'.rDIREGl'OR - I have reviewed the information that you have submitted to determine if this timber operation is subject
to the requirements of the 15A NCAC 213 .0259 Tar-Pamlico River Basin: Nutrient Sensitive Waters
Management Strategy: Protection and Maintenance of Existing Riparian Buffers) on the above
referenced property. The property and date of timber sale are as follows:
The timber on the above referenced tract was sold at sealed bid on December 3, 1999.
The deed was prepared on December 9, 1999 and executed on the dates of December 10, 14, 16,
and 21, 1999.
The fully executed deed delivered the timber on December 22, 1999.
Based on the materials provided, the Raleigh Regional Office of the Division of Water Quality believes
that the proposed logging activities are not required to comply with the requirements of the temporary
riparian rule as long as the timber deed listed above remains valid and Forest Practice Guidelines are
followed in conjunction with Best Management Practices.

RE: Johnston-Witt/Harris Tract to Weyerhaeuser Co.
Dear Mr. Mitchell:
At the request of James Meadows of Watson Timber Company and on behalf of<rt`iy client,
Weyerhaeuser Company, I would set out the following:
1. The timber on this tract was sold at sealed bid on December 31, 1999. The sellers
accepted the bid of Weyerhaeuser Company on that date.
2. A deed was prepared and dated December 9, 1999.
3. The sellers executed the deed on the dates of December 10, 1999, December 14, 1999,
December 16, 1999, and December 21, 1999.
4. The fully executed deed was delivered to me as attorney for Weyerhaeuser Company on
December 22, 1999.
Based upon the foregoing, it is my opinion that, under North Carolina law, the title to the
timber passed on December 22, 1999 at the time of the delivery of the deed.
