JAY ZIMMERMAN Director FACT S H E ET Individual Isolated and Other Non -404 Jurisdictional Wetlands and Waters Permit for Duke Energy Progress Sutton On-site Landfill DWR Project # 2015-0998 Public Hearing: When: March 15, 2016 Where: New Hanover, NC Location: Cape Fear Community College's Union Station Auditorium 502 North Front St. Wilmington, N.C. Registration starts at 5:00 PM. Hearing will begin at 6:00 PM. RACKGROHND- On December 22, 2015, Duke Progress Energy applied to the North Carolina Division of Water Resources (DWR) for an Individual Isolated and Other Non -404 Jurisdictional Wetlands and Waters Permit, pursuant to Title 15A North Carolina Administrative Code 02H .1300. The activity for which this permit is sought is to permanently impact 6.57 acres of isolated wetlands at the L.V. Sutton Steam Plant in New Hanover County to construction a coal combustion residual landfill. The Division of Water Resources must take final action on the application prior to May 14, 2016. PUBLIC HEARING PROCEDURES: The public is invited to attend the public hearing and may make verbal comments and/or submit written comments, data or other relevant information. Speakers must register at the hearing and the speaking sequence will be in the order of registration. Registration will begin at 6:00 p.m. Speaking times may be limited to 3 minutes maximum per speaker, with the final time limit to be determined on the day of the hearing depending upon the number of registered speakers. Information presented should specifically address issues related to water quality impacts resulting from the construction a coal combustion residual landfill at the L.V. Sutton Steam Plant. Cross examination of persons speaking will not be allowed, however, the Hearing Officer may ask questions for clarification. Written comments may be forwarded at any time before or after the hearing provided they are received by the Division no later than 5:00 P.M. on April 15, 2016. HOW TO SUBMIT WRITTEN COMMENTS: The public is invited to comment in writing on the application described above. Written comments may be submitted to the Division of Water Resources. All written comments must be received by 5:00 P.M. on April 15, 2016 in order to be considered.
