Stevens, Director NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES April 13, 2000 Johnston County DWQ Project # 000459 APPROVAL of 401 Water Quality Certification and Neuse Buffer Rule John McFadyen 312 North Third Street Smithfield, NC 27577 Dear Mr. McFadyen: You have our approval, in accordance with the attached conditions and those listed below, to fill 0.1 acres of wetlands in Johnston County for the purpose of boat ramp construction as you described in your application received by the Division of Water Quality on April 5, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106. This certification allows you to use Nationwide Permit Number 18 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 213 .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. As discussed at the site meeting on July 1, 1998 and numerous phone conversations, the application has been modified to include filling in for the boat ramp and adjacent areas only. In an effort to minimize the impact, the access for this site will be from utilizing either the existing drive along the adjacent warehouse or by constructing a road along the existing right of way. Neither of these options have any impact to the existing site. The scope of the boat ramp and access area has been reduced to only filling in approximately 1/10 th. of an acre, as originally discussed. This project consist of the installation of a boat ramp facility on the Neuse River near the intersection of Hwy 301 and the Neuse, South of Smithfield N.C. Construction techniques for this project includes the placement of precast concrete slabs such that no green concrete will be placed in the Neuse River. In the beginning Mr. Eric Fleet (DWQ), Mr. Bennett Wynne (NC Wildlife Resource Commission), Ms. Jean Manuele (C.O.E.), Mr. Tom Adams (Southwind), Mr. McFadyen, Mr. Warren Wallace and myself met on site to discuss the requirements and permitting process for the project. Since that meeting a revised site plan has been produced which minimizes wetland impacts on site. Mr. Todd Tugwell (C.O.E.) has recently given a verbal approval with the revised site and has given direction to submit the Pre-construction notification application to your office.
