I met with you on site March 15 and discussed several alternatives that would reduce the impact on the features that were subject to the Tar Pamlico River Basin: h: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0259. The new information was received by this Office on April 19, 2000. The General Permit (00-0468) for this .,; greenway trail was issued by the Central Office on April 17, 2000. Stevens, Director NC ENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAND NATURAL RESOURCES April 17, 2000 Nash County DWQ Project # 000468 APPROVAL of 401 Water Quality Certification and Tar Pamlico Buffer Rules City of Rocky Mount c/o Peter Varney One Government Plaza, PO Drawer 1180 Rocky Mount, NC 27802-1180 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to fill 0.14 acres of wetlands in Nash County for the purpose of recreational bikeway construction, as you described in your application received by the Division of Water Quality on April 6, 2000. After reviewing your application, we have decided that this action is covered by General Water Quality Certification Numbers 3106 and 3127. This certification allows you to use Nationwide Permit Numbers 18 and 25 when the Corps of Engineers issues them. This approval is also valid for the Tar Pamlico River Buffer Rules (15A NCAC 2B .0259). In addition, you should set any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for anadjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. From my understanding the bikeway was moved to avoid disturbing or damaging several magnificent Oaks. The walkway corridor for the upland areas will be cleared, stumped, poor soils exacavated then backfilled with suitable soil materials. Rocky Mount. This is a connecting link between 2 existing bikeway corridors along the Tar River. 14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) : The proposed bikeway corridor was selected due to it impacting the least number of wetlands while maintaining an asthetically pleasing location near the river. Wetland impacts were avoided by extending the walkway from STA 60 +35 to STA 60 + 00 over the wetlands instead of filling(the preferred alternative). Additionally, a cantelevered walkway was attached to the bridge from STA 69 + 68.55 to STA 75 +95.18 instead of using other options which crossed the river twice and impacted more wetlands 3 or was located closer to the river and impacted more wetlands than the preferred alternative. 15. Wetland impacts were avoided by extending the walkway from STA 60 +35 to STA 60 + 00 over the wetlands instead of filling(the preferred alternative). Additionally, a cantelevered walkway was attached to the bridge from STA 69 + 68.55 to STA 75 +95.18 instead of using other options which crossed the river twice and impacted more wetlands 3 or was located closer to the river and impacted more wetlands than the preferred alternative. 15.
