Zebulon, NC 27597 Dear Mr. Sir: You have our approval, as described in your application dated March 7, 2000 and in accordance with the attached conditions and those listed below, to place fill material in 0.18 acres of wetlands for the purpose of constructing a putt-putt golf course in Wake County. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification corresponds to the Nationwide Permit Number 26 issued by the Corps of Engineers. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). Your project should be constructed as described in your permit application submitted on March 7, 2000 except where conditioned below. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). ). This approval shall expire with the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Stormwater shall be directed to sheetflow at nonerosive velocities through the protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Soil & Environmental Consultants, Ina 244 West Millbrook Road 19 Raleigh, North Carolina 27609 ® (919) 846-5900 6 Fax (919) 846-9 January 28, 1997 Sears Design Group Attn: Mr. Richard Lee 625 West Jones Street Raleigh, NC 27603 Re: Wetland Report: Roger Duty Property, Wendell, NC Dear Mr. Lee: WETLANDS In January 1997, the property was traversed on foot and the soils, vegetation and hydrology evaluated and wetland areas examined by current procedures described in the 1987 Corps Manual for Identifying and Delineating Wetlands. .We have deterrltined that jurisdictional areas are within the project area (see attached map). - ' Vegetated wetlands and or Waters of the U.S. were found ui association with drainages on the property and within the floodplain of the large creek Ironically, unvegetated channels meet the definition of a stream in the Clean Water Act and, therefore, are subject to similar regulations as vegetated wetlands. Three vegetated wetland areas and an unvegetated channel, approximated on the attached map, are subject to current wetland regulation. These areas should be surveyed to determine their limits. The surveyed map can then be over-laid on the current site plan to determine which wetland permits are required, if any. Recent rule changes prevent the loss of more than 500 linear feet of stream beds and 3 acres of wetlands by Nationwide Permit 26. An Individual Permit would likely be required if project impacts exceed these thresholds. A survey of an approved wetland delineation and a site development plan can be used to determine a projects eligibility for wetland permits. Interpretations of the new rules regarding impacts to stream channels have not been fully explored and changes may occur, please call for up-dates. Findings Potential wetland areas on the site were evaluated for the presence of hydric soils and evidence of hydrology and vegetation. In these areas, hydrologic proof would be in the existence of hydric soils with oxidized root channels in the upper 12 inches of the "A" horizon. Other indicators of hydrology include, water bome deposits, drift lines, scour marks, and regional indicators of soil saturation, etc. Soil/Site Evalwitiorn 1$ Mapping and Physical Analysis M Wetlands Mapping and Mitigation N Environmental Ai on-site waste 'treatment systems, Evaluation and Design After close examination of the soil borings, we found hydric soils and other hydrology indicators present for wetlands designation in the areas as approximately shown on the attached map. S&EC, [nc. has scheduled a meeting with the Corps to get their confirmation that our wetland delineation is accurate; the meeting is scheduled for February 18, 1997. Permitting ' Wetland impact permits are issued on a per-project basis as determined by the Army Corps of Engineers. The Corps has determined that impacts on parcels sub-divided from larger tracts are sometimes considered to be cumulative to existing impacts for the large tract. If this is the case, then thresholds as discussed below may not apply and impacts to wetlands must be considered in light of existing permits. Prior construction notification to the Corps is not required for impacts less than 1/3 acre above headwaters if impacts to stream beds are less than 500 linear feet and if no other Nationwide Permit is required. Prior notification to DWQ is not required for impacts less than 1/3 acres above headwaters. If impacts are greater than 1/3 acres and are due to commercial development than a stormwater pond may be required. Headwaters is defined as a stream with an average flow of 5 cfs (in this area, roughly a 3,500 acre drainage area). Recent rule changes require that all impacts to wetlands, less than 1/3 acre, be reported to the Corps within 30 days of the completion of construction. S&EC, Inc.. has not reviewed a, final site plan and a wetland survey for this property and caniaot accurately assess the permitting needs. Nationwide Permits can potentially be utilized if the project is designed to have impacts of less than 500, linear feet to channels, and less than 3 acres. Individual Permits require an analysis to determine that the proposed impact is the least environmentally damaging practical alternative and typically require compensatory mitigation. If you choose to have us perform additional work, the following is a listing of everything you may possibly want. None are required by law unless impacts are proposed, but some clients prefer to have them: Request that the Corps verify our delineation, notification to the Corps regarding impacts to wetlands.
