RTFNC is in the process of obtaining a brownfields agreement (BFA) on this property. RTFNC plans to sell the property for development. One of the public comment requirements of the North Carolina Brownfields Program (NCBP) is to notify property owners of contiguous parcels prior to the public comment period so they are aware of this process. Under the brownfields statute, RTFNC is recognized as a party that did not cause or contribute to any contamination at the property, and is not responsible to remediate the soil and groundwater at the property to unrestricted use levels. However, the BFA specifies institutional controls in the form of land use restrictions (LURs) that specify the types of reuse of the property. These LURs have been developed to ensure the suitability of the intended reuse(s) of the property. The boundary of RTP 8 is shown in red on the attached Figure 1, and the parcel information from the Wake County and Durham County GIS websites indicates you own one or more parcels that are contiguous to the brownfields property. In the case where parcels overlap the two counties, two PINs for the two counties are referenced above. Also attached is the summary notice of intent (SNI) prepared by the NCBP, which provides information related to where you can view the draft BFA and ancillary documents and the dates of the public comment period, which begins on October 1, 2016. After the 30-day public comment period and based on any written comments received, the NCBP will finalize the BFA after determining if any changes to the document or a public meeting are needed. The results of soil and groundwater sampling conducted at the site are included in the draft BFA, and the locations of the samples are marked on the brownfields plat map included in the package. Active remediation of the site is not required in the BFA, although there are additional requirements associated with redevelopment of the “Area of Overshot” designated on the plat. Please review the attached SNI to determine whether you would like to review the draft BFA during the public comment period, and provide the City with any comments you may have.
