On June 18, 1999 I sent you a letter relevant to the buffered areas for the subject property. Those features
on site that are at least intermittent streams and therefore subject to the Neuse River Basin: Nutrient Sensitive
Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code
T15A:02B.0233 (NCAC 0233) were delineated as follows:
From flag NBR 100 to 112;
From flag NBR 200 to 203
and off property around flag NBR 303 to (or toward) 222.
This letter is being sent to expressly state that the pond present on this site along Holly Springs road was
evaluated as part of the original site visit and was not listed as subject in that delineation. Although this
features is present on the ground and both the USGS and Wake County Soils Maps, this pond is not
connected to waters of the State and therefore, not subject to protection under this Rule.
