Currently the property is developed with three large warehouse structures, one office building, one smaller office building, one maintenance shop building, two temporary office/storage structures, and two outdoor canopy structures. Parcels A, B, and C of the subject site are primarily used by Waste Management to sort and process recycling of glass, plastics, and cardboard for transport off- site. Pratt Industries conducts maintenance and service of Waste Management’s fleet of dump trucks in the maintenance building located on Parcel D. The first floor of the larger office building located on Parcel D is occupied by Waste Management and the 2nd floor is vacant. The smaller office building on Parcel D is currently occupied by Peden Family, LLC. Parcel E is used as a staging area and temporary tractor trailer storage by Rooms to Go. The operations conducted at the property include waste recycling and automotive service and repair (this includes storage of petroleum and automotive fluids, parts cleaners, and active vehicle maintenance operations)                 Suspected contaminants at the site include chlorinated solvents and metals in soil and groundwater.  Only a Phase 1 has been completed at the property.                  The proposed use of the property is to reposition the 2 existing warehouses for office, retail, and restaurant space.  Additional retail is planned for other portions of the site along with approx. 300 apartments and structured and open parking. The estimated capital investment is $110,000,000.  The construction of the proposed structures will create an expected 250 jobs and up to 500 permanent jobs.   We are now evaluating Plan of Steel, LLC , and the subject property for eligibility for entry into the Brownfields Program.  Under the Brownfields Property Reuse Act, only entities that did not cause or contribute to the contamination at the property are eligible to enter the program.  The applicant PD listed below have asserted that:  1.) they have not caused or contributed to the contamination at the property, and 2.) they have substantially complied with laws, regulations, and rules for the protection of the environment.  If you have any information to suggest otherwise, please provide that information to me at geof.little@ncdenr.gov and 919-707-8252 by November 4, 2016. In fact, the BFA will require the developer to provide access to the property to any party doing work under any DEQ program. A BFA provides liability protection only to a non-causative redeveloper of the property. The developer will be required to make the property safe for its intended re-use. Cleanup to unrestricted use standards will not be required unless deemed necessary based on the developer's proposed use of the property. Furthermore, the BFA will not change the developer's responsibility to obtain any and all DEQ permits (e.g. storm water, sediment control, NPDES, etc.) as required under applicable law.
