After reviewing your application. we have decided that this fill is covered by General Water Quality Certification Number 3102 . This certification allows you to use Nationwide Permit Number 13 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Applicant will examine the use of a small (one to two foot) vertical offset of concrete to provide concentrated flow. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Improvements are to be made to the Dartmouth Road culvert. These improvements include the removal of the existing structure and replacing it with a larger culvert and the stabilization of the stream banks upstream and downstream from the culvert. The construction equipment that will be used for this project will be typical excavation and fill equipment. The project will use, but is not limited to the following: 1) Track hoes; 2) Dump trucks; 3) Picks and jackhammers; 4) Bulldozers; 5) Bobcats; and 6) Cement trucks. The steps to be taken to replace the culverts will include the following: 1) Install traffic control; 2) Install impervious dike, silt fencing, and stilling basin clearing only as deemed necessary to install these devices; 3) Remove the items indicated in the plans and perform excavation as necessary to construct culverts; 4) Perform culvert removal and any other necessary removal in accordance with the plans; 5) Construct proposed culverts and appurtenances; 6) Backfill the site as necessary; 7) Perform stream modifications and immediately stabilize in accordance with the plans; 8) Replace all items in accordance to plans; 9) Remove all temporary erosion control items and immediately seed all areas; and 10) Remove traffic control. The following culvert revisions are to be made: Replace the existing concrete pipe culvert structure with two 79-ft. long 4'x 3' reinforced concrete box culverts. The total disturbance will involve approximately 0.15 acres. The disturbance will incorporate 152 linear ft. of channel length with channel modifications taking place upstream and downstream from the culvert. The stream bank stabilization measures to be utilized are: 1) Vegetated matting with live stakings, and 2) Full bed and bank riprap protection. The stream channel impacts due to the implementation of the culvert and stream bank protection are shown in the table below. Note that the measurements shown represent the most extreme changes for each culvert.
