8. PROJECT SUMMARY: The applicant proposes to construct a 10-slip private community dock,
including parking and access road, on and adjacent to Beard Creek for the Oaks at Beard Creek
Subdivision.
9. NARRATIVE DESCRIPTION:
The applicant, Coastal marketing and Development Company, owns a 37 acre tract of land on the
west side of Beard Creek off NCSR 1101 2.1 miles south of the intersection with NCSR 1005 near
the town of Arapahoe in Pamlico County. The applicant is developing a 31 lot subdivision called The
Oaks at Beard Creek. According to the applicant 13 lots are waterfront. The majority of the property
is a combination of old farm land and mature forest. Near the water's edge there are some scattered
trees on the high ground which transitions down to an area up to 50 ft. wide that has been delineated
as 404 wetlands under the jurisdiction of the U. S. Army Corps of Engineers. Beyond the 404
wetlands is a fringe of coastal marsh up to 200 ft. wide which is vegetated primarily with Juncus
roemerianus and Spartina cynosuroides. The tract is approximately 15 feet above MSL. Beard Creek
is approximately 880 feet wide at the project site and the water depth at the middle of the creek is -5.0
feet below NWL.
Several lots have been sold in the subdivision. To date no individual pier/dock permits have been
issued. The home sites will be served by individual well and septic tanks. All other waterfront lot
owners will have the opportunity to construct their own private docks within their respective riparian
corridor. Lot 10 has been dedicated as the location for the community dock access. The access road
and parking area are 225 ft. from the NWL which is outside the Public Trust and Coastal Marsh
AECs.
Land use along Beard Creek is dominated by agricultural and silvicultural practices. There is a
moderate number of residential, single-family home sites along this portion of the creek which are
served by individual piers. Water depths in the immediate project area range from -2.5 feet to -4.1
feet below NWL. Beard Creek flows directly into the Neuse River and is classified SC SW NSW by
the NC Division of Water Quality. Immediately downstream of the proposed project area, Beard
Creek is classified as a Primary Nursery Area by the NC Division of Marine Fisheries.
The applicant proposes to build a 10-slip community dock for the Oaks at Beard Creek Subdivision.
The slips will be located on either side of a 5 ft. by 190 ft. pier. Each slip would run 14 ft. wide and
28.5 ft. in length. Six 4 ft. by 10 ft. finger piers would be constructed to provide access to the
interior slips. Eighteen tie poles would also be installed. Access to the pier will be provided via a 5
ft. by 245 ft. walkway (105 ft. over high ground and 140 ft. over coastal marsh) from the parking
area. A 20 ft. by 385 ft. road to a 45 ft. by 45 ft. parking lot (allowing 5 spaces) will provide
community access to the facility.

Approximately 11,780 sq. ft. of Public Trust Waters of Beard Creek would be usurped by the
installation of the docking facility. Of that total, proposed docks and finger piers would shade
approximately 1,190 sq. ft. of shallow water habitat. The installation tie poles and pilings would
create some short term, construction related increases in turbidity to the adjacent waters as well as
some minor impacts to bottom habitat. The construction of the access walkway to the pier would
shade approximately 700 sq. ft. of coastal marsh (primarily Spartina cynosuroides and Juncus
roemerianus). The walkway crossing coastal marsh would be elevated a minimum 3 ft. above the
marsh substrate.
The most obvious question of impact lies on what influence will boats docking in 2.5 ft. to 4.1 ft. of
water have on the system's productivity. Typically power boats, shoal draft sailboats, and retractable
keel / centerboard sailboats under 27 feet in length (appropriate for a 28.5 ft. slip) draw less than 4 ft.
of water. Consequently, boats of this class should present a minimal impact to the resource. Larger
or fixed keel vessels may require more draft thus presenting a greater threat to the resource. Based on
the proposed structure, there should be no adverse impacts to navigation in the area (proposed pier
length S 1/4 distance across creek).
All roads and parking would be located outside of any AEC. No further development is being
proposed by the developer at this time. Individual lot owners would be responsible for obtaining
CAMA permits on their lots for development along Beard Creek.
