Dear Mr. Stanfield:

At your request, I am notifying you of the current compliance status of the above referenced
brownfields property. This response covers required actions recently requested by the North Carolina
Brownfields Program (NCBP) for compliance with the Notice of Brownfields Property and Brownfields
Agreement recorded on April 24, 2006.

To date NCBP has received the following documentation to complete the required compliance
actions:

1. Revised Land Use Restrictions Update form detailing an asphalt cap repair (letter dated March
7, 2012, Selwyn Properties/MPP 1600 LLC).
2. Deed of Trust copy containing required Brownfields language within an instrument of
conveyance (letter dated April 12, 2012, Johnston Allison & Hord).
3. Notification of monitoring well abandonment (letter dated August 21, 2006, Helms Mulliss
Wicker PLLC)

The above documentation has been reviewed and accepted by NCBP. Therefore, the subject brownfields
is deemed in compliance and no further actions are required at this time.
