Basements were not observed on the property. However, LUR 5 requires basements to be vented. No monitoring wells observed. Additionally, no signage posted at the property regarding lake/pond water use restrictions. Exposed soils were not observed on the property. A letter Notice of Noncomliance was issued to the Town of Clayton on March 7, 2016, for failure to submit a LURU. Additionally, current deed was recorded approx. 27 days after NBP and is not compliant with LUR 11 regarding specific language required to be added to instrument conveying interest in the property. E.I. Du Pont de Nemours and Company did not include said statements in deed. Additional notification will be sent to the Town of Clayton regarding this deficiency. No signage was apparent at the property regarding the use of the pond/lake. BF staff are currently working with the owner's consultant (AECOM) in fulling paragraph 13 & 15 before full redevelopment of the property commences. Access into the property is limited with only one dirt road/path entry near the intersection of Covered Bridge Rd. and Loop Rd. Access to the southeastern portions are from adjacent private property.
