Dear Mr. Roberts:
This letter is to document compliance with Land Use Restriction (“LUR”) Number 4 in the Notice of
Brownfields Property (“Notice”). The Notice was recorded on January 20, 2015 at the Mecklenburg Register
of Deeds in Book 30545, Page 864 by Old Pineville Investments, LLC. LUR Number 4 states the following:
4. The Prospective Developer shall conduct pre-occupancy indoor air sampling in the location of the previous soil vapor sample SSVP-3 as depicted on the plat component of this Notice, for a minimum of one additional sampling event following execution of this Agreement, unless that portion of the building is
demolished. A sampling plan shall be submitted to DEQ for review and approval prior to the initial sampling event. The Prospective Developer shall submit the results of each sampling event with each Land Use Restriction update as described in paragraph 10 below. Upon receipt of data, DEQ will review data to
determine if additional measures or monitoring is deemed necessary.
In September 2016, the North Carolina Brownfields Program received and approved a work plan for the
sampling event. On November 16, 2016, NCBP received and reviewed the Pre-Occupancy Indoor Air
Sampling Report prepared by Hart & Hickman. Based on that report, no additional measures or monitoring
are required for occupancy.
Please continue to submit the annual LUR Update certifications to remain compliant with the recorded
