Vapor mitigation systems are required in areas denominated "Area of Potential Vapor Concern" on the
plat map recorded as Exhibit B to the Notice.
Use of surfacewater was not observed. A groundwater supply well was allowed pursuant to the approval
letter dated 1/27/2014
Exposed soils were not observed. Hotel portion of property is undeveloped at this time (see attached
photos). Areas of Contaminated Soil are properly maintained per LUR 4.
Prohibited bulk chemical storage (Petroleum Fractions) was not observed.
Property is open to public ingress and egress. Portion of property also constitutes part of the
Wilmington River Walk.

Property is mostly undeveloped with plans to construct multi-story mixed use hotel
complex and a public park. Marina docks have been constructed and are in use
Basements were not observed on the property.

Inspector Comments
This property mostly remains undeveloped. The marina tract has been dredged and is now in operation. All parcels that comprise the entire
brownfield property are listed in the "Recorded Instruments" section below. During the title search for current owners, it was discovered that
Riverfront holdings still own a portion of the brownfields property and that a new entity, Northern Riverfront Marina and Hotel LLLP, have owned
portions of the brownfields property snice July 2014. Three (3) of the current owners are currently noncompliant with respect to NCGS 130A-
310.35(d), paragraph 23 of the BFA and LUR 15 (LURU).
Additional follow-up with non-compliant owners needed to address missing LURUs and required deed language. A Letter Notice of LURU Non-
compliance dated April 15, 2015 was issued to Pier 33, LLC. All other current owners who were not issued a Non-compliance letter were unknown
until this recent title review. Additional letters or e-mails will be sent to current non-compliant owners to address these deed and LURU issues.
