VAN DER VAART Secretary June 20, 2016 TRACY DAVIS Director Subject: Minor Modification of NPDES Stormwater Permit NCS000549 Riverbend Steam Station Gaston County The Division of Energy, Mineral, and Land Resources' Stormwater Program received your request to add stormwater outfall (SW018) into you permit on June 7, 2016. The Division has reviewed and approved your request. This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please insert the attached page 13 of 19 in Part II of your permit and discard or disregard the old page (be sure not to discard the old page if its reverse side contains another part of the permit). This modification includes the following changes from your current permit: • Monitoring requirements for the new stormwater outfall SW018. • Because it is on the same page, the modified page also reflects the removal/abandonment of outfalls SW015, SW016, and SWO17 (confirmed in the letter from Duke Energy to DEQ dated October 29, 2015). If any parts, measurement frequencies, or sampling requirements contained in this modification are unacceptable to you, then you have the right to file a petition for a contested case with the Office of Administrative Hearings within thirty (30) days following receipt of this letter. This petition must conform to the requirements of Chapter 150B of the North Carolina General Statutes. Petitions must be timely filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. If you do not file a petition within the required time, the agency decision shall be final and binding. This permit is not transferable except after notice to the Division. Part III, B.2. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit modification does not affect the legal requirements to obtain other permits which may be required by this Division, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local governmental permit that may be required.
