Dear Mr. Peck:
The North Carolina Department of Environment and Natural Resources (DENR) is in receipt of
the Letter of Intent (LOI), submitted on August 23, 2006 and the additional submittal on August 28, 2006
on behalf of Eden & Avant Investments Limited Partnership as prospective developer (PD), seeking entry
into the North Carolina brownfields program for the referenced site. After reviewing the LOI with
respect to the requirements of the Brownfields Property Reuse Act of 1997, we have determined that a
revised affidavit is required. The address listed in number 3 on the affidavit refers to the wrong property.
Please submit a corrected affidavit before a determination can be made regarding the project’s eligibility
for the brownfields program. Upon our receipt of the information, we will expedite the eligibility
determination.
