There are no records or other information concerning the volumes or dates
upon which the oil spill occurred. The tank was in operation from 1963 until 1989.
Based on interviews the surface stains were caused when delivery hoses were
drained onto the ground and releases were not routine, continuous. or systematic.
The diesel fuel was used to operate fork lifts that operated in the lumber yard. The
tank was removed from the facility in 1989.
SWMU No. 9 is located in a relatively flat area adjacent to the lumber yard
building 150 feet east of the ditch which runs south to north through the plant to
Lower Creek. Overland flow in this area is via sheet flow to the north towards Lower
Creek and the unnamed northwsouth tributary bisecting Tract 1.

Fact Sheet and Notification
To All Interested Parties:
Singer Furniture Company announces that the North Carolina Department of Environment and Natural
Resources (NCDENR) has approved the company's request to modify hazardous waste permit number
NCO 000604322. The effect of this modification is to:

Redefine the legal boundaries of the RCRA facility to only include those portions of the
Singer Furniture Company (SFC) property identified as Tract 1 of the Miller Hill Complex.
Establishes that if it is detennined that environmental contamination has been derived
from solid waste management unit {SWMU) number 3 (also known as the Glue Wash
Evaporation Pond), SFC shall be responsible for the implementation of any NCDENR
approved remediation plan. For regulatory compliance purposes, if contamination exists,
the contamination shall be regulated as if it originated from the redefined RCRA facility.
Creates permit conditions, that require the recording of deed restrictions and limits the
future uses of the subdivided property such that:
The Property shall be hereafter limited to commercial and industrial uses (to the
extent that such uses do not include any use that would allow children. or elderly, ill or
infirm persons to reside, be cared for or be otherwise present on the Property on a routine
and recurring basis, including, but not limited to, such use as an adult or child day-care
facility, nursing home. primary or secondary educational facility, or health care facility,
none of which shall be allowable uses) and all other uses shall hereafter be prohibited;
and
The withdrawal and/or injection of water from or into the subsurface aquifers or
any other water bearing zone underlying the Property shall be hereafter prohibited except
to the extent that such withdrawal and/or injection is affirmatively approved or lawfully
ordered NCDENR; and
No surface water within the Property may be used for any purpose including,
without limitation, swimming, fishing or potable or agricultural purposes, provided
however thai this use restriction does not prohibit access to suen surface wale1:; for' ii"le
purpose of environmental investigation or remediation.
SFC has clean-closed the hazardous waste treatment (incinerator) and storage (container) units. The
clean closure certifications were accepted by the North Carolina Department of Environment and Natural
Resources on February 24, 1994. The company is continuing its investigation of the SWMU's located on
the property. The company believes that with appropriate institutional controls and deed restrictions the
SWMU's will not harm human health or the environment.
This Fact Sheet and Notice is being delivered to owners of property located within 1000 feet of the Singer
Furniture Company property locally known as the Miller Hill Complex. The facility is located at 714
Virginia Street, S.W., Lenoir, North Carolina 28645.
