Past uses on the property include automotive fuel sales, automobile repair services, food services and residential. Lambert Development South Street LLC plans to redevelop the property with residential condominiums and associated parking structure. Groundwater sampling was conducted at the 601 West South Street property. Detects of benzene, trichloroethylene and tetrachloroethylene were identified in groundwater samples at concentrations above the 15A NCAC 02L .0202 Groundwater Quality Standards (April 1, 2013 version). Detects of benzene, trichloroethylene, 1,2,4-trimethylbenzene were identified in groundwater samples at concentrations above the Residential Vapor Intrusion Screening Levels for Ground Water (October 2017). From December 2016 through February 2017 soil excavation was conducted at the candidate brownfields property, petroleum impacted soils were reported, and an UST was discovered and removed (refer to UST Incident No. 46192). TPH-GRO and DRO were identified in soil samples at concentrations exceeding the respective action levels of 50 and 100 ppm. UST Incident Nos: 15998 and 33450, Brownfields Property: Raleigh MGP (13022-09-092), IHSB Site: Raleigh Coal Gas Plant No. 2 (NCD986188902) and Hazardous Waste Sites: Rose & Sons Auto Service Inc, (NCD981855612) and Clancy & Theys (NCR000003897) are located nearby the candidate Brownfields Property. The applicant PD listed above have asserted that: 1) they have not caused or contributed to the contamination at the property, and 2) they have substantially complied with laws, regulations, and rules for the protection of the environment. A Brownfields Agreement (BFA) has no legal effect on your agency's authority to regulate or enforce against any and all parties who caused or contributed to the contamination at the property. In fact, the BFA will require the developer to provide access to the property to any party doing work under any DEQ program. A BFA provides liability protection only to a non-causative redeveloper of the property. The developer will be required to make the property safe for its intended re-use. Cleanup to unrestricted use standards will not be required unless deemed necessary based on the developer's proposed use of the property. Furthermore, the BFA will not change the developer's responsibility to obtain any and all DEQ permits (e.g. storm water, sediment control, NPDES, etc.) as required under applicable law.
