Dear Mr. Zarzecki:
On April 6, 1999, I met with you at the subject property to conduct a site visit for the above
referenced project. This project is referenced by the Raleigh Regional Office as NBRRO 99-080.
As a result, it was determined that there are no streams present on the property and that the two
ponds present on this tract of land tract are therefore not subject to the Neuse River Basin: Nutrient
Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A:02B.0233 (NCAC 0233).
The feature present below the small pond may become subject off property, but there is no forest
vegetation around the pond to subject it to riparian protection. The dam on the larger pond is
forested but the feature exiting the pond does not become subject until well off of the property.

I met with you at a proposed development along Tryon Road in Wake County. At your
request, an evaluation was performed to determine whether features as indicated by a
blue high lighter on the attached map would require compliance with the Neuse River
Buffer Rules. Feature # 1 as indicated on the attached map is a stream and is subject to
the Riparian Buffer Rule. Feature # 2 is not a stream and is not subject to the Neuse
Buffer Rule.
In addition, in accordance with the rule, concentrated stormwater runoff from new
ditches or manmade conveyances must be dispersed into sheet flow before the runoff
enters Zone 2 of the riparian area.
