Sullins, Deputy Director Division of Water Quality January 8, 2004 DWQ# 03-1128 Guilford County Mr. Scott Wallace Keystone Group, Inc. 5710-K-203 High Point Road Greensboro, NC 27407 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Wallace: You have our approval, in accordance with the attached conditions, to place permanent fill in 145 linear feet of perennial stream and 0.03 acre of wetlands for a road crossing and in 0.075 acre of wetlands for roadbed and slope fill in order to construct the Meadow Oaks Subdivision in Guilford County, as described in your application received by the Division of Water Quality (DWQ) on September 9, 2003 and in additional correspondence received on October 10, 2003 and November 14, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3404 which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should secure any other federal, state or local permits before you proceed with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is valid only for the purpose and design that you have described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification, as well as the additional conditions listed below: 1. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. A sample deed notification can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. 2. The culvert required for this project shall be installed in such a manner that the original stream profile is not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including the pattern and profile) are to be maintained above and below the location of the culvert. The culvert shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the stream. If the culvert becomes perched, the appropriate stream grade shall be re- established or, if the culvert is installed in a perched manner, the culvert shall be removed and re-installed correctly. Native vegetation and other soft stream bank stabilization techniques must be used where practicable instead of riprap or other bank hardening methods. If riprap is necessary in the streambed, it shall be limited to the minimum amount required (as shown by engineering calculations) to protect the culvert from scouring. 3. No impacts to the stream channel, to include temporary or permanent placement of riprap, culverts, fill material, or mechanized land clearing, are authorized for the proposed stream crossing at the site designated W-1. This crossing is depicted in the site plan as utilizing a bottomless arch culvert. 4. Upon finishing the project, the Applicant shall fill out and return the enclosed "Certificate of Completion" to notify NCDWQ when all work included in the §401 Certification has been completed. This certificate should be returned to the 401/Wetlands Unit of the NC Division of Water Quality at the address listed. Along with the Certificate of Completion, please send photographs upstream and downstream of each culvert site to document correct installation. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1506 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. QU4Crty SEC, r/0N The attached pre-construction notification (PCN) reflects a third submittal requesting impacts to `Waters of the US' for the proposed Meadow Oaks Subdivision near Greensboro, NC. The initial PCN was submitted September 5, 2003. The attached PCN addresses questions raised by the NC DWQ from earlier submittals. The applicant, Keystone Group, requests the use of Nationwide Permit 14 for impacts to `Waters' related to road construction. The subject property is located east of Rehobeth Church Road approximately 1.3 miles south of Interstate 85. The site is shown on the attached USGS Topo Quad vicinity map. Surface waters on the property flow to Ryan Creek. Site plans for the proposed development include construction of 74 single-family homes and 5 acres dedicated for construction of multi-family dwellings. At this time plans for the multi- family site have not been completed. The project engineer is aware that level spreaders will be conditioned to the construction of the multi-family area if final plans result in impervious percents greater than 30. Total impacts to jurisdictional features involve 145 linear feet of channel and 0.1 acres of wetlands. Proposed impacts W-1, W-2, and S-1 occur via pipe placement, rip rap dissipater and fill slopes associated with road construction. The proposed road will be maintained by the City of Greensboro DOT and will connect Rehobeth Church Road and Blazingwood Drive. Spanning of the stream at impact S-1 would be difficult due to extensive channel sinuosity. The mitigation plan for the project involves preservation of undisturbed streams and wetlands, avoidance and minimization of permanent impacts and establishment of mandated 50' City of Greensboro stream and wetland buffers. The project engineer has incorporated retaining walls and an arch culvert to avoid impacts to wetlands and perennial streams. A previously proposed wetland impact, W-3, and perennial stream impact near station 8+00 have been avoided through . the use of retaining walls. Large-scale maps of the arch culvert and retaining wall at station 8+00 are included with this submittal. Minimization of impacts can be demonstrated from initial site plans that proposed impacts of 436 If of perennial channel and 15,411 fe of wetlands to final plans with 145 if and 4744 f C, respectively. Approximately 94% (74,982 sq ft) of the jurisdictional wetlands and 93% (1973 linear feet) of stream channel will not be disturbed upon construction of the project. Stream and wetland buffers are shown on the revised overall site plan. In response to questions raised by the USACE for the earlier submittal: the mitigation plan was outlined in the earlier in which previous impact W-3 has been eliminated by the use of retaining walls, the culvert design does not require riprap or temporary crossings and the clearing limits for lots 10 and 11 are enclosed. The project engineer does not know whether any review agency will require the use of riprap for the proposed arch culvert. A temporary crossing in the location of the proposed arch culvert will not be necessary according to the developer and their engineer. In response to questions raised by the NC DWQ in their 9/22 and 10/20 response letters a more detailed site plan with topo, jurisdictional features, impacted areas, etc has been provided. Large- scale drawings of the impact areas are included with the PCN. A typical cross-section view of the proposed arch culvert is enclosed for review. A revised plan view of the arch culvert is also enclosed. Please note that no column ever existed in the middle of the culvert. Previous wetland impact W-3 has been avoided via retaining walls. Wetland impacts W-4, 5 and 6 from an earlier site plan were never requested by the applicant but shown initially to S&EC. At our recommendation these along with stream impacts will not occur. The questionable hatch area on a previous drawing mentioned in the 9/22/03 DWQ response letter is not wetland. The project engineer states the road low-point has designed to coincide near the stream location to minimize fill while providing the most direct route to proposed outlets. The project engineer's computations for use of the standard riprap outfall are enclosed with this notification. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. The purpose of this submittal is to request the use of Nationwide Permit 14 for the proposed Meadow Oaks Subdivision in Greensboro, NC. The subject property is located east of Rehobeth Church Road approximately 1.3 miles south of Interstate 85. The site is shown on the attached USGS Topo Quad vicinity map. Surface waters on the property flow to Ryan Creek. The applicant proposes to impact 145 linear feet of channel for construction of Meadow Oaks Road. The proposed road will be maintained by the City of Greensboro DOT and will connect Rehobeth Church Road and Blazingwood Drive. Proposed impacts occur via pipe placement, rip rap dissipater and fill slopes associated with road construction. Revised impact totals for the project are: 0.1 acres of vegetated wetland and 145 linear feet of channel (impact S-1). Spanning of the stream at impact S-1 would be difficult due to extensive channel sinuosity. The mitigation plan for the development involves preservation of remaining streams and wetlands, avoidance and minimization of permanent impacts and establishment of mandated 50' City of Greensboro stream and wetland buffers. The project engineer will incorporate retaining walls and an arch culvert to avoid impacts to wetlands and perennial streams. A previously proposed wetland impact, W-3, has been avoided along with perennial stream impacts through incorporation of retaining walls. Minimization of impacts can be demonstrated from initial site plans with proposed impacts of 43 61f of perennial channel and 15,411 ft2 of wetlands to 145 if and 4744 ft2, respectively. Approximately 94% (74,982 sq ft) of the jurisdictional wetlands and 93% (1973 linear feet) of stream channel will not be disturbed by the development. The majority of the streams and wetlands on the property will require 50'no-build buffers required by the City of Greensboro. A map of the buffers is attached in this PCN. In response to questions raised by the USACE for the earlier submittal: the mitigation plan was outlined in the earlier paragraph, previous impact W-3 has been eliminated by the use of retaining walls, the culvert design does not require riprap or temporary crossings and the clearing limits for lots 10 and 11 are enclosed. The project engineer does not know whether any review agency will require the use of riprap for the proposed arch culvert. A temporary crossing in the location of the proposed arch culvert will not be necessary according to the developer. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted Page 9 of 12 aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
