After reviewing Number your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to construct a 6' x 350' dock, to extend 3 ft. waterward of NWL, on a canal adjacent to his property, a 300 ft. retaining wall with backfill and to install a 40' x 6' wide x 3' high culvert with side wall portals in a ditch on his property. C. T. & Shelia Hayes Bio Report Page Two The applicant's property is located at 34 Beverly Drive- (SR 1183) Wanchese, Dare County and adjacent to a manmade canal off the Croatan Sound. The property has 739 ft: of shoreline along the canal and is approximately 35 ft. wide. The property has an elevation of approximately 5 ft. above normal water level (NWL) and is vegetated with loblolly pine and in4genbu='grasses. The property appears to be a relic spoil site used for the deposition of material excavated from the adjacent canal. The property is accessed through the adjacent riparian, property tot he south which is the site of a commercial boat building business. A dirt/rock/shell road bed approximately 15 ft. wide runs the length of the property and is used to access the adjacent riparian property to the north. A 20 ft. wide and 1 ft. deep drainage ditch transects the property approximately 250 ft. from the south property line. A sunken small boat with boards laying over the bow and transom is used by the applicant to access the north portion of his property. To the east of the property exists a Coastal Wetland marsh vegetated with Juncus roemerianius, Cladium Jamaicense and Spartina cynosuroides. The marsh is irregularly flooded and the existing ditch serves as a connection to the canal. Manmade features on the property include a dock 8 ft. wide and 150 ft. long which was permitted by CAMA General Permit 019329A and a meter base for shore ties. The adjacent canal widths.vary from 57 ft. to 68 ft. and the water depth is approximately -7 ft. The waters of the Croatan Sound in this area are classified as SA by the Division of Environmental Management and are closed to shellfishing by the Shellfish Sanitation Branch. Development Proposal In order to provide moorings for commercial fishing use, the applicant proposes to construct an additional dock parallel to the canal shoreline which will be approximately 350 ft. long and 6 ft. wide. The structure will extend 3 ft. waterward of NWL with 3 ft. overland and will be attached- to the existing dock. The applicant proposes to construct a 300 ft. long retaining wall along his eastern property line to separate the adjacent marsh from the upland area. The area behind the retaining wall will be filled to allow the existing dirt roadway to be widened. In order to access the north portion of his property by vehicle, the applicant proposes to install a 40 ft. long, 6 ft. wide and 3 ft. high culvert in the existing ditch and to place fill material in the ditch and over the culvert. A 10 ft. long bulkhead portal is proposed over the culvert ends to contain the fill material. The construction of the dock will shade approximately 1050 sq. ft. of Public Trust Area and Estuarine Waters Areas of Environmental Concern (AEC) and 1050 sq. ft. of Estuarine Shoreline AEC. The proposed dock along with the existing dock will provide the applicant with a total of ten 50 ft. long mooring slips. The construction of the retaining wall and the 1 t C. T. & Shelia Hayes Bio Report Page Three associated filling will result in 1500 sq. ft. of Estuarine Shoreline being filled with 111 cubic yards of fill material. The installation of the culvert and the associated filling will result in 700 sq. ft. of Public Trust Area and Estuarine Waters AEC's being filled. Approximately 18 cubic yards of fill material will be placed below the NWL. The installation of the culvert will not change the use of the ditch 'and water flow should not be adversely affected by the structure.,, Archival aerial photographs indicate a similar structure existed prior to 1989. Vehicular parking will be provided adjacent to the existing dirt drive. The applicant has not proposed to improve this area with imperious surfaces such as gravel or marl. It can be expected that the soil area will be compacted in order to support truck traffic. Water turbidity will occur during construction and vessel traffic will increase within the canal system after the project is complete. Submitted by: Frank A. PROJECT SUMMARY: The applicant proposes to construct a 6' x 350' dock, to extend 3 ft. waterward of NWL, on a canal adjacent to his property, a 300 ft. retaining wall with backfill and to install a 40' x 6' wide x 3' high culvert with side wall portals in a ditch on his property. C. T. & Shelia Hayes Bio Report Page Two The applicant's property is located at 34 Beverly Drive (SR 1183) Wanchese, Dare County and adjacent to a manmade canal off the Croatan Sound. The property has 739 ft. of shoreline along the canal and is approximately 35 ft. wide. The property has an elevation of approximately 5 ft. above normal water level (NWL) and is vegetated with loblolly pine and indigenous grasses. The property appears to be a relic spoil site used for the deposition of material excavated from the adjacent canal. The property is accessed through the adjacent riparian property tot he south which is the site of a commercial boat building business. A dirt/rock/shell road bed approximately 15 ft. wide runs the length of the property and is used to access the adjacent riparian property to the north. A 20 ft. wide and 1 ft. deep drainage ditch transects the property approximately 250 ft. from the south property line. A sunken small boat with boards laying over the bow and transom is used by the applicant to access the north portion of his property. To the east of the property exists a Coastal Wetland marsh vegetated with Juncus roemerianius, Cladium jamaicense and Spartina cynosuroides. The marsh is irregularly flooded and the existing ditch serves as a connection to the canal. Manmade features on the property include a dock 8 ft. wide and 150 ft. long which was permitted by CAMA General Permit 019329A and a meter base for shore ties. The adjacent canal widths vary from 57 ft. to 68 ft. and the water depth is approximately -7 ft. The waters of the Croatan Sound in this area are classified as SA by the Division of Environmental Management and are closed to shellfishing by the Shellfish Sanitation Branch. Development Pro t In order ; to provide moorings for commercial fishing use, the applicant proposes to construct an additional dock parallel to the canal shoreline which will be approximately 350 ft. long and 6 ft. wide. The structure will extend 3 ft. waterward of NWL with 3 ft. overland and will be attached to the existing dock. The applicant proposes to construct a 300 ft. long retaining wall along his eastern property line to separate the adjacent marsh from the upland area. The area behind the retaining wall will be filled to allow the existing dirt roadway to be widened. In order to access the north portion of his property by vehicle, the applicant proposes to install a 40 ft. long, 6 ft. wide and 3 ft. high culvert in the existing ditch and to place fill material in the ditch and over the culvert. A 10 ft. long bulkhead portal is proposed over the culvert ends to contain the fill material. The construction of the dock will shade approximately 1050 sq. ft. of Public Trust Area and Estuarine Waters Areas of Environmental Concern (AEC) and 1050 sq. ft. of Estuarine Shoreline AEC. The proposed dock along with the existing dock will provide the applicant with a total of ten 50 ft. long mooring slips. The construction of the retaining wall and the C. T. & Shelia Hayes Bio Report Page Three associated filling will result in 1500 sq. ft. of Estuarine Shoreline being filled with 111 cubic yards of fill material. The installation of the culvert and the associated filling will result in 700 sq. ft. of Public Trust Area and Estuarine Waters AEC's being filled. Approximately 18 cubic yards of fill material will be placed below the NWL. The installation of the culvert will not change the use of the ditch and water flow should not be adversely affected by the structure. Archival aerial photographs indicate a similar structure existed prior to 1989. Vehicular parking will be provided adjacent to the existing dirt drive. The applicant has not proposed to improve this area with imperious surfaces such as gravel or marl. It can be expected that the soil area will be compacted in order to support truck traffic.
