Today, March 15, 2016, at 6:1 OPM we are holding this hearing located at: Cape Fear Community College's Union Station Auditorium 502 North Front Street Wilmington, North Carolina I am Jason Watkins, Field Operations Branch Head, with the North Carolina Department of Environmental Quality, Division of Waste Management, Solid Waste Section. I have been appointed as hearing officer for this public hearing concerning draft landfill permit number 6512 -INDUS -2016 and draft isolated wetland permit number IWP000004, for the Duke Energy, Sutton Energy Complex Industrial Landfill Facility. Sr. Specialist • Johnn Murray, Permitting Engineer I would also like to recognize water quality permitting section staff present this evening: • Jennifer Burdette, 401 & Buffer Coordinator • Jim Gregson, DWR Regional Supervisor - WiRO • JoAnn Steenhouse, DWR WiRO This hearing has been called pursuant to the North Carolina General Statue NCGS 130A- 309.203 of the Coal Ash Management Act Solid Waste Management and Title 15A North Carolina Administrative Code 02H . 13 00 in order to accept public comment on public participation in consideration of draft landfill permit number 6512 -INDUS -2016 and draft isolated wetland permit number IWP000004. Copies of the public notice, draft permits and fact sheets are available this evening in the back of the room or from the Division contacts. A sign-up sheet is also located in the back of the room for you to sign in to the meeting and to indicate if you wish to speak. The Statues require: The Department shall hold a public hearing and accept written comment on the draft permit decision for a period of not less than 30 or more than 60 days after the Department issues a draft permit decision. The public was given a 30 day period to comment on the draft permits prior to this public hearing and will be given an additional 30 days following this hearing. The public comment period began on February 11, 2016 and will end at 5:00pm on April 15, 20167, 2016. All comments received within this 60 -day period will be considered in making the final determinations regarding the permit. At this time I will summarize the contents of draft landfill permit number 6512 and isolated wetland permit number 4, which are the subject of this public hearing. LANDFILL PERMIT STRUCTURE The permit is divided into two parts, the Permit to Construct, and the Permit to Operate, consisting of a list of Approved Documents, and specific conditions for the construction, operation, and monitoring of the landfill units. DESCRIPTION The Solid Waste Section has prepared a draft of Solid Waste Permit number 6512 -INDUS - 2016. The draft Permit allows for the following activities: 1. Construction of Cells 1 through 11 the landfill; and 2. The operation of Cells of the landfill as they are construct and approved by the Division. The division has determined that the proposed facility plan, engineering plan, construction quality assurance plan, operation plan, closure and post -closure plan, and water quality Public Hearing Duke Energy, Sutton Energy Complex, Industrial Landfill Draft Landfill Permit No. 6512 -INDUS -2016 Draft Isolated Wetland Pen -nit No. IWP000004 March 15, 2016 6:OOPM Cape Fear Community College Page 4 of 5 monitoring plan, as identified in the permit to construct application, satisfy the requirements and intent of the North Carolina Solid Waste Management General Statues and Administrative Code. ISOLATED WETLAND PERMIT The permit authorizes 6.57 acres of isolated wetlands to be impacted by the proposed landfill. Specific conditions are included to ensure protection of water quality such as requiring compensatory wetland mitigation, adherence to solid waste and NPDES permits, notification to the Division of Water resources regarding requests to modify these permits, and modification of the isolated wetlands permit or application for a Section 404 permit for future ash basin and lay of land area excavation activities. The permit also includes general conditions that the project must followed in order to protect water quality. Notification Persons who want to receive notice of the final permit decisions should register with the Division contact. The purpose of the hearing this evening is to receive comments on the on the draft permits. Comments will only be accepted on the draft permits. We are not here to discuss the permits, to answer questions during the hearing, or enter into debate. At the conclusion of the hearing, staff will be available to answer questions. Five minutes will be allotted per speaker. Please note that a transcript of this hearing will be made available on the Solid Waste Section website under the Public Notices heading using the following address: http://portal.ncdenr.org/web/wm/sw A written response will be provided for all comments and will be made available upon request to the Division contact.
