3 As a result of site visits earlier this year, it was determined that the Tar River Greenway Project was greater
impact on the riparian buffer than necessary. I met with you on site March 15 and discussed several
alternatives that would reduce the impact on the features that were subject to the Tar Pamlico River Basin:
h: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A:02B.0259.
The new information was received by this Office on April 19, 2000. The General Permit (00-0468) for this
.,; greenway trail was issued by the Central Office on April 17, 2000. Thank you for your attention to this

APPROVAL of 401 Water Quality Certification and Tar Pamlico Buffer Rules

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to fill 0.14 acres of wetlands
in Nash County for the purpose of recreational bikeway construction, as you described in your application received by the
Division of Water Quality on April 6, 2000. After reviewing your application, we have decided that this action is covered by
General Water Quality Certification Numbers 3106 and 3127. This certification allows you to use Nationwide Permit
Numbers 18 and 25 when the Corps of Engineers issues them. This approval is also valid for the Tar Pamlico River Buffer
Rules (15A NCAC 2B .0259). In addition, you should set any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification.
If you do not accept any of the conditions of this certification, you may ask for anadjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Enclosed are the revised maps showing the changes Bob Zarzecki and Steve Mitchell
requested for the Tar River Bikeway during their meeting with Bobby Joyner, President on
March 15, 2000.
On map CE-3 and CE-6 the dotted line represents the original baseline of the former
bikeway location. From my understanding the bikeway was moved to avoid disturbing or
damaging several magnificent Oaks.
Additionally on map CE-4 a 6x6 treated timber level spreader was added to a shallow
swale to disperse the water from the bikeway over a larger area. If you have any

For work in the wetlands the construction corridor needed will be about 20 feet in width. Trees will be cut
at grouna ievei ana iert unaisturoea unless stump removal is requirea Tor piling construction. H tracKnoe
with auger will be used to minimize disturbance of wetlands while boring the 4 ' deep x 30" diameter
holes. The walkway corridor for the upland areas will be cleared, stumped, poor soils exacavated then
backfilled with suitable soil materials.
Rocky Mount. This is a connecting link between 2 existing bikeway corridors along the Tar River.
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN
WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) :
The proposed bikeway corridor was selected due to it impacting the least number of wetlands
while maintaining an asthetically pleasing location near the river. Wetland impacts were avoided by
extending the walkway from STA 60 +35 to STA 60 + 00 over the wetlands instead of filling(the preferred
alternative). Additionally, a cantelevered walkway was attached to the bridge from STA 69 + 68.55 to
STA 75 +95.18 instead of using other options which crossed the river twice and impacted more wetlands

or was located closer to the river and impacted more wetlands than the preferred alternative.

Size and Location of Property (waterbody, Higliway name/number, town, etc.): 3,000 linear feet
of proposed greenway (bike trail) on the north side of River Drive, immediately adjacent to the
river, in Rocky Mount, North Carolina. The property is located adjacent to, and below the
headwaters, of the Tar River.
Indicate Which of the following apply:
XX * There are wetlands on the above described property which we strongly suggest should be
surveyed. The surveyed wetland lines must be verified by our staff before the Corps will
make a final jurisdictional determination on your property.
* Because of the size of your property and our present workload, our identification and
delineation of your wetlands cannot be accomplished in a timely manner. You may
wish to employ a consultant to obtain a more timely delineation of the wetlands. Once
your consultant has flagged a wetland line on the property, Corps staff will review it,
and, if it is accurate, we strongly recommend that you have the line surveyed for final
approval by the Corps. The Corps will not make a final jurisdictional determination on
your property without an approved survey.
XX * The wetlands on your lot have been delineated, and the limits of Corps jurisdiction have
been explained to you. Unless there is a change in the law or our published regulations,
this determination may be relied upon for a period not to exceed five years from the date
of this notification.
* There are no wetlands present on the above described property which are subject to the
permit requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there
is a change in the law or our published regulations, this determination may be relied
upon for a period not to exceed five years from the date of this notification.
Placement of dredged or fill material in wetlands on this property without a Department of the
Army permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311).
A permit is not required for work.on the property restricted entirely to existing high ground. If

For work in the wetlands the construction corridor needed will be about 20 feet in width. Trees will be cut

with auger will be used to minimize disturbance of wetlands while boring the 4 ' deep x 30" diameter
holes. The walkway corridor for the upland areas will be cleared, stumped, poor soils exacavate then
backfilled with suitable soil materials.
Rocky Mount. This is a connecting link between 2 existing bikeway corridors along the Tar River.
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN
WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) :
The proposed bikeway corridor was selected due to it impacting the least number of wetlands
while maintaining an asthetically pleasing location near the river. Wetland impacts were avoided by
extending the walkway from STA 60 +35 to STA 60 + 00 over the wetlands instead of filling(the preferred
alternative). Additionally, a cantelevered walkway was attached to the bridge from STA 69 + 68.55 to
STA 75 +95.18 instead of using other options which crossed the river twice and impacted more wetlands

or was located closer to the river and impacted more wetlands than the preferred alternative.

Rocky Mount. This is a connecting link between 2 existing bikeway corridors along the Tar River.
14. STATE REASONS WHY IT I$ BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN
WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) :
The proposed bikeway corridor was selected due to it impacting the least number of wetlands
while maintaining an esthetically pleasing location near the river. Wetland impacts were avoided by
extending the walkway from STA 60 +35 to STA 60 + 00 over the wetlands instead of filling(the preferred
alternative). Additionally, a cantelevered walkway was attached to the bridge from STA 68 + 65.55 to
STA 75 +95.18 instead of using other options which crossed the river twice and impacted more wetlands

or was located closer to the river and impacted more wetlands than the preferred alternative.

a. WETLAND DELINEATION MAP SHOWING ALL WETLANDS, STREAMS, LAKES AND PONDS
ON THE PROPERTY (FOR NATIONWIDE PERMIT NUMBERS 14, 18, 21, 26, 29 AND 36). ALL
