The approximately 20.375 acre subject property consists of one parcel which isdivided by Moncure Pitssboro Road. The parcel ID number for the subject property as listed inthe Chatham County tax database is 60773. The current deed for the parcel that makes up thesubject property are found in the Chatham County Register of Deeds Book 1721 Page 0346.The objective of this ESA was to identify recognized environmental conditions ("RECs") inconnection with the subject property. This ESA was performed in conformance with the scope,methodology, and limitations described in ASTM E 1527-13 -- Standard Practice forEnvironmental Site Assessments: Phase I Environmental Site Assessment Process. Limitationsand exceptions to this practice are described in Section 2.4; deviations are described in Section11. Spangler Environmental, Inc. ("SEI") conducted this ESA in accordance with the agreedupon scope of work. Activities included review of government records, review of historicaldata, review of available mapping resources, and site reconnaissance to determine existingconditions and past land use activities. The subject property is currently vacant and developed with a poultry processing facility. Areasaround the perimeter of the property are wooded. The property contains a guardhouse, twopump buildings, an assembly building, a barn, a shed, a workshop building, two officebuildings, a vehicle maintenance building, and a main facility comprised of several adjacent andadjoining structures. Municipal water, sewer, and electricity are available to the subjectproperty (See Site Photographs). Under contract with SEI, Environmental Data Resources, Inc. ("EDR") of Milford, Connecticutprepared an EDR Radius Map (RM) for the subject property. SEI provided EDR with thelocation of the subject property based on information provided to SEI by representatives ofLonerider Brewing Co. EDR analyzed federal, state, and tribal government environmentaldatabases and EDR proprietary records for information on sites or facilities with known orexpected environmental conditions within minimum search distances of the subject property, asspecified by ASTM E 1527-13. The RM listed no individual sites that were not mapped due to missing or inadequate addressinformation (i.e., Orphan Summary). Analysis of the RM indicated that the subject property was listed on the searched databases(RM# A1&A2&A3 Townsends Inc. Pittsboro Plant). Records identified four (4) mapped siteslocated within the minimum search distances of the subject property (RM# 2 Quick Change Oiland Lube, 20 Deegan Dr., RM# 5 Brewer Property, Sandra, 134 Log Barn Rd., RM# 6&B7Louisiana-Pacific Corporation, 840 Moncure-Pittsboro Rd., RM# B8&B9 NCDOT AsphaltSite #30, SR 1012and SR 1962), located within the minimum search as defined by ASTM E1527-13. The corresponding documentation for these databases is included in Appendix B. The physical setting (i.e., location of drainage features and/or relative topographical position) ofeach of the four discrete locations listed in the RM were evaluated to determine the potential forimpact to the likely presence of recognized environmental conditions on the subject property. Based on distance to the subject property, topographical features, remediation efforts, and thetype of contaminant known to have impacted these sites, in our best professional judgment, thefour discrete mapped sites have minimal potential to impact the subject property. During sitereconnaissance and review of regulatory records, observations were made which lead to theidentification of environmental concerns. As a result of these observations and the findings ofthis assessment, evidence suggests the presence or likely presence of any hazardous substanceor petroleum products on the property under conditions that indicate an existing release, a pastrelease, or a material threat of release of any hazardous substance or petroleum products ontostructures on the property or into the ground, groundwater, or surface water of the property. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 2 - Therefore, two RECs in association with the subject property have been identified in thisassessment:•A 10,000 gallon diesel UST is located southeast of the service garage. According to thelatest inspection performed in February 2014, the tank appears to be empty. The tank waswas originally installed in 1961, is of single walled steel construction, and does notcurrently have a functioning corrosion prevention system. An NOV has been issued dueto the failure to maintain the corrosion prevention system and for having improperregistration. Due to the age of the tank, type of construction, and nonfunctional corrosionprevention system, this tank is identified as posing a material threat of release and istherefore considered an REC.•Several 55 gallon storage drums, some full, some partially full, some empty, wereobserved on the northern exterior of the maintenance building on a concrete pad. Thelabels on the drums identified various types of oil, hydraulic fluid, and polymers. Some ofthe storage drums observed on the northern exterior of the maintenance building did nothave labels that were legible. Furthermore, some of the drums appeared to only bepartially full. As a result, SEI was not able to reasonably identify the contents of thesedrums. Staining of the floor of the concrete storage area was observed in the vicinity ofthe drums. The staining was confined to the concrete pad. Due to the unknown contents ofthese drums and the observed staining, an REC has been identified. 2.0 Introduction 2.1 Purpose The objective of this ESA is to identify, to the extent feasible, recognized environmentalconditions in connection with the subject property pursuant to the process described in ASTMStandard E 1527-13 -- Standard Practice for Environmental Site Assessments: Phase IEnvironmental Site Assessment Process. This involved evaluating the property forcontaminants within the scope of the Comprehensive Environmental Response, Compensation,and Liability Act (CERCLA) and for petroleum products and other environmental conditions. 2.2 Scope-of-Services Spangler Environmental, Inc. has (SEI) completed this ESA in accordance with methodologydescribed in ASTM E 1527-13. Achieving assessment objectives entailed the following: •Identifying historic uses of the property from the present to the property's first developeduse, or 1940, whichever is earlier.•Reviewing and interpreting reasonably ascertainable and practically reviewable federal,state, and local public records for the subject property and immediate vicinity.•Performing visual inspection and walk-through of the subject property and immediatevicinity, including photographic documentation.•Performing a Vapor Intrusion Screen for the subject property. This ESA did not include any sampling or testing of materials. Environmental issues orconditions specifically outside the scope of this assessment include, but are not limited to,asbestos-containing materials, radon, lead-based paint, lead in drinking water, wetlands,regulatory compliance, cultural and historical resources, industrial hygiene, health and safety,ecological resources, endangered species, indoor air quality, and high voltage power lines. Deviations from the methodology described in ASTM E 1527-13 are mentioned in Section 11.0of this report. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 3 - 2.3 Significant Assumptions No significant assumptions were required to satisfy the scope of services of this ESA. 2.4 Limitations and Exceptions Consistent with good commercial or customary practice, the level of inquiry for this report hasbeen guided by the type of property and the information developed in the course of inquiry. Thework performed in conjunction with this ESA is based upon the described scope of services,and not on tasks or procedures beyond the scope of services or the time constraints imposed bythe client. All data developed and the findings, opinions, and conclusions discussed herein arerelevant to the subject property and to the dates of the site work and should not be relied uponto represent conditions on other properties or dates. SEI did not perform a 50-year title searchfor the subject property as per ASTM 1527-13. All surface environmental assessments are inherently limited in that conclusions are drawn andrecommendations developed from information obtained from limited research and siteevaluation at a specific time. Environmental circumstances at the subject property andsurrounding properties may change with the passage of time. Hazardous materials beneath thesurface or covered by debris may be present but undetectable during site reconnaissance.Verification of subsurface conditions, including the hazard potential of buried or covereddebris, is beyond the scope of this investigation. This assessment was performed in a professional manner using the degree of skill and careexercised for similar projects under similar conditions by reputable and competentenvironmental consultants. SEI made a reasonable attempt to seek out all relevant facts to theextent that such information was reasonably ascertainable and practically reviewable. SEI shallnot be responsible for conditions or consequences arising from relevant facts that wereconcealed, withheld, or not fully disclosed at the time the evaluation was performed. The findings and conclusions contained in this report are partly based upon, and limited by, thegovernment data and other information made available for the locations considered at the datesgiven. While SEI has used reasonable care to avoid reliance on faulty information, it is not ableto verify the accuracy of all data and information provided by government entities and thirdparties. Therefore, SEI is not responsible for any finding, opinion, or conclusion contained inthis ESA that is based, in whole or in part, upon inaccurate or incomplete data, or that wasobtained directly or indirectly from third parties. Unless otherwise indicated in this report, no attempt was made to check on the compliance ofpresent or past owners of the site with federal, state, or local laws and regulations. This ESA shall be used solely for its intended purpose and by the intended client. This reportdoes not constitute an environmental regulatory compliance audit and shall not be used as such.The conclusions presented in this report are scientific rather than legal in nature, unlessspecified otherwise. Any person or entity considering the use, acquisition, or the like, of thesubject property does so on the sole reliance of his or her own judgment and on his or her ownpersonal investigation of such property, and not in reliance upon any representation by SEIregarding such property, the character, quality, or value thereof. The following limitations were encountered during the preparation of this report:-The historic use of the subject property dating back to 1940 could not be established throughthe review of available historical resources-The historical use of the subject property could not be verified at 5 year intervals due to gaps inthe available historical resources. However, review of historical aerial photography indicatesthat the use of the subject property did not singificantly change from the time the property wasfirst documented in aerial photography to the present. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 4 - 2.5 Special Terms and Conditions The term "recognized environmental condition" means the presence or likely presence of anyhazardous substance or petroleum products on the property under conditions that indicate anexisting release, a past release, or a material threat of release of any hazardous substance orpetroleum products onto structures on the property or into the ground, groundwater, or surfacewater of the property. The term is not intended to include de minimis conditions that generallydo not present a material risk of harm to public health or the environment and that generallywould not be the subject of an enforcement action if brought to the attention of appropriategovernmental agencies. The term "historical recognized environmental condition" describes anenvironmental condition which in the past would have been considered a recognizedenvironmental condition, but which may or may not be considered a recognized environmentalcondition currently. The term "controlled recognized environmental condition" means arecognized environmental condition resulting from a past release of hazardous substances orpetroleum products that has been addressed to the satisfaction of the applicable regulatoryauthority (e.g., as evidenced by the issuance of a NFA letter or equivalent, or meetingrisk-based criteria established by regulatory authority), with hazardous substances or petroleumproducts allowed to remain in place subject to the implementation of required controls (e.g.,property use restrictions, AULs, institutional controls, or engineering controls). The term"vapor intrusion condition" is described as the presence or likely presence of any chemical ofconcern in existing or planned structures on a property resulting from an existing release or apast release from contaminated soil or groundwater on the property or within close proximity tothe property, at a concentration that presents or may present a human health risk. As such, theterm "potential vapor intrusion condition" describes where vapors of hazardous substances orpetroleum products have the potential to intrude into a building or planned building location.The term "vapor encroachment condition" describes the presence or likely presence of chemicalof concern vapors in the subsurface of the property caused by the release of vapors fromcontaminated soil or groundwater or both either on or near the property as identified by the Tier1or Tier 2 procedures. The term "subject property" means the real property consisting of the 20.375 acre tract of landthat consists of one parcel identified in the Chatham County tax database as PIN# 60773. Thecurrent deed for the parcel that makes up the subject property is found in the Chatham CountyRegister of Deeds Book 1721 Page 0346. The subject property is defined in greater detail inSection 3.0. 2.6 User Reliance Lonerider Brewing Co. are intended to be the only recipients of this report, and may distributethe report and its findings as necessary, at the discretion of Lonerider Brewing Co. This reportis work product of SEI. Additional replication and distribution of this report is strictlyprohibited by SEI, unless permission has been granted by SEI. 3.0 Site Description 3.1 Location and Legal Description Based on the information provided by the User, the 20.375 acre subject property consists of oneparcel which is divided by Moncure Pitssboro Road. The parcel ID number for the subjectproperty as listed in the Chatham County tax database is 60773. The current deed for the parcelthat makes up the subject property is found in the Chatham County Register of Deeds Book1721 Page 0346. A Location Map is provided in Appendix A as Figure 1. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 5 - 3.2 Site and Vicinity General Characteristics Geologically, the subject property is mapped as Felsic Metavolcanic Rock in the Charlotte andMilton Belt (North Carolina Department of Natural Resources Geological Survey, 1985). Thisrock unit is described as "metamorphosed dacitic to rhyolitic flows and tuffs, light gray togreenish gray; interbedded with mafic and intermediate metavolcanic rock, meta-argillite, andmetamudstone." This unit is identified as Cambrian/Late Proterozoic in age. The site is located on the USGS 7.5 Pittsboro, NC topographic quadrangle. The generaltopography of the site is sloped toward the southeast, with mild topographic relief across mostof the subject property. Surface drainage appears to flow towards the south and eastern portionsof the property. A copy of the USGS Topographical Map is included as Figure 1. According toEDR databases, the subject site is at elevation + 418 NGVD. Soils at the subject property (see Soils Report in Appendix H) are mapped by the United StatesDepartment of Agriculture, Soil Conservation Service (USDA-SCS) as four individual soiltypes. These soil types consist of the following: Georgeville Silt Loam, Georgeville - BadinComplex, Goldston - Badin Complex, and Georgeville - Urban Land Complex. The majority ofthe soils at the property are described as silty loams. The majority of the property is identifiedas Georgeville Silt Loam which is described as well drained silt loam found on 2-6% and6-10% slopes with a parent material of residuum weathered from metavolcanics and/or argillite.Georgeville - Badin Complex is described as well drained silt loam found on 10-15% slopeswith a parent material of residuum weathered from metavolcanics and/or argillite. Goldston -Badin Complex is described as well drained very channery silt loam found on 15-35% slopeswith a parent material of residuum weathered from metavolcanics and/or argillite. Georgeville -Urban Land Complex is described as well drained silt loam found on 2-10% slopes with aparent material of residuum weathered from metavolcanics and/or argillite. A more detaileddescription of the individual soil types and their location can be found in the Soils Report inAppendix H. These soil conditions appear to be present at the subject site based on sitereconnaissance. Portions of the southern and eastern regions of the property are located in flood zone AEaccording to the FEMA Floodplain Map # 3710974100J. The developed portions of the targetproperty do not lie within a flood hazard area. The FEMA data is shown within the EDRphysical setting source summary provided as Appendix B as well as Appendix H. 3.3 Current Use of the Property The property is currently developed with a poultry processing facility as well as numerousoutbuildings that support the facility's operations. The facility was once operated byTownsends, Inc. The property is currently vacant and the facility appeared to have not been inoperation for a significant period at the time of the site visit. According to the review ofregulatory documents the facility closed down in 2011. 3.4 Site Improvements The subject property consists of one 20.375 acre parcel which is divided by Moncure PitssboroRoad. The parcel ID number for the subject property as listed in the Chatham County taxdatabase is 60773. This parcelis currently zoned as Heavy Industrial (M-2) by the Town ofPittsboro Planning Department. The subject property is improved with several buildings. The portion of the property south ofMoncure-Pittsboro Road contains the following structures: a guard house, two pump buildings,a barn, a shed, an assembly building, an office and storage building, a maintenance building, onoffal processing building, and the main poultry processing facility which itself is made up of a Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 6 - collection of buildings. The property is believed to have been originally developed with apoultry processing facility in the early 1960s. The portion of the property north ofMoncure-Pittsboro Road contains the following structures: an office building and a servicegarage. The property contains a 1,000,000 gallon upright AST, a 300,000 gallon upright AST,and a third upright AST of unknown capacity. The main facility is heated and cooled byroof-mounted air handling units. Two truck scales are located on the property. The property isdeveloped with parking areas for the main facility as well as the service garage. The property isserviced by overhead power lines and appears to be serviced by municipal water and sewer. 3.5 Current Uses of the Adjoining Properties Properties within the vicinity of the subject property are generally residential. Adjoining to thewest of the subject property are residential single family homes. Adjoining to the south of thesubject property appears to be a partially wooded agricultural tract. Adjoining to the north ofthe subject property are residential single family homes. Adjoining to the northeast of thesubject property is undeveloped wooded land. Adjoining to the east of the subject propertyappears to be a water treatment facility (See Site Photos). 4.0 User Provided Information SEI was provided limited data and information by the intended User(s) of this Phase IEnvironmental Site Assessment. Information provided was verified, to the extent practicable, asdescribed in the following Subsections of this Section 4.0. The lack of information, if noted, hasbeen considered by the Environmental Professional(s) in the preparation of this report, and doesnot materially condition or limit any conclusions or opinions given by the EP in this Section 4.0or elsewhere unless otherwise specifically stated. SEI has no specialized knowledge of the Subject Property outside of the research which wasconducted and reported as part of this report. The property ownership and tenants as well as all individuals who were interviewed as part ofthis investigation, have not reported any specialized knowledge of this Subject Property outsideof what is contained in this report. 4.1 Title Records According to the Chatham Tax Department, Reman Properties LLC currently owns the subjectproperty. Records in the Chatham County Register of Deeds indicate that Reman PropertiesLLC has been in possession of the property since November 19, 2013. Prior to that the propertywas owned by OM-NC LLC. No further title information was provided to SEI and,consequently, was not reviewed for this ESA. 4.2 Environmental Liens or Activity and Use Limitations No environmental liens or activity or use limitations for the subject property were identified byLonerider Brewing Co. during the course of investigation. 4.3 Specialized Knowledge SEI was provided with no specialized direction by Lonerider Brewing Co. and therefore had nospecialized knowledge of the subject property prior to the site assessment. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 7 - 4.4 Valuation Reduction for Environmental Issues SEI is not aware of any known value reduction being contemplated by Lonerider Brewing Co.for environmental issues. 4.5 Owner, Property Manager, and Occupant Information No written or verbal communication with the property owner revealed any information whichsuggested that there are currently or historically any recognized environmental conditionsassociated with the subject property. Property Owners Property Occupants Reman Properties, LLC.Vacant 4.6 Reason for Performing Phase I This ESA was performed by SEI by request of Lonerider Brewing Co. as part of theirpre-acquisition environmental due diligence for the purchase of the subject property. 5.0 Records Review 5.1 Standard Environmental Records Sources Under contract with SEI, Environmental Data Resources, Inc. (EDR) of Shelton, Connecticutprepared an EDR Radius Map (RM) for the subject property. SEI provided EDR with thelocation of the subject property based on site information provided to SEI by representatives ofLonerider Brewing Co. EDR analyzed federal, state, and tribal government environmental databases and EDRproprietary records for information on sites or facilities with known or expected environmentalconditions within minimum search distances of the subject property, as specified by ASTM E1527-13. A complete copy of the RM is provided in Appendix B. The following Federal databases were searched: CERCLIS, CERCLIS-NFRAP, CONSENT,CORRACTS, DOD, ERNS, FINDS, FTTS, FUDS, NPL-Liens, HMIRS, ICIS, MLTS, MINES,NPL, NPLL-RECOVERY, ODI, PADS, Proposed NPL, Delisted NPL, RAATS, RCRA-TSD,RCRA-LQG, RCRA-SQG, ROD, SSTS, TRIS, TSCA, UMTRA, US BROWNFIELDS, USENG CONTROLS, and US INST CONTROLS. The following State databases were searched: AST, BROWNFIELDS, DRYCLEANERS, IMD,INST CONTROL, LUST, LUST TRUST, NC HSDS, OLI, SHW, State Landfill, UST, andVCP. The following Tribal databases were searched: INDIAN RESERV, INDIAN LUST, andINDIAN UST. The search also included the following EDR Proprietary databases: HistoricalAuto Station, Historical Cleaners, and Manufactured Gas Plants. These Federal, State, Tribal, and EDR proprietary databases are described in Appendix B. It appears that only gas was released as a resultof the leak. The available documentation does not indicate that the releasewould have affected the soil or surface water at the subject property. As anindustrial facility that is involved with the handling and storage of hazardoussubstances, the Townsends facility was required to submit a Risk ManagementPlan. A copy of the RMP was requested by the Town of Pittsboro Departmentof Emergency Management but a copy was not able to be located. The facilty islisted on the EPA's Toxics Release Inventory System due to toxic chemicalsthat were either transported offsite or discharged into the air, water, or land. Sitereconnaissance and records review did not reveal any indication of chemicaldischarges to water or land that would have been associated with the facility. Site Name:Brewer Property, SandraDatabases:LUST, LUST TrustAddress:134 Log Barn RdDistance:0.36 milesDirection:WSWElevation:HigherComments:The files for this property were reviewed at the NCDENR Raleigh RegionalOffice. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 11 - Site Name:Louisiana-Pacific CorporationDatabases:LUST, LAST, UST, IMDAddress:840 Moncure-Pittsboro RdDistance:0.45 milesDirection:ESEElevation:LowerComments:A leaking diesels AST was detected in 1999. Concentrations of TPH thatexceeded soil to groundwater MSCCs were detected. 1,800 tons of impactedsoil were removed. No groundwater contamination was detected. The site alsocontained hydraulic oil reservoirs that they did not appear to be associated withany releases. The release incident related to the AST was closed out in 2001. In1989 a 2,000 gallon gasoline UST and a 500 gallon Diesel UST were removedfrom the site. Soil contamination was detected. No groundwater contaminationwas detected. The incident relating to the two USTs was closed out in 2001,indicating that either the contaminated soil was removed to the satisfaction ofthe governing regulatory agency or that the level of contamination was lowenough that active remediation was not required. Based on the regulatory status,distance to the subject property, topographic position of the site, nature of therelease, and lack of groundwater contamination, the above referencedinformation does not indicate a material threat as defined by the ASTM E1527-13 standard. The PSSS revealed that there are no public water supply wells located near the subjectproperty. 5.3 Physical Setting The PSSS contains a physical setting source map at a scale of approximately 1"=2000' and isprovided in Appendix B. Othersupporting historical documentation was deemed sufficient to identify the possible presence ofRECs. 6.0 Site Reconnaissance 6.1 Methodology and Limiting Conditions The site reconnaissance was conducted on December 10, 2014 by Tomas Will with SEI,accompanied by Austin Cox of Reman Properties, LLC. Weather conditions at the time of thesite reconnaissance were clear and cold. The visual reconnaissance consisted of observing theboundaries of the property and systematically traversing the site to provide an overlapping fieldof view, wherever possible. The periphery of the on-site structure was observed along withinterior accessible common areas, processing, storage and maintenance areas. Photographs ofpertinent site features identified during the site reconnaissance are included in the appendices. 6.2 General Site Setting Based on the information provided by the User, the Site Assessment ("ESA") for a propertylocated along Moncure-Pittsboro Road, Moncure, Chatham County, North Carolina. Theapproximately 20.375 acre subject property consists of one parcel which is divided by MoncurePitssboro Road. The parcel ID number for the subject property as listed in the Chatham Countytax database is 60773. The current deed for the parcel that makes up the subject property arefound in the Chatham County Register of Deeds Book 1721 Page 0346. A Location Map isprovided in Attachment A as Figure 1. The subject property is east of the intersection ofMoncure-Pittsboro Rd. and Farmingdale Ln. Site reconnaissance conducted by SEI personnel did not reveal the presence of hazardoussubstances or petroleum products under conditions that indicate an existing release, past releaseor material threat of a release in connection with past and current uses of the subject propertywith the exception of the following;-A 10,000 gallon diesel UST located near the service garage that was later found to be out ofcompliance, does not have functioning corrosion protection, is of single-walled steelconstruction, and was originally installed in 1961-Several 55 gallon storage drums, some full, some partially full, some empty, are stored on thenorth end of the maintenance building. Some drums were not identifyable due to fadedlabelling. Staining of the floor of the concrete storage area was observed in the vicinity of thedrums. The property is currently developed with a poultry processing facility as well as numerousoutbuildings that support the facility's operations. The interior of the facility was largely empty,with most of the equipment having been previously removed. Turkey Creek runs through thesouthern and eastern sections of the property. Municipal water, sewer, and electricity areavailable to the subject property (See Site Photographs). The buildings located on the subject property consist of the following:-The service garage located in the far northwest of the subject property. This building containsvarious bays and workspaces presumably used to maintain the fleet of trucks as well as forklifts Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 14 - and other equipment that would have been used in relation the facility. A fuel dispenser wasobserved to the immediate east of the service garage. Southeast of the fuel dispenser a concretepad with fill ports for a UST was observed.-The office building located in the far north of the property, east of the service garage. Thisbuilding is believed to have been used as office space to process the logistics of the incomingchicken shipments. A truck scale is located on the south side of this building.-The guardhouse is located in the northwest of the subject property, near the entrance to thesouthern portion of the parcel.-The two pumphouses are located directly west of the guardhouse. These buildings containpump and piping infrastructure associated with the two nearby upright ASTs.-The main poultry processing facility. This facility is made up of a collection of buildings. Thefacility appears to be four stories tall. In addition to large spaces believed to have been used forprocessing the chickens, this building contains offices, break rooms, and changing areas.Several trench drains are located in the areas belived to have been used for poultry processing.Pump systems and engine rooms are located in the interior of the southern portion of thefacility. Very little equipment remained inside the facility. There are two main loadings baysassociated with this facility. On the southern exterior of the facility is an upright AST ofunknown capacity. On the southwestern exterior of the facility a secondary containment areawas observed that was believed to have once contained two ASTs. Staining was observedwithin the secondary containment area. An upright AST containing ammonium gas wasadjacent to the secondary containment area. A concrete pad was observed on the southeasternexterior of the building which is believed to have been the location of an AST containign CO2.A network of pipes is located at the southern exterior of the facility. The network of pipesincludes an orange AST believed to have been used to store ammonia gas. Several markedstorage drums containing deoderants and petroleum products were observed periodically aroundthe exterior of the facility.-To the far southwest of the main facility is the assembly building which is believed to havebeen where the chickens were unloaded from trucks.-At the far south of the property is a barn and shed. These buildings are believed to have beenused for storage. Two large labelled containers were observed inside the barn containing achemical whose use was not able to be identified.-Immediately southwest of the main facility is a storage and office building. This building waslargely empty. A concrete pad was observed to the south of this building which is believed tohave been the site of a former AST or possible UST.-Immediately south of the main facility is a maintenance building. This building is believed tohave been used to perform routine maintenance on the equipment associated with the facility.The remnants of a freight elevator or loading arm was observed on the second story of thisbuilding. Several 55 gallon storage drums, some full, some partially full, some empty, werestored on the north end of the maintenance building on a concrete pad. The drums appeared toall be labelled howver some h were not identifiable due to faded labelling. Staining of the floorof the concrete storage area was observed in the vicinity of the drums. The staining wasconfined to the concrete pad.-To the east of the main facility and across the stream is a building belived to have been usedfor offal processing. There are pipes, pumps, and tumblers located in this building. Two loadingbays are located at the building exterior. The possible location of a former AST is located onthe eastern exterior of the building. As a result of these observations, evidence was found of the presence or likely presence of anyhazardous substance or petroleum products on the property under conditions that indicate anexisting release, a past release, or a material threat of release of any hazardous substance orpetroleum products onto structures on the property or into the ground, groundwater, or surfacewater of the property. Appendix D contains Site Reconnaissance Photographs and Appendix Eincludes a Site Reconnaissance Checklist. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 15 - 7.0 Interviews SEI made reasonable effort to ascertain actual knowledge of items of significance from theUser(s) of this Phase I Environmental Site Assessment. Information provided was verified, tothe extent practicable, as described in the following Subsections of this Section 7.0. Theappropriate level of assessment has been guided by the type of property subject to assessment,the identified expertise and risk tolerance of the User(s) if so identified to the EP, and theinformation developed in the course of assessment of the property and inquiry. The lack ofinformation, if noted, has been considered by the Environmental Professional(s) in thepreparation of this report, and does not materially condition or limit any conclusions or opinionsgiven by the EP in this Section 7.0 or elsewhere unless otherwise specifically stated. 7.1 Interview with Property Owner/Operator The Owner/Operator interview is attached in Appendix H. The Owner identified that a previousPhase I Environmental Site Assessment had been conducted on the subject property but that hewas unable to provide SEI with a copy. The Owner interview revealed that a Notice ofViolation (NOV) had been issued by the UST section of the North Carolina Deptartment ofEnvironment and Natural Resources (NCDENR) due to the tank needing updated registration.The Owner/Operator interview did not reveal the presence of any RECs. The Owner of the property recommended that SEI contact Mr. Bill Baker, a retired engineerwho was involved with designing the facility. Mr. Baker was able to provide SEI with anaccount of how the poultry processing facility functioned as well as where hazardoussubstances and petroleum products were stored. Mr. Baker confirmed the presence of a 10,000gallon diesel UST located near the service garage. Mr. Baker stated the following; the two largeupright ASTs near the entrance to the facility were used to store water, underneath the concretepad located south of the office and storage building which is immediately southwest of the mainfacility is an 80,000 gallon UST used to store water, the secondary containment area locatednear the southeast exterior of the main facility was likely used to store tanks containedhydraulic fluid, the concrete pad located on the eastern exterior of the main facility was used fora CO2 AST, chlorine was stored in carboys at the southeast loading dock for the main facility,and the eastern outbuilding was used to process offal that was generated during the processingof the chicken which was loaded onto trucks then taken offsite. According to Mr. Baker, therewere additional USTs that were once associated with the property that were removed byS&ME. Mr. Baker represented that confirmation soil sampling was performed during theremoval of the tanks to rule out the presence of a release. Mr. Baker was not aware of anyrelease incidents that would have resulted in contamination of the soil or groundwater. 7.2 Interviews with Government Officials SEI contacted Thomas Bender with the Chatham County Fire Department (CCFD) forinformation concerning storage or release of hazardous substances or petroleum products at ornear the subject property. Mr. Hodge indicated that they had a record of a diesel UST but thatthere are no records related to the release of hazardous substances or petroleum products on thesubject property. Based on this information, no concerns were noted for the subject property. SEI also contacted the Pittsboro Department of Emergenecy Management (PDEM). A copy ofthe Risk Management Plan was requested from PDEM but copies of the plan could not belocated. However, PDEM was able to provide an inventory of the various chemicals stored onthe property which has been included in Appendix H. The PDEM did not have any records thatwould indicate the release of hazardous substances or petroleum products on the subjectproperty. Based on this information, no concerns were noted for the subject property. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 16 - SEI also contacted Clark Wipfield with NCDENR-UST branch. Mr. Wipfield is the projectmanager for corrective actions in Chatham County. Mr. Wipfield did not have any records forthe facility other than an NOV that had been issued in relation to the 10,000 gallon diesel USTon the property. Mr. Wipfield was not able to identify any records that indicated any registeredtanks on the property. SEI also contacted Rose Pruitt with NCDENR-UST branch. Ms. Pruitt is an inspector with thePermits and Inspections division of the UST section. Ms. Pruitt provided SEI with a copy of theNOV for the diesel UST issued Octover 6, 2014 as well as the most recent inspection reportfrom February 26, 2014 (see Appendix H). The inspection records indicate that the tank is ofsingle wall steel construction, the piping in fiberglass, originally installed in 1961, and wasempty on the day of inspection. The NOV was issued because the corrosion prevention systemfor the tank is nonfunctional and because the tank is improperly registered. Based on thisinformation, the 10,000 gallon diesel UST was identified as an REC due to their being amaterial threat of past release. 7.3 Interviews with User An User Interview was not performed as part of this assessment. Based on the informationobtained from other sources, an User Interview was not expected to reveal relevant informationabout the property that could not be ascertained through standard record review. 8.0 Findings 8.1 Hazardous Substances in Connection with Identified Uses SEI found evidence of anhydrous ammonia, diesel, caustic soda, hydraulic fluid, chlorine, andvarious other hazardous substances during the inspection of the Subject Property. Several smallcontainers of solvents, oils, and various cleaners were observed in various areas dedeicated tomaintenance. These materials appeared to be properly stored. The anyhydrous ammonia wascontained in ASTs located near the southern exterior of the main facility and piping systemsused to transport both liquid and gaseous anyhdrous ammonia were observed throughout themain facility. No indications of a release were observed in connection with the anhydrousammonia tanks and piping. A fuel dispenser and UST believed to contain diesel were observednear the exterior of the service garage. The tank is believed to have a capacity of 10,000gallons, is of single walled steel construction, and was installed in 1961. No staining ordistressed soils were observed in connection with the UST or dispenser. Concrete staining wasobserved within the secondary containment area observed near the southeastern exterior of themain facility. An interview with one of the engineers who designed the facility indicates thathydraulic fluid was stored in this area. While the secondary containment area was observed tocontain cracks, SEI did not observe evidence that would indicate that the contents of whateverwas stored in this area seeped through the pad or through the containment walls. Two largelabelled containers were observed inside the barn containing a chemical whose use was not ableto be identified. No indications of a release were observed in connection with these containers.Several 55 gallon storage drums, some full, some partially full, some empty, were observed onthe north end of the maintenance building on a concrete pad. The labels on the drums identifiedvarious types of oil, hydraulic fluid, and polymers. The drums appeared to all be labelledhowever some were not identifiable due to faded labelling. Staining of the floor of the concretestorage area was observed in the vicinity of the drums. The staining was confined to theconcrete pad (see Site Photos). Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 17 - 8.2 Hazardous and/or Unidentified Substance Containers and Storage Tanks Some of the storage drums observed on the northern exterior of the maintenance building didnot have labels that were legible. As a result of the unknown contents of thesedrums and the observed staining, an REC has been identified. 8.3 Indications of PCBs No indications of polychlorinated biphenyls (PCB) that would result in an enforcement action ifbrought to the attention of the appropriate government agencies were identified in thisassessment. 8.4 Indications of Solid Waste Disposal No indications of Solid Waste Disposal that would likely result in an enforcement action ifbrought to the attention of the appropriate government agencies were identified in thisassessment. SEI did observe the remains of a discarded 55 gallon storage drum in the woodsnear the stream south of the main facility. 8.5 Hazardous Substances on Adjacent Properties No indications of Hazardous Substances on Adjacent Properties that would likely result in anenforcement action if brought to the attention of the appropriate government agencies wereidentified in this assessment. 8.6 Vapor Intrusion Conditions (VIC) Based on records review and site reconnaissance, no vapor intrusion conditions were identifiedon the subject property. 8.7 Potential Vapor Intrusion Conditions (pVIC) In accordance with the ASTM E2600-10 standard, a non-invasive Tier-1 assessment of pVICswas performed for the subject property to identify potential Vapor Intrusion Conditions. TheTier-1 assessment involves a search distance test that evaluates the proximity of the planned orexisting structures on the subject property to the nearest known edge of contamination (100 feetfor volatile contaminants other than dissolved petroleum hydrocarbon chemicals and 30 feet forpetroleum chemicals). This Tier-1 pVIC assessment did not reveal any chemicals of concern orcontamination under conditions that indicate a release within the search radius. Therefore apVIC can be ruled out. Should contamination be discovered on the subject property, theseconditions would need to be reassessed. 8.8 Vapor Encroachment Conditions (VEC) As directed in the ASTM E2600-10 standard, "Standard Guide for Vapor EncroachmentScreening on Property Involved in Real Estate Transactions", a vapor encroachment screen wasperformed to identify VECs for the subject property. A Tier 1 vapor encroachment screen is thereview of state and federal database records to identify those sites within the 1/10 mile, with thepotential to affect subsurface vapor conditions at the subject property. The review of thesedatabases did not reveal any release of any chemicals of concern within the search radius.Therefore a VEC can be ruled out. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 18 - 8.9 Recognized Environmental Conditions (REC) Based on records review and site reconnaissance, the following Recognized EnvironmentalConditions were identified on the subject property:-A 10,000 gallon diesel UST is located southeast of the service garage. According to the latestinspection performed in February 2014, the tank appears to be empty. The tank was wasoriginally installed in 1961, is of single walled steel construction, and does not currently have afunctioning corrosion prevention system. An NOV has been issued due to the failure tomaintain the corrosion prevention system and for having improper registration. Due to the ageof the tank, type of construction, and nonfunctional corrosion prevention system, this tank isidentified as posing a material threat of release and is therefore considered an REC.-Several 55 gallon storage drums, some full, some partially full, some empty, were observed onthe northern exterior of the maintenance building on a concrete pad. The labels on the drumsidentified various types of oil, hydraulic fluid, and polymers. Some of the storage drumsobserved on the northern exterior of the maintenance building did not have labels that werelegible. Furthermore, some of the drums appeared to only be partially full. As a result, SEI wasnot able to reasonably identify the contents of these drums. Staining of the floor of the concretestorage area was observed in the vicinity of the drums. Phase I Environmental Site Assessment Report 270 Moncure-Pittsboro Road Phase I ESA Moncure, Chatham County, NC December 19, 2014 - 19 - 9.0 Opinions SEI has prepared this Phase I ESA on the subject property totaling approximately 27.375 acreslocated in Chatham County, NC in conformance with the scope and limitations of ASTM E1527-13. Exceptions to, or deletions from, this practice are described in Section 2; deviationsare described in Section 11. There are no mapped or unmapped sites located within the minimum search distances of thesubject property as defined by ASTM Standard E1527-13 in the above referenced databases thathad a likely potential for impact to the subject property based on the review of availableinformation. Based on the absence of any information concerning the release of hazardoussubstances or petroleum products under conditions that create an environmental concern, thereis no indication of a material threat from nearby properties as defined by the ASTM StandardE1527-13. Site reconaissance and interviews with regulatory officials has led to the identification ofseveral environmental concerns with relation to the subject property, including, theidentification of two RECs. As a result SEI recommends the following actions: -Removal or closure in place of the 10,000 gallon diesel UST located near the service garage inaccordance with the UST guidelines set by NCDENR-Take confirmation samples of the soil in the immediate vicinity of the tank to rule out a releasefrom the tank.-Conduct a soil boring underneath the secondary containment area near the southeasternexterior of the main facility where staining was observed and hydraulic fluid is believed to havebeen stored to rule out impacts to the soil.-Characterize the contents of the 55 gallon storage drums which are partially full or that can notbe identified with labels and properly dispose of them.-Conduct a soil boring underneath the concrete pad on the northern exterior of the maintenancebuilding where the 55 gallon drums are stored and where staining was observed to rule outimpacts to the soil.-Properly dispose of all storage containers including those which may contain hazardoussubstances or petroleum products.-Obtain and review a copy of the previous Phase I for the subject property-Obtain and review reports from S&ME that document the location of USTs that were removedfrom the property, what their contents were, and what the analytical results of the soil samplingwas. 10.0 Conclusions Records review and site reconnaissance indicated two incidents causing potential soil and/orgroundwater contamination by hazardous substances or petroleum products were identified onthe subject property. Nearby properties within the minimum search radius with documentedrelease incidents were determined to not constitute a material threat based on the availabledocumentation. As a result of these observations and the findings of this assessment, evidencesuggests the presence or likely presence of any hazardous substance or petroleum products onthe property under conditions that indicate an existing release, a past release, or a material threatof release of any hazardous substance or petroleum products onto structures on the property orinto the ground, groundwater, or surface water of the property.
