Park Ave. Charlotte NC 28203 frankamcc@aol.com Subject: Annual Sampling Required by Land Use Restriction (LUR) Notice of Brownfields Property Brown’s Solvent Co., 2935 Griffith Street Charlotte, Mecklenburg County Brownfields Project No. 05006-01-060 Dear Mr. McCleneghan: On February 17, 2010, the North Carolina Brownfields Program received a written request from MACTEC Engineering and Consulting, Inc, on behalf of current owner, Mr. Frank McCleneghan, for the above reference brownfields site. The request was to eliminate the sampling requirement in LUR No. 13 in the Notice of Brownfields Property. The Notice was recorded on May 20, 2004 at the Mecklenburg County Register of Deeds, Book 17225, Page 171-199, by the Estate of Katherine C Bell. In the Notice, LUR No. 13 states the following: 13. Unless and until DENR approves their abandonment pursuant to the next land use restriction, the groundwater monitoring wells denominated MW-1 (in the former UST basin) and MW-4 (northwest and downgradient of the former UST basin) on the plat component of the Notice of Brownfields Property referenced in paragraph 16 below shall be properly maintained, and shall, in alternating years commencing with the year this Agreement becomes effective, be sampled, by U.S. Environmental Protection Agency Method 8260, for toluene. If the sampling results for toluene are below the applicable gross contamination level of 257,000 ug/L contained in the Guidelines for Assessment and Corrective Action of DENR’s Underground Storage Tank Section for two consecutive sampling events, the then current owner of each affected portion of the Property may request in writing that DENR terminate the sampling requirement. In April 2010, DENR hereby approved your request to cease groundwater sampling as contaminant levels have remain steady or decreased. In October 2013, the monitoring wells were abandoned and documentation submitted to DENR in accordance with LUR 14. Be advised that the current owner is still required to submit an annual LUR Update, but the sampling is no longer required. Please refer to this correspondence in future LUR Updates.
