HomeMy WebLinkAbout14043_Morganton Heights_Wal-Mart Stores_LURU17Brownfields Project #: 14043-10-12 Brownfields Property: Morganton Heights, 400 Henredon Drive Property Owner (In whole or part): ___Wal-Mart Stores, Inc.___________ LAND USE RESTRICTIONS (“LUR”) UPDATE LUR 1: No use may be made of the Brownfields Property other than for retail, office and hotel purposes, and, if the Department of Environment and Natural Resources (“DENR”) issues prior written approval, other commercial purposes and high-density residential purposes upon such conditions as DENR may impose. Within the meaning of this restriction, the following definitions apply: a. “Retail” refers to the sale of goods, or services not covered by LUR 1.b. below, directly to the consumer, and includes restaurants. b. “Office” refers to the conduct or rendering of business or professional services. c. “Hotel” refers to the provision of overnight lodging to paying customers, and to associated reservation, cleaning, utilities and on-site management and reception services. d. “Commercial” refers to a business enterprise. e. “High-density residential” refers to use of units in multi-unit buildings as permanent dwellings. In compliance _X___ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ LUR 2: Unless compliance with this LUR is waived in writing in advance by DENR in relation to particular buildings, no use of the Property may occur prior to demolition of all buildings on the Property depicted on the plat component of the Notice of Brownfields Property (“Notice”) [other than the substation near the Property’s western property boundary] in accordance with applicable legal requirements, including without limitation those related to lead and asbestos abatement that are administered by the Health Hazards Control Unit within the Division of Public Health of the North Carolina Department of Health and Human Services. In compliance _ X ___ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ LUR 4: Within the area of the Property 500 feet east of Henredon Brook, no activities that encounter, expose, remove or use groundwater (for example, installation of water supply wells, fountains, ponds, lakes or swimming pools, or construction or excavation activities that encounter or expose groundwater) may occur on the Brownfields Property without prior sampling and analysis of groundwater to the written satisfaction of DENR in any areas proposed for such activities, and submittal of the analytical results to DENR. If DENR requires sampling and determines that the analyses reflect contaminant concentrations that exceed the standards and screening levels applicable to the uses authorized for the Brownfields Property, the groundwater-related activities proposed may only occur in compliance with any written conditions DENR imposes. In compliance _ X ___ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ Morganton Heights (#14043-10-12) LUR 5: Stream sediment and soil in the area designated “No Soil Disturbance Without DENR Approval,” on the plat component of the Notice, may not be disturbed unless and until DENR states in writing, in advance of the proposed disturbance, that any risk from soil contamination on the Brownfields Property is such that the Brownfields Property is, or assuming implementation of and compliance with DENR-approved measures will be, 1) suitable for the uses specified in LUR 1 above and 2) does not render public health and the environment less than fully protected. Any measures DENR determines in writing are necessary for that statement to be made shall be taken pursuant to a plan approved in writing by DENR in advance, and approved in writing as implemented. Such measures may include without limitation environmental sampling and soil removal, treatment and/or capping. In compliance _ X ___ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ LUR 6: No use may be made of the Property until, to DENR’s written satisfaction, at least two (2) feet of clean fill or a building, paved parking area or other impervious surface is placed, at grade as of recordation of the Notice, on the sampling locations designated “SB-1, SB-25, and SB-124” on the plat component of said Notice. Said fill or impervious surface shall be maintained. In compliance _ X ___ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ LUR 7: In the area designated “Vapor Intrusion Requirement Zone” on the plat component of the Notice (i.e., the area within 125 feet of the monitoring well designated EMW-3 on said plat), any building constructed must satisfy one (1) of these conditions: a. vapor intrusion mitigation measures, approved in writing by DENR in advance, have been installed to the satisfaction of a professional engineer licensed in North Carolina, as evidenced by said engineer’s seal, and photographs illustrating the installation and a brief narrative describing it are submitted to DENR and deemed satisfactory in writing by that agency; or Morganton Heights (#14043-10-12) b. DENR has concurred in writing in advance, based on a technical showing by the building’s proponent, that the building’s users, and public health and the environment, would not be at risk from indoor vapor intrusion from the Property’s volatile contaminant plume. In compliance __X__ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ LUR 8: None of the contaminants known to be present in the environmental media at the Property, including those listed on the plat component of the Notice, may be used or stored at the Property without the prior written approval of DENR, except in de minimis amounts for cleaning and other routine housekeeping activities, in sealed, pre- packaged containers sold in a retail context, or as constituents of fuels and oils in emergency generators and other machinery so long as none of the machinery’s fuel tanks, piping, equipment or generators are located within 125 feet of the monitoring well designated “EMW-3” on the plat component of the Notice. In compliance _ X ___ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ Morganton Heights (#14043-10-12) LUR 10: The owner of any portion of the Brownfields Property where any existing, or subsequently installed, DENR-approved monitoring well is damaged shall be responsible for repair of any such wells to DENR’s written satisfaction and within a time period acceptable to DENR. In compliance __ X __ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ LUR 11: Neither DENR nor any party conducting environmental assessment or remediation at the Brownfields Property at the direction of, or pursuant to a permit, order or agreement issued or entered into by, DENR may be denied access to the Brownfields Property for purposes of conducting such assessment or remediation, which is to be conducted using reasonable efforts to minimize interference with authorized uses of the Brownfields Property. In compliance __ X __ Out of compliance ____ Remarks: _______________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ ________________________________________________________________________ LUR 12: During January of each year after the year in which the Notice is recorded, the owner of any part of the Brownfields Property as of January 1st of that year shall submit a notarized Land Use Restrictions Update (“LURU”) to DENR, and to the chief public health and environmental officials of Burke County, certifying that, as of said January 1st, the Notice remains recorded at the Burke County Register of Deeds office and that the land use restrictions applicable to that owner’s part(s) of the Property are being complied with.
