavation impacts include a 20' by 40' area
for the boat ramp and side slopes and a 10' by 60' isolated wetland area near the Highway 17 right-of-
way, for a total impact of 1400 square feet. Additionally there would be approximately 700 square feet
of impact to the shallow bottom resource of Town Creek.
The applicants plan to construct a public boat ramp facility by excavating through the wetland fringe and
into the bottom sediments of Town Creek to prepare a slope for a concrete slab. The slab or ramp is
proposed to be 15' wide by 35' long. 21' of the ramp would be through the federal wetlands with 14'in
the water. Once in place, the side slopes of the ramp will be stabilized by riprap. One tie piling is
proposed to hold boats going out and coming in. Water depths in Town Creek range in depth from 7'
to 14', based upon the soundings taken of the area. See sheet labeled "Depth Soundings".
A portion of the high ground (about .85 acres) area is to graded level and gravelled for a parking area
and boat ramp access. A total of nine parking spaces are proposed.
The waters of Town Creek have been classified as C SW by the Division of Water Quality. They are
Inland Waters, closed to shellfishing as determined by Shellfish Sanitation. Town Creek is not a primary
nursery area as determined by the Division of Marine Fisheries. This area has been identified as a habitat
for Helisoma eucosmium, the Greenfield Rams-Horn snail , a species listed as special concern by the State
of North Carolina.
10. ANTICIPATED IlVIPACTS
This project, if approved, would result in the disturbance of approximately 1.2 acres of high ground
forested land within a flood plain. Also, approximately .05 acres of wetlands and open water would be
filled and/or excavated in conjunction with the proposal. Temporary turbidity could result from the
fill/excavation in the water and along the shoreline. Native vegetation will be removed during
construction.
Potential impacts to the Greenfield Rams-Horn snail species are unknown.

PROJECT NARRATIVE DIVISION OF
Purpose: COASTAL MANAGEMENT
The County of Brunswick proposes to construct a public boat ramp on Town Creek, in the
Winnabow area. A 6.4-acre tract which is bounded by Town Creek and US HWY 17 would be
purchased by the County for the ramp facility. An NC DOT approved entrance from the highway
and an on-site gravel entrance/parking area would provide access to the ramp.
Current Conditions:
The 6.4-acre tract has a roughly semi-circular shape as Town Creek wraps around the property,
meeting HWY 17 on either side of the property. Town Creek is classified as freshwater at this
location, so that a Public Trust AEC is the only AEC applicable to the site. At the interface of
Town Creek and the land, riverine wetlands are found. The wetland is a typical bottomland
hardwood community and is largely dominated by Taxodium distichum and Nyssa sylvatica. A
minimal understory exists, but herbaceous species such as Osmunda cinnamomea and Rhus
radicans are found. The continuity of this wetland fringe is somewhat interrupted on the
southeast portion of the tract (as seen on the wetland survey enclosed). In these areas, historic fill
is present and is thought to be part of the old HWY 17 road bed. Two physically isolated
wetlands naturally exist on the site and are labeled "Wetland B" and "Wetland C" on the wetland
survey. The central portion of the tract is upland with trees such as Pinus taeda, Sassafras
albidum, Quercus nigra, and Liquidambar styraciua. Again, an understory is largely absent and
a few trees are currently down as a result of Hurricane Floyd. The only existing man-made
features on the site are the historic road bed, a single lamp post, and some fill or wash-out
material adjacent to HWY 17 (as seen on the aerial photograph enclosed).
Proposed Project:
The project proposes to construct a 15' wide, concrete boat ramp on the northeastern property
edge. The ramp would begin at the wetland edge, and would extend 35' in length. This would
place 21' of the ramp length in the wetland and 14' of the ramp length on public bottom. The
proposed ramp would have a 5:1 slope. To achieve this slope, an average 2' of excavation
below the existing grade would be needed (this is an average across the length of the ramp). Side
slopes would be stabilized with rip-rap or gabions at a 3:1 slope. Although the width of rip-rap
from the ramp to the top of the slope will be dependent on the depth excavated, the width is
expected to be 9' on the western side and 6' on the eastern side. A hydrographic survey has been
completed and depths at the end of the proposed ramp are roughly -5' NLW. All proposed upland
development is based upon providing access to the ramp. An entrance from Hwy 14 would be
asphalt for 15', at which point the entrance would become gravel. A gravel access area to the
ramp would include nine gravel parking spaces. Total upland development including the entrance,
parking, and ramp access would cover 0.85 acres.
Avoidance and Minimization of 404 Wetland Impacts:
Impacts to jurisdictional 404 wetlands have been avoided and minimized to the greatest extent
practicable. Plans situate a single ramp at narrowest point of wetland fringe. The possibility of
CAMA Major Application, Town Creek Boat Ramp, linnabow area, Brunswick County
elevating the ramp on a piling supported structure was investigated by the engineer, but was
infeasible due to the gradual slope between the upland and the creek. Parking and turn/around
areas have been planned around the wetland labeled "Wetland C" in order to avoid additional
wetland impacts. The project does propose to fill the 0.02-acre wetland labeled "Wetland B".
This wetland has been determined to be isolated by the ACOE, and has been previously impacted
from the construction of HWY 17. Even with the minimal wetland impact proposed here, a
public ramp and park may be the best usage of this floodplain-adjacent property.
Construction Methods:
Standard construction methods would be used to create the 6" concrete ramp and framework.
Rip-rap side slopes would be lined with filter fabric to enhance stabilization. Silt fencing would be
installed around the project area prior to excavation and grading within the ramp area. Permanent
ground cover would be installed at the completion of construction to prevent transport of
sediment off-site. Conditions of an approved Sedimentation and Erosion Control Plan, as well as
a Low Density Stormwater Permit would be followed. All construction activities would be
reviewed and supervised by a licensed engineer.
Sedimentation/Erosion Control and Stormwater Permit applications:
An estimated 1.2 acres of the tract would be disturbed through grading in the proposed parking
