No mitigation is proposed. EPA recognizes that we previously sent a letter indicating no comments to this proposal. However, since the date of that letter, we have been contacted by several local homeowners who have concerns about this project. One local homeowner indicated that there are substantial shellfish beds in the project area, specifically in the marsh south of the proposed dock, and through which the boardwalk will cross. The local homeowners also indicate that there are many inaccuracies in the application documents, including a failure to provide notification to at least one adjacent landowner, and an inaccurate portrayal of the potential hazards to navigation. The level of community concern and possible misinformation in the application is a matter we must address. The water classification in the project area is SB, but the project area is closed to shellfish harvesting. There may be natural shellfish beds in the project area. Further, the area is designated as a Primary Nursery Area. EPA believes that marinas of this size can cause significant secondary impacts to water quality, in addition to the secondary impacts to the shellfish beds. EPA is concerned about the cumulative impacts of docks and other hardened structures along waterways, especially those classified as shellfish growing waters. The approval of many projects of this kind in a specific area and continued closure of the shellfish waters may lead to the eventual reclassification of the waterbody, contrary to the antidegradation provisions of the Clean Water Act. VW1... 2 I EPA is concerned about development in coastal areas and the direct and cumulative impacts to wetlands functions, water quality, and fin- and shellfish resources hi these areas. EPA notes that the estuarine waters of Masonboro Sound in this area are listed by the North Carolina Department of Environment and Natural Resources on the 1996 Clean Water Act Section 303(d) list as only partially supporting its designated use due to point and non-point sources. including urban runoff, septic tanks, and marinas. EPA believes that additional adverse impacts to the Masonboro Sound watershed may further prevent this waterbody from fully supporting their designated uses. Because of our concerns, EPA believes that it is important to receive accurate information on proposed projects in such sensitive areas. In order to address the concerns raised by local citizens and assure that the resource agencies are being provided with accurate information concerning this project, EPA recommends that the application be considered incomplete. If it is not possible at this time to declare the application incomplete, EPA recommends that the permit be held in abeyance until the appropriate information can be obtained, including the following: 1. a survey of the shellfish resources in and adjacent to the project area; 2. a survey of water depths within the project area; 3. the proposed distance of the project from the outer boundary of the navigational channel; and 4. a detailed statement about the possible navigational hazards from the proposed project. PROJECT SUMMARY: The applicant proposes to construct a pier and community docking facility (23 slips) to provide water access for their subdivision. Shandy Lane P.O.A. Page 2 9. PROTECT DESCRIPTION The project site is located adjacent to Masonboro Sound, at the end of Shandy Avenue, in New Hanover County. Shandy Lane is an existing subdivision consisting of twenty-three (23) single- family lots, of which, the majority have already completed residential development. The project site is a 1.71 acre (Tract B) which includes common area adjacent to Shandy Avenue and an easement, forty (40) wide, through a broad expanse of salt marsh to access a portion of an island, which is adjacent to the entrance canal for Shandy Point boat basin. Shandy Point subdivision is located north of the Shandy Lane development. Average elevations of the portions of the property that are above mean high water (NEW) are 3-5 feet above mean sea level. The mainland portion of the tract is wooded. Here the shoreline includes a border of high marsh coastal wetlands, Black Needle Rush (Juncus roem rin s), intermixed with Spike Grass (Distic lis spi a a), Sea Lavender imonium, spp.), Saltwort (Saljcornia, spp.), Sea Oxeye (Bonichia frutescens), and Salt Meadow Grass (Spartina patens). The high marsh transitions to a marsh cove of Smooth Cordgrass (Spa_rtina 1 iflora), which is approximately 600 feet in width from the mainland to the island. The highground island vegetation includes several Live Oaks, Pine, Red Cedar, Yaupon, and Wax Myrtle, fronted with shrubs, Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharus halimifolia). The island's . high marsh perimeter is similar to that listed above, which transitions to a border Smooth Cordgrass (Spartina alterniflora), approximately 130 feet wide, between the island and the open water of the Shandy Point boat basin entrance canal. The tract also includes a narrow berm between the island and another section of the mainland. When viewed on aerial photography, the berm is one several, between different islands in this area. They appear to be remnants of historical access from the mainland to the sound. The relic berm has some Red Cedar and highground shrub vegetation, flanked on both side slopes by areas of high coastal marsh. The berm is subject to occasionally overwash by extreme high, lunar and storm tides. The waters adjacent to project site are classified as SB# by the NC Division of Water Quality. The pound sign (#) indicates that wastewater discharges are prohibited to this segment of SB classification. The waters are designated as primary nursery area by the NC Division of Marine Fisheries, but they are CLOSED to the taking of shellfish. The width of the water body (open water area) is 182 feet, between the marsh vegetation bordering either side of Shandy Point entrance channel. The Wilmington-New Hanover Land Use Plan classifies the wetland area of the project site as Conservation and those areas above the 100 year flood elevation as Resource Protection. The applicant proposes to construct a pier and community docking facility (23 slips) to provide water access for their subdivision. The pier would be in two (2) sections. The first section would provide an elevated walkway from the shoreline to the island, and would be 631 feet long and 6 feet wide. Homeowners would utilize a highground foot path to the north side of the island where a second section of pier, 152 feet long and 6 feet wide, would access the floating dock. The floating dock would be oriented parallel to the channel, ranging from 15 to 25 feet waterward of the marsh vegetation, and would be 276 feet long and 5 feet wide. The structure would include 22 perpendicular fingers piers on the waterward side (north) of the main floating dock, each measuring 10 feet in length by 2 feet in width. ANTICIPATED zirACTS The proposed floating dock facilities would incorporate 4,692 square feet of Public Trust Area and Estuarine Waters. The proposed pier sections would shade approximately 4608 square feet of coastal wetlands. There would be some disturbance of the marsh and shallow bottom along the proposed walkway alignments during initial construction, however, provided that the walkways are sufficiently elevated to avoid excessive shading impacts to wetland vegetation, no long-term adverse impacts are anticipated as a result of the pier construction. The long pier length and isolated location of the docks, may increase the potential for theft and/or vandalism problems. The intrusion of the dock and boats up to 26 feet in length docked at the facility would create the potential for restricted navigation and congestion in the Shandy Point entrance channel. PROJECT SUMMARY: The applicant proposes to construct a pier and community docking facility (23 slips) to provide water access for their subdivision. 1 Shandy Lane P.O.A. Page 2 9. PROTECT DESCR_EMON The project site is located adjacent to Masonboro Sound, at the end of Shandy Avenue, in New Hanover County. Shandy Lane is an existing subdivision consisting of twenty-three (23) single- family lots, of which, the majority have already completed residential development. The project site is a 1.71 acre (Tract B) which includes common area adjacent to Shandy Avenue and an easement, forty (40) wide, through a broad expanse of salt marsh to access a portion of an island, which is adjacent to the entrance canal for Shandy -Point boat basin. Shandy Point subdivision is located north of the Shandy Lane development. Average elevations of the portions of the property that are above mean high water (NIHW) are 3-5 feet above mean sea level. The mainland portion of the tract is wooded. Here the shoreline includes a border of high marsh coastal wetlands, Black Needle Rush (Juncus roemaria_nus), intermixed with Spike Grass (Distic U sp..ata), Sea Lavender (Limmim, spp.), Saltwort (SaUmmia, spp.), Sea Oxeye lBorric is t .c ins), and Salt Meadow Grass (Sp rta _ina patens). The high marsh transitions to a marsh cove of Smooth Cordgrass (Spartina alterriflora), which is approximately 600 feet in width from the mainland to the island. The-highground island vegetation includes several Live Oaks, Pine, Red Cedar, Yaupon, and Wax Myrtle, fronted with shrubs, Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharus halimifolia). The island's high marsh perimeter is similar to that listed above, which transitions to a border of Smooth Cordgrass (Spartina alterniflora), approximately 130 feet wide, between the island and the open water of the Shandy Point boat basin entrance canal. The tract also includes a narrow berm between the island and another section of the mainland. When viewed on aerial photography, the berm is one several, between different islands in this area. They appear to be remnants of historical access from the mainland to the sound. The relic berm has some Red Cedar and highground shrub vegetation, flanked on both side slopes by areas of high coastal marsh. The berm is subject to occasionally overwash by extreme high, lunar and storm tides. The waters adjacent to project site are classified as SB# by the NC Division of Water Quality. The pound sign (#) indicates that wastewater discharges are prohibited to this segment of SB classification. The waters are designated as primary nursery area by the NC Division of Marine Fisheries, but they are CLOSED to the taking of shellfish. The width of the water body (open water area) is 182 feet, between the marsh vegetation bordering either side of Shandy Point entrance chaimel. The Wilmington-New Hanover Land Use Plan classifies the wetland area of the project site as Conservation and those areas above the 100 year flood elevation as Resource Protection. The applicant proposes to construct a pier and community docking facility (23 slips) to provide water access for their subdivision. The pier would be in two (2) sections. The first section would provide an elevated walkway from the shoreline to the island, and would be 631 feet long and 6 feet wide. Homeowners would utilize a highground foot path to the north side of the island where a second section of pier, 152 feet long and 6 feet wide, would access the floating dock. The floating dock would be oriented parallel to the channel, ranging from 15 to 25 feet waterward of the marsh vegetation, and would be 276 feet long and 5 feet wide. The structure would include 22 perpendicular fingers piers on the waterward side (north) of the main floating dock, each measuring 10 feet in length by 2 feet in width. Electricity, potable water, and lighting would be Shandy Lane P.O.A. Page 3 provided to the docks. The applicant states that the slips would accommodate boats up to 26 feet in length. 10. ANTICIPATED IMPACTS The proposed floating dock facilities would incorporate 4,692 square feet of Public Trust Area and Estuarine Waters. The proposed pier sections would shade approximately 4608 square feet of coastal wetlands. There would be some disturbance of the marsh and shallow bottom along the proposed walkway alignments during initial construction, however, provided that the walkways are sufficiently elevated to avoid excessive shading impacts to wetland vegetation, no long-term adverse impacts are anticipated as a result of the pier construction. The long pier length and isolated location of the docks, may increase the potential for theft and/or vandalism problems. The intrusion of the dock and boats up to 26 feet in length docked at the facility would create the potential for restricted navigation and congestion in the Shandy Point entrance channel. Here the shoreline includes a border of high marsh coastal wetlands, Black Needle Rush (Juncus roema-rianus), intermixed with Spike Grass Wistic lis spiet_a), Sea Lavender (Limonium, spp.), Saltwort (tea, spp.), Sea Oxeye Borric is f escens), and Salt Meadow Grass (Spa ina patens). The high marsh transitions to a marsh cove of Smooth Cordgrass ('512artina lte iflom), which is approximately 600 feet in width from the mainland to the island. The highground island vegetation includes several Live Oaks, Pine, Red Cedar, Yaupon, and Wax Myrtle, fronted with shrubs, Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharus halimifoli a). The island's high marsh perimeter is similar to that listed above, which transitions to a border of Smooth Cordgrass (Spartina alterniflom), approximately 130 feet wide, between the island and the open water of the Shandy Point boat basin entrance canal. The tract also includes a narrow berm between the island and another section of the mainland. When viewed on aerial photography, the berm is one several, between different islands in this area. They appear to be remnants of historical access from the mainland to the sound. The relic berm has some Red Cedar and highground shrub vegetation, flanked on both side slopes by areas of high coastal marsh. The berm is subject to occasionally overwash by extreme high, lunar and storm tides. The waters adjacent to project site are classified as SB# by the NC Division of Water Quality. The pound sign (#) indicates that wastewater discharges are prohibited to this segment of SB classification. The waters are designated as primary nursery area by the NC Division of Marine Fisheries, but they are CLOSED to the taking of shellfish. The width of the water body (open water area) is 182 feet, between the marsh vegetation bordering either side of Shandy Point entrance channel. The Wilmington-New Hanover Land Use Plan classifies the wetland area of the project site as Conservation and those areas above the 100 year flood elevation as Resource Protection. The applicant proposes to construct a pier and community docking facility (23 slips) to provide water access for their subdivision. The pier would be in two (2) sections. The first section would provide an elevated walkway from the shoreline to the island, and would be 631 feet long and 6 feet wide. Homeowners would utilize a highground foot path to the north side of the island where a second section of pier, 152 feet long and 6 feet wide, would access the floating dock. The floating dock would be oriented parallel to the channel, ranging from 15 to 25 feet waterward of the marsh vegetation, and would be 276 feet long and 5 feet wide. The structure would include 22 perpendicular fingers piers on the waterward side (north) of the main floating dock, each measuring 10 feet in length by 2 feet in width.
