I requested that Mr. Small submit to this office an explanation of why the problem in the New River is an emergency and plans detailing the area to be dredged, amount and type of material, and type of dredge to be used. The requested information was received on July 3, 1989. On July 5, 1989, I contacted Mr. Small and informed him that the project met the requirements for our Emergency Dredging General certification and requested that dredging only be done on an out going tide. cc: CF Bill Mills . ATLANTIC INTRACOASTAL WATERWAY nrv.uM..~"GE~E~\ (Onslow County) OI'J.Oft.tN\~~:e\"'" ~C TO WHOM IT MAY CONCERN: The WILMINGTON DISTRICT CORPS OF ENGINEERS, Wilmington, North Carolina, proposes to perform E~lliRGENCY maintenance dredging in Channel to New River Inlet, Onslow County, North Carolina. PROJECT DESCRIPTION. This emergency maintenance work is scheduled to begin immediately and will require approximately 25 days to complete. The work will require the removal of all material lying above the plane of 6 feet below mean low water (MLW) within the designated limits shown on the enclosed drawing. The estimated quantity of material to be removed from all areas is approximately 5,000 cubic yards of predominantly coarse sand with lesser amounts of shell fragments. The work will be accomplished by use of the Government sidecast Dredge MERRITT. The m.aterial will be disposed of adjacent to the channel. All dredging will take place only within the existing authorized channel and only during ebb tides. A drawing showing the proposed work with disposal adjacent to the channel is enclosed with this notice. A list of Federal, State, and local agencies with whom these activities are being coordinated is also enclosed. A Final Environmental Impact Statement (FEIS) relating to the authorized maintenance of the project (Maintenance of Atlantic Intracoastal Waterway Side Cannels, North Carolina, dated July 1976) was filed with the Council on Environmental Quality on November la, 1976. There is no known related dredging by others. No impacts to known archeological/historical resources or to endangered species will occur. Dredging will take place within the existing authorized channel. A Section 404(b)(1)(PL 95-217) evaluation report for this emergency is being prepared. Section 401 (P.L. 95-217) General Water Quality Certificate Number 1332 was issued on June 18, 1979 and modified by 1332-R issued June 12, 1987, for emergency dredging due to unpredictable shoaling in the coastal waters of North Carolina. ~ -2- The proposed action is consistent with the approved Coastal Management Program of the State of North Carolina and has been coordinated with the North Carolina Division of Coastal Management. The decision whether to perform this work has been based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal have been balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal have been considered, including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. Under emergency procedures, this public notice is being distributed to all known interested persons concurrent with performance of work in order to assist in developing facts on which a decision may be made by the Corps of Engineers with respect to the disposal of dredged material in navigable or ocean waters. For accuracy and completeness of record, all data in support of or in oppositio~ to the proposed work should be submitted in writing setting forth sufficient detail to support convictions. Any person who has an interest which may be affected by the disposal of this dredged material may request a public hearing. The request must be submitted in writing to the District Engineer immediately and must clearly set forth the interest which may be affected and the manner in which the interest may be affected by this activity.
