After reviewing your application, we have decided that this project is in compliance with the Neuse River Buffer rules (15A NCAC 2B .0233). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but no limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval is only valid for the purpose and design that you described in your application. If the property is sold, the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, NC 27611-7447. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse River Buffer rules. State reasons why it is believed that this activity must be carried out in wetlands (include any measures taken to minimize wetland impacts): The proposed access road has been aligned as close to perpendicular as possible to limit the amount of impacts to the stream and buffers. Other than this single access road the subdivision has been designed to around the Neuse River 50-foot Buffer Regulations to limit impacts to the riparian areas on the site. Some grading will occur within Zone 2 of the buffers for required side-slopes. No buildings or parking lots will be placed within these areas. The graded areas will be re-vegetated, stabilized and the activity will provide diffuse flow and the health of existing vegetation in Zone 1 will not be S&EC, Inc. Project # 98-4194 7/22/99 compromised. Also, a sanitary sewer connector will be required to connect to an existing sewer line. This connector will impact the buffers in the northeast comer of the property. The connector will be placed as close to perpendicular as practicable and will have a construction corridor less than 40 linear feet. 14. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding the presence of any federally listed or proposed for listing endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project.
