Knox on behalf of the Town of Pilot Mountain, herein referred to as the Client, to identify, to the extent feasible, recognized environmental conditions (RECs) in connection with the subject property. 1.2 Scope-of-Services Withers & Ravenel (W&R) has performed a Phase I ESA for the ±8.29-acre site located approximately 1,000 feet west of the intersection between East Main Street and Old US Highway 52 Bypass in Pilot Mountain, Surry County, North Carolina (Figure 1). The subject site consists of one parcel that totals approximately ±8.29-acres. According to Surry County GIS and Tax information, the subject property consists of one property addressed as 612 East Main Street and is currently owned by Caro Associates, LLC. The Surry County parcel ID number for this site is 5976-17-11-1019. W&R performed a visual inspection of the subject property on January 22nd & 23rd, 2009. Photographs taken document features and materials observed during site reconnaissance activities, where possible. A photographic essay has been included in the Appendix. W&R understands that a Phase I ESA has been authorized for a potential real estate transaction. W&R also understands that the site will be redeveloped for use as a community college with continued use of municipal water and sewer services. The Phase I ESA performed by Withers & Ravenel included a site inspection, historical research, municipal research, and a database search for the above-referenced site. The Phase I ESA was completed in general accordance with the guidelines set forth in Standards and Practices for All Appropriate Inquiries (Title 40 of the Code of Federal Register (CFR), Part 312); Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (American Society for Testing and Materials (ASTM) Standard E-1527- 05); and Withers & Ravenel’s Standard Contract Conditions for Engineering Services. Withers & Ravenel has used the guidelines to serve as a baseline for customary standards of environmental site assessments and to create a high quality, standardized environmental assessment report. Non-Scope Considerations This report represents Withers & Ravenel’s efforts to document the recognized environmental conditions on the site and surrounding area that may adversely impact the subject site. However, ASTM E 1527-05 establish environmental issues or conditions at a property that the Client may wish to assess in connection with the subject property that are outside the scope of this practice (non-scope considerations). The standards state that some substances may be present on a property in quantities and under conditions that may lead to contamination of the property or nearby properties but are not included in CERCLA’s definition of hazardous substances or do not present potential CERCLA liability. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 2 Assessment of such non-scope considerations is not required for appropriate inquiry as defined by this practice. Therefore, the Phase I investigation does not include inspection for items excluded by the ASTM E 1527-05 standards such as asbestos-containing materials, radon, copper or lead in drinking water, wetlands, regulatory compliance, cultural and historic resources, industrial hygiene, health and safety, ecological resources, endangered species, high-voltage power lines, mold, indoor air quality, and lead-based paint. Vapor intrusion is also a non-scope consideration. The ASTM E1527-05 Phase I scope of services excludes vapor intrusion under the indoor air quality exclusion found in Section 13.1.5.12. No implication is intended as to the relative importance of inquiry into such non-scope considerations, and this list is not intended to be all-inclusive. All conclusions made in this report are based upon the assessment performed by Withers & Ravenel and are subject to the service constraints presented below. 1.3 Limitations and Exceptions This report presents the findings of Withers & Ravenel's assessment of existing and past environmental conditions at the site. Appropriate inquiry of information was utilized for this Phase I Site Assessment and included: • A site reconnaissance, • A historical source review that included aerial photographs, recorded land title records, and available fire insurance maps, • A Federal and State records review through EDR, Inc., and • Interviews with the current property owner, the property manager, a former employee of the Amos & Smith Hosiery Company, and an adjacent property owner. Appropriate inquiry does not mean an exhaustive assessment of the property. W&R did not enter either of the residential structures located on the subject property or the storage shed/barns located behind each of the residential structures. W&R could not view the elevator shaft and hydraulic room for the freight elevator located in the hosiery building. W&R did not have access to a janitor’s closet located on the eastern end of the hosiery building or a storage room located in the basement of the building. Visibility was also obstructed throughout portions the flea market area as some booths were blocked off with locked curtains. All other areas of the site were accessible at the time of our site reconnaissance. This environmental site assessment cannot entirely eliminate uncertainty regarding the potential for RECs in connection with the property. Performance of a Phase I ESA in accordance with ASTM E-1527-05 is intended to reduce, but not eliminate, uncertainty regarding the potential for RECs in connection with a property based on information obtained within reasonable limits of time and cost. If conditions at the site change or additional information becomes available which would materially affect the nature of the report, we request that we be contacted so that any change in conditions can be properly reviewed and our report amended accordingly. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 3 1.4 Special Terms and Conditions Site information and materials were obtained by W&R through review of public files. The resulting report is provided for sole use by the Town of Pilot Mountain and their lender to provide financing on the project for which it was prepared. Use of this report by any third parties is at the sole risk of Town of Pilot Mountain and their lender and W&R disclaims any such third party use of the report. Draft/Preliminary Findings: If the report is stamped “DRAFT” or is identified as preliminary, the following constraints apply: The Draft Report was prepared by Withers & Ravenel at the specific request of a client. The information and findings provided in the Draft Report are not Withers & Ravenel’s final conclusions and recommendations, but merely basic information requested by the client upon which the client may draw its own conclusions. Client agrees that Withers & Ravenel shall not be liable for any claims, loss, damage, or expenses incurred by the Client or others arising out of the use of, or reliance on, any information contained with the Draft Report. Report Purpose: The purpose of this report is as described in the Introduction of this report. The scope and level of services provided were determined based on the stated purpose. If the purpose for which the report is to be used, or the proposed use of the site changes, this report is no longer valid and use of this report by the Client or others without Withers & Ravenel’s review and written authorization shall be at the user’s sole risk. If review of this report is required by Withers & Ravenel after its date of submission, Withers & Ravenel shall be entitled to additional compensation at Withers & Ravenel’s existing rates or such terms as agreed to between Withers & Ravenel and the Client. Scope of Services: Observations and conclusions provided in this report are based solely on the Scope of Services between the Client and Withers & Ravenel and summarized in the Introduction of this report. No additional observations, investigations, studies, or testing not specifically stated in the Scope of Services have been performed by Withers & Ravenel. Withers & Ravenel shall not be liable for the existence of any condition, the discovery of which required the performance of services not authorized under the agreement. Unless specified in the Introduction of this report, Withers & Ravenel did not evaluate the presence of asbestos-containing materials, radon, copper or lead in drinking water, wetlands, regulatory compliance, cultural and historic resources, industrial hygiene, health and safety, ecological resources, endangered species, high-voltage power lines, mold, indoor air quality, and lead-based paint. Time: Technology, economic conditions, site variations, or regulatory provisions may change over time and render the report inaccurate. If review of this report is required by Withers & Ravenel after three months from its date of submission, Withers & Ravenel shall be entitled to additional compensation at Withers & Ravenel’s existing rates or such terms as agreed to between Withers & Ravenel and the Client. Conclusions: The conclusions stated in this report are based upon observations of existing physical and/or economic conditions; Withers & Ravenel’s interpretation of site history and site usage information; information provided by the Client; and information and/or analyses provided by independent testing and information services or laboratories upon which ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 4 Withers & Ravenel is entitled to reasonably rely. Withers & Ravenel is not authorized and did not attempt to independently verify the accuracy or completeness of information or materials received from third parties during the performance of the Scope of Services associated with this report. Withers & Ravenel shall not be liable for any conditions, information, or conclusion, the discovery of which required information not available or independent investigation of information provided to Withers & Ravenel, unless otherwise indicated. Any site drawing(s) provided within this report is not meant to be an accurate base plan, but is used to present the general, relative locations of features on, and surrounding, the site. 1.5 Reliance This report has been prepared exclusively for the Client. Except for the Town of Pilot Mountain and their lender, no other party is entitled to rely on the conclusions, observations, specifications, or data contained therein without the express written consent of W&R. This report has been prepared pursuant an agreement between the Client and W&R. All uses of and reliance upon this report are subject to, and deemed acceptance of, the conditions and restrictions contained herein. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 5 2 Site Description 2.1 Location and Legal Description Description provided in Section 1.2 of this report. 2.2 Site and Vicinity Characteristics The subject property is located in an area primarily consisting of residential and commercial/industrial development. Four driveways originating at Main Street provides access to the site from the north. The subject property is currently being utilized for residential and commercial purposes. The subject property consists of a large building formerly used for textile operations, which now contains Head Hunters Beauty Salon, Upper Crust Crumbs Dessert Co., a flea market and auction space, a former dance studio and warehouse storage space. A small vacant structure previously utilized as a boiler room was located south of the commercial building and two residential structures were located on the western portion of the site, each with an adjacent storage building/barn. These structures are discussed in more detail in Section 2.3. The remaining portions of the site consisted of paved parking areas, manicured lawns, and undeveloped woodlands. Utilities observed onsite are discussed in Section 5.5. A chain link fence was observed around the perimeter of the hosiery building parking lot, separating the manufacturing facility from the wooded areas on the southern portion of the property as well as the residential structures located on the eastern portion of the site and the residential structure located on the western adjacent property. A large water tower was observed in a clearing within the wooded area south of the hosiery building. An unimproved path was observed extending east from the water tower to Hamlin Drive and appears to provide access to the tower for maintenance purposes. W&R observed a minor amount of miscellaneous nuisance debris on various portions of the subject property. Debris observed primarily consisted of household type debris such as drink containers and food wrappers and was located primarily in the wooded areas of the site. Two, more formalized, debris areas were also noted on the subject property during site reconnaissance (Figure 2). One debris area was observed south of the boiler room structure. Debris in this area consisted of structural type debris such as bricks and cinder blocks, scrap metal, bottles, cans, stray metal, an uncapped rusted 55-gallon drum, textile manufacturing material, etc. For the purposes of this report, “scrap metal” is a generic term used to describe miscellaneous metallic items typical of household items, manufacturing machinery, etc. The second debris area was observed behind one of the residential structures and consisted of household materials such as drink cans, food containers, plastic materials, and other residential household materials. No obvious odors or staining, typical of petroleum or chemicals, was observed in these areas. It should be noted that at the time of W&R’s site visit, the areas around most of the debris observed on site were heavily covered with undergrowth, fallen canopy (leaves, twigs, etc.), and enriched soil. This ground cover made it difficult to observe the entire area, observe minor staining (due to the decomposition of the canopy), and note any minor odors in the soil. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 6 SITE FEATURES During W&R’s site inspection no water supply wells, pits, ponds, or lagoons were observed on the subject property. A groundwater monitoring well was observed on the northern portion of the site in front of the hosiery building. According to a well tag located inside the monitoring well, this well was installed in 1990. According to Mr. Billy Pell the groundwater monitoring well would have been on the subject property prior to being purchased by Caro Associates, LLC. Mr. Pell stated that he was unaware what the monitoring well had been used for in the past and stated it was likely associated with a former gas station located on the corner of Main Street and Old Highway 52 Bypass. Mr. Pell stated that there had been a leak associated with the underground storage tanks at the gas station in the early 1990’s and that monitoring wells had been installed in the nearby vicinity. W&R was unable to locate any information from the state in regards to a Leaking Underground Storage Tank (LUST) incident at the site identified by Mr. Pell. However, this site was listed as a UST site in the EDR report and the potential exists that a spill or leak incident could have occurred at this site. The Dayton Tire/Exxon gas station is located across Main Street from the location of the well. However, no obvious monitoring wells were noted on this property and no LUST incident was found in the database report. W&R was provided information from the Town of Pilot Mountain (client) regarding this well (See Section 3). A file review of archived files placed on a compact disk and provided by the NCDENR-Division of Waste Management – UST Section in Raleigh, North Carolina revealed the aforementioned monitoring well along with two additional monitoring wells, one located adjacent to the southwest corner of the hosiery building and one located east of the boiler room building, associated with a reconnaissance investigation performed on the subject property in November of 1990. See Section 4.1.6 for more information. According to Mr. Pell, the water tower on site was connected to the town water supply and did not use groundwater. This tower was most likely utilized for emergency water in case of fires. Please see Section 4.2 for site elevation, possible site surface and groundwater flow, storm water flow, topographic information, and off-site sources information. 2.3 Description of Structures At the time of W&R’s site reconnaissance, the subject property contained six structures consisting of two residential structures each with a detached storage building/barn, a boiler room structure, and a large hosiery facility currently in use as a multi-tenant commercial building. W&R was able to view the interior of the hosiery building and boiler room structure; however, W&R did not enter the residential structures or their respective storage buildings/barns. A detailed description of the building’s construction, mechanical/ electrical/plumbing systems, pavement condition, etc. should be provided in reports completed by other professionals. Former Hosiery Building The former hosiery building is an approximate 70,000 square foot single story brick building. The oldest part of the building was constructed in 1938 with later additions constructed during the 1940’s. The building has been primarily used as a textile ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 7 manufacturing plant for the manufacture of women’s hosiery and men’s socks. The building has since been updated with the removal of the textile manufacturing equipment, the placement of additional walls, the floors refinished, and gas pack heating installed in some sections of the building. The building now provides commercial space for the local flea market, an auction house, Head Hunters Beauty Salon, Upper Crust Crumbs Dessert Co., and warehouse storage space for a local rope manufacturer. Refer to Figure 3 for the current floor plan layout and information provided by the property manager and Caro Associates, LLC. Refer to Figure 4 for a former floor plan layout acquired from publicly available information at the NCDENR – Raleigh Regional Office. W&R discussed the history of the property with the current property manager (see Section 6.2) and a former employee of the Amos & Smith Hosiery Company (see Section 6.3). This resulted in the discovery that the western portion of the building currently being used as a bakery by Upper Crust Crumbs Dessert Co. and for warehouse storage previously functioned as a dye house. This area had trench-style floor drains that ran along the eastern sides of the bakery room that were now filled with concrete by Caro Associates, LLC so they could better utilize the floor space in this area. Additional elongated concrete areas were also noted within the warehouse space and may possibly be additional trench drains. A concrete patch adjacent a municipal sewer manhole cover was also observed in this area. Mr. Pell, the current property manager, stated that the concrete patch near the manhole may cover a former filter system that had been used to screen wastewater for lint before it entered the municipal sewer system. He explained that the excess lint was probably periodically removed, placed in a drum, and hauled off to the local landfill. Mr. Pell stated that the trench drains likely connected to this area and then proceeded to the sanitary sewer system. Additional floor drains were also noted by W&R throughout the remaining portions of the building, primarily located in the restrooms or locations formerly used as restrooms. However, several floor drains were noted in the central portion of the building which is now occupied by the local flea market and the western portion of the building, which is currently vacant (See Figure 3). Additional small rectangular concrete patches were also observed in the flea market area; however, these patches were in a uniform pattern and appeared that they may have been used to anchor textile machinery to the ground. Mr. Pell was unsure what these concrete patches may have been in the past and W&R could not rule out the possibility that these patches may be additional trench drains or another style floor drain used during the textile manufacturing process. The eastern most section of the hosiery building was vacant. According to Mr. Pell this area had also been used for knitting and storage in the past. The northern portion of this area contained bathrooms and several storage closets with steps leading to a loft area that appeared to have been used for storage. One of the closets, labeled as a janitor’s closet, was locked at the time of W&R’s site reconnaissance. According to Mr. Pell the closet is not in use and to the best of his knowledge the closet is empty. W&R observed a square concrete basin on the southern wall of this vacant area. Several floor drains were observed adjacent to this area as well as possible trenching in the concrete that had been filled with brick. According to Mr. Cleve Harris, the current owner, this was the location of a water filtration system to remove lint from the air inside the hosiery building. Mr. Harris stated that this end of the building primarily housed knitting operations and that he was unaware if any chemicals would have been stored in this location. W&R observed a “Danger: Chemical Storage” sign on the exterior wall adjacent to a large door that enters the ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 8 warehouse signifying that chemicals were most likely stored in this area of the hosiery building in the past. A freight elevator was located toward the back of the hosiery building in the area that is currently being used as an auction house. The freight elevator provided an access to a basement area that is below this portion of the building. The freight elevator is no longer in use and W&R was unable to view the shaft area or the hydraulic room for the elevator at the time of site reconnaissance. The basement area of the hosiery building consisted of several rooms. According to Mr. Pell the basement had been used as a maintenance and repair area for hosiery machinery. Currently the basement is primarily vacant except for a large room that is being used for storage. This area of the basement was locked at the time of W&R’s site visit. According to Mr. Pell this area contains household items such as furniture that belongs to Mr. Harris, the current owner of the building. The basement also provided an access to the original boiler room. At the time of W&R’s site reconnaissance the boiler room was vacant. W&R observed several old rusted electrical boxes on one of the walls and a flight of stairs leading up to the main floor of the hosiery building. No obvious signs of staining or odors typical of petroleum products were observed in the boiler room; however, the floor was heavily covered in broken concrete and debris making visibility difficult at the time of W&R’s site reconnaissance. Boiler Room Building The detached boiler room structure, located south of the hosiery building towards the southwest corner, was an aluminum building with two large garage doors and a concrete floor. A large concrete and cinder block containment area was located off the eastern side of the building that formerly housed a large above ground storage tank (AST). A large circular concrete platform was observed within the containment basin. Mr. Harris stated that the AST that was approximately 7,500 to 10,000 gallons in size and was removed from the property around the time that he acquired it in 2002. W&R observed aboveground fuel lines running from the containment basin into the boiler room building. The interior of the boiler room building was primarily vacant. The fuel lines entering the building from the containment area stopped in the area where the boiler had likely been located. Staining and odors typical of petroleum products were noted on the wall of the building in this area as well as on the fuel lines and concrete floor. Three 55-gallon drums were also observed inside the boiler room building and are discussed in more detail in Section 5.6. Residences One residential structure, a single story house with wood siding and an asphalt roof, was located on the northeastern corner of the subject property and was addressed as 628 Main Street. Two 250-gallon ASTs were observed on the western side of the house and are discussed in more detail in Section 5.6. W&R was not granted access to the interior of the residence during site reconnaissance. A wooden storage shelter/barn with a tin roof was located off the southeast corner of the residence. The storage shelter/barn appeared to currently be used for storage for ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 9 household and lawn care items. The storage shelter/barn was locked at the time of W&R’s site reconnaissance; therefore, W&R was unable to observe the interior of this structure. Several old tires, a rusted 55-gallon drum used for trash, excess lumber, flower pots, and a wheel barrel was observed on the western and southern sides of the storage building. Two ramps/lifts typically used for automotive maintenance such as oil changes were also observed in close proximity to the storage shed/barn. No signs of staining or odors typical of petroleum or chemicals were observed in this area. The second residential structure was a two story house with wood siding and an asphalt roof addressed as 624 Main Street. W&R was not granted access to the interior of this residence during site reconnaissance. W&R was able to speak with a gentleman at the house who stated that he was the tenant. The tenant informed W&R that the house was currently heated by wood and portable kerosene heaters. The tenant also stated that the house had likely been heated with fuel oil from an AST in the past. A small aluminum storage building/barn was located directly behind this residential structure. W&R was not granted access to the interior of the structure but was told by the tenant of the house that the building was used for storage of household items such as excess furniture. 2.4 Current Uses of the Property At the time of W&R’s site visit the subject property was used for residential and commercial purposes. 2.5 Current Uses of Adjoining Properties The subject property is located in a moderately populated industrial/commercial and residential area of Pilot Mountain, Surry County, North Carolina. The subject property is bordered to the east and west by residential structures; to the south by railroad tracks and the Hamilton Casting Corporation; and to the north by Carson’s Automotive and Muffler Shop, Sanders McHone Farm Service, and Dayton Tires and Exxon gas station. Repairs are taking place at the Dayton Tires and Exxon, which is located directly north of the former Hosiery building and groundwater monitoring well. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 10 3 User-Provided Information The following information was provided to W&R during completion of this report. 3.1 Title Records No title records were provided to W&R with regards to the subject property. 3.2 Environmental Liens Mr. Blair Knox (Manager for client) answered that he was not aware of any environmental cleanup liens or activity or land-use limitations (AULs) filed or in place for the subject property. A copy of Mr. Knox’s questionnaire completed is included in the Appendix. As of the date of this report, the environmental liens and AULs search was not completed by a professional title company or title professional and returned to W&R. However, W&R observed no liens on file in the brief review of available deeds at the Surry County offices. W&R feels that this information should be completed along with title work for the property as typically coordinated by the real estate attorney. If any environmental liens and AULs against the property are discovered, this information should be provided to W&R prior to any transfer of this property so that we may make a proper review and issue an amended letter accordingly. If no environmental liens or AULs are discovered, the letter titled “Title and Judicial Records Review for Environmental Liens and Activity and Use Limitations” provided by W&R should be filled out completely and placed inside the cover to accompany this report as an attachment. 3.3 Historical Reports No historical reports were provided to W&R in relation to the subject property. Mr. Cleve Harris of Caro Associates, LLC (current property owner) indicated that a Phase I ESA had been completed on the subject property approximately 10 years prior; however, a copy of the report could not be located. Mr. Blair Knox (Manager for client) indicated that he was not aware of any historical Phase I ESA reports existing for the subject property. W&R was provided with a letter from the Groundwater Supervisor of the Division of Water Quality – Groundwater Section discussing the underground storage tank closure at the Amos & Smith Hosiery Mill from the Town of Pilot Mountain (client). From this letter W&R was able to complete file and incident reviews of the site regarding past incidents. See Section 4.1.6 for more information. 3.4 User Questionnaire W&R provided a questionnaire to Mr. Blair W. Knox (Manager for client) to ascertain his knowledge of the history of the subject property. Mr. Knox stated in the questionnaire that the subject property had been used as a hosiery mill in the past. W&R did not gain any additional information based on Mr. Knox’s answers. A copy of this questionnaire is included in the Appendix. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 11 3.5 Relationship between Purchase Price and Fair Market Value Mr. Blair W. Knox (Manager for client) stated in the questionnaire that the purchase price of the subject property reasonably reflects the fair market value of the property. No differential in price or fair market value has resulted from petroleum or hazardous substance related environmental conditions. A copy of the questionnaire completed by Mr. Knox is included in the Appendix. 3.6 Owner Questionnaire W&R provided a questionnaire to Mr. Cleve Harris of Caro Associates, LLC regarding any commonly known or specialized knowledge of past activities at the subject property. Mr. Harris stated that Caro Associates, LLC have owned the property for six years. Mr. Harris stated that the property had been used in the past as a knitting mill, sock mill, and for multi-use retail. Mr. Harris stated that an AST was formerly located on the subject property to store fuel oil for the boiler but it has been removed. W&R did not gain any additional information based on Mr. Harris’ answers. A copy of this questionnaire is included in the Appendix. An interview was also completed with Mr. Cleve Harris and can be viewed in Section 6.1. 3.7 Site Plans Mr. Billy Pell provided W&R with a floor plan of the existing building. This map has been included in our report as Figure 3. No other site plans were provided to Withers & Ravenel. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 12 4 Records Review 4.1 Municipal Research 4.1.1 Local, State and Federal Environmental Regulatory Authorities and Databases Through Environmental Data Resources, Inc. (EDR), an environmental database search firm, W&R reviewed files and databases of the North Carolina Department of Environment and Natural Resources (NCDENR) and the United States Environmental Protection Agency (EPA) to determine if either agency has been involved in any regulatory activities at or in the vicinity of the site. Facilities that treat, store, generate, transport, or dispose of hazardous substances or petroleum products and any incidents of leaks, spills and dumping of hazardous substances or petroleum products may be found in one or more government listings. A portion of the EDR report contains a section titled "Orphan Summary" whereby sites with registered USTs, leaking USTs, landfills, environmental violations, etc. that have not been properly mapped by EDR are listed. During completion of the Phase I ESA, W&R observed the subject property and immediately adjacent properties. The sites listed in the Orphan Summary did not appear to reference the subject property or adjacent properties. One listing was recognized for a property in the surrounding area. “Smoking D’s”, listed as a Leaking Underground Storage Tank (LUST) site, was determined during site reconnaissance to be located approximately 500 feet northeast of the site. According to the EDR Report soil contamination was reported during the UST closure at the site in 2001. Based on the distance of the property from the subject site and topographic situation, W&R does not consider this site to be a REC to the subject property and should not interfere with the continued operation of the property with municipal water and sewer services. General information about this LUST site can be found in the EDR Report located in the Appendix. W&R did not, however, verify the actual location of each site appearing on the Orphan summary, as this was not considered reasonably ascertainable in the context of time and budget required to complete the Phase I ESA. Additional sites listed in the EDR Report and not discussed in the paragraphs below were deemed to be located beyond the search distances set forth in the ASTM E-1527-05 standard for Phase I ESAs. The sites can be viewed in the EDR report provided in the Appendix. Details of the reported are noted below. 4.1.2 National and State Priorities List; CERCLA W&R reviewed the EDR listing of sites registered in the National and State Priorities Lists as “Superfund” sites under the Comprehensive Environmental Response Compensation and Liability Act (CERCLA). No CERCLA sites are listed for the subject property or sites located within a one-mile radius of the subject property. The Hazardous Substance Disposal Sites (HSDS) list contains locations of uncontrolled and unregulated hazardous waste sites. No HSDS sites are listed for the subject property or within a one-mile radius of the subject property. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 13 The Inactive Hazardous Sites Inventory (SHWS) list contains state hazardous waste site records and is the state equivalent of CERCLIS. No SHWS sites are listed for the subject property or within a one-mile radius of the subject property. 4.1.3 Potential CERCLA W&R reviewed the lists provided by EDR of sites registered in the Comprehensive Environmental Response Compensation and Liability Act as potential “Superfund” sites under the Comprehensive Environmental Response Compensation and Liability Information System (CERCLIS). No potential CERCLA/“Superfund” sites are listed for the subject property or sites located within a half-mile radius of the subject property. 4.1.4 RCRA W&R reviewed the list provided by EDR of businesses that generate or transport hazardous waste registered under the Resource Conservation and Recovery Act (RCRA). No RCRA generating or transporting facilities were listed for the subject property. Two RCRA sites are listed in the EDR Report within a one-half mile radius of the site. H&M Motors, Inc. addressed as 101 Carson Street, approximately 322 feet northwest of the site is listed as a RCRA Conditionally Exempt Small Quantity Generator (CESQG) with no RCRA violations. Due to the facilities topographic situation from the site and the lack of reported violations, W&R does not consider the RCRA CESQG to be a REC. A RCRA- CESQG (Conditionally Exempt Small Quantity Generator) site, Pilot Mountain Textiles, Inc., was listed 1,467 feet from the subject property. No violations are listed for this site. Therefore, based on the distance of the property from the subject site and topographic situation, W&R does not consider this site to be a REC to the subject property and should not interfere with the continued operation of the property with municipal water and sewer services. General information about this RCRA site can be found in the EDR Report in the Appendix. Withers & Ravenel reviewed the Federal facility index system (FINDS) database. FINDS contains facility information and “pointers” to other sources that contain more detail. The subject property was identified on the FINDS database and was listed as Brown Wooten Mills Incorporated Pilot Mount Inacti. According to information listed in the EDR report the site was listed in the finds database as part of the AFS (Aerometric Information Retrieval System (AIRS) Facility Subsystem). AIRS is the national repository for information concerning airborne pollution in the U.S. AFS is used to track emissions and compliance data from industrial plants. The site was also listed in the FINDS database as NC-FITS (North Carolina – Facility Identification Template for State) which is a NCDENR template that provides a common facility identifier in order to improve accessibility to comprehensive information about environmental regulated entities in North Carolina. No additional information was provided in the EDR Report regarding the subject property and the subject property did not appear in any additional databases searched. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 14 Four additional sites were identified on the FINDS database within one-half mile of the site. General information on these sites can be found in the EDR Report located in the Appendix. Two of the sites listed, Pilot Mountain WTP and Town of Pilot Mountain, were noted on the EDR Report to be 1 foot from the property; however, these sites were determined during site reconnaissance to be located at least 3,000 feet west northwest of the subject property. W&R believes that the remaining sites listed under the FINDS database either corresponds to sites discussed under other databases or are listed for issues that do not represent a threat to the environmental quality of the subject property under ASTM E-1527-05 standards. 4.1.5 Hazardous Spill Incident Records W&R reviewed NCDENR-Incident Management Database (IMD), the Hazardous Materials Information Reporting System (HMIRS), and USEPA - Emergency Response Notification System (ERNS) databases pertaining to hazardous material spills provided in the EDR report. The site was listed as an IMD site under Amos & Smith Hosiery at 600 East Main Street. This site is discussed in more detail in Section 4.1.6. No ERNS, HMIRS, or other IMD sites were listed in the EDR Report that corresponds to the subject property or properties within a one-half mile radius. 4.1.6 UST Leak Incidents W&R reviewed a list of leaking underground storage tank (LUST) incidents for Surry County maintained by NCDENR provided by the EDR Report. Excluding the “Smoking D’s” site discussed in the orphan summary discussion in Section 4.1.1, no UST leak incidents were reported for the subject property or for properties within a one-half mile radius. However, W&R was provided with an underground storage tank closure letter regarding the Amos & Smith Hosiery Mill from the Town of Pilot Mountain (client). W&R contacted the NCDENR-Division of Waste Management Regional Office in Winston-Salem, North Carolina for information regarding the former UST. According to Mr. Thomas Moore, a 20,000 gallon UST was removed from the subject property in 1991. Mr. Moore stated that the file was closed on April, 4, 1997. W&R reviewed publicly available information regarding this site via archived files placed on compact disk provided by the NCDENR- Division of Waste Management – UST Section in Raleigh, North Carolina. W&R was provided with a site report/information by EDR. Information obtained from the NCDENR file is summarized below. Copies of this information can be provided upon request. Amos & Smith Hosiery (Subject Site) According to a report titled Soil Remediation Project, dated July 22, 1991, by Environmental Investigations, surficial soil contamination was discovered at the Amos & Smith facility during a reconnaissance investigation completed in November of 1990. According to the report the soil contamination resulted from floor rinsing in the boiler room building in which the rinsing liquid was discharged through an opening in the wall of the building. The contaminated soils were excavated until no signs of contaminated soil remained. Confirmation samples collected beneath the base of the contamination ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 15 east and south of the building indicated that the vast majority of the surficial contamination had been removed. Laboratory samples collected contained less then the NCDEM allowable limit for the parameters tested. Contaminated soils were observed remaining under the foundation walls of the building. This soil was not excavated under the building foundation in order not to jeopardize the integrity of the building. A sample collected from this area indicated oil and grease as well as total petroleum hydrocarbons (TPH) diesel and mineral spirit range concentrations greater the NCDEM allowable limits. According to a UST Closure report, dated July 22, 1991, by Environmental Investigations, a 20,000 gallon UST was removed from the subject property on June 10, 1991. During excavation and removal of the UST, soil contamination was discovered around the UST fill pipe and approximately 35 yd³ of soil was removed for offsite disposal. Three confirmation soil samples were collected from the base of the excavation. According to the laboratory analysis, two of the samples contained less than the NCDEM allowable limit for the parameters tested. However, a sample collected from underneath the center of the UST indicated levels of oil and grease and diesel range TPH at levels above NCDEM allowable limits. A Site Sensitivity Evaluation performed for the Amos & Smith facility scored a 20 rating, which was above the TPH/diesel result of 19 parts per million (ppm) but below the oil & grease result of 68 ppm. Based on the low score on the Site Sensitivity Evaluation a variance in the maximum cleanup level was requested for petroleum contaminated soil. The report further stated that three groundwater monitoring wells had been installed on the property in December 1990 and that samples collected from these wells did not indicate the presence of volatile organic compounds. However, a separate analysis for semi-volatile organics (SVOCs), like those typical of #6 fuel oil, was not completed for the groundwater on site. Typical SVOCs were not noted in the volatile method (EPA Method 8240) conducted at the time A letter dated April 11, 1997, from the DEHNR Division of Water Quality – Groundwater Section, addressed to Mr. Bob Wooten of Brown Wooten Mill, Inc. stated the UST system has been closed in accordance with NCAC Title 15A Subchapter 2N. The Client may elect to do additional soil and groundwater assessment to confirm contamination was removed from the UST incident site; however, this does not appear to be required as the UST closure met 1997 standards, which are not as stringent as 2008/2009 standards. W&R does consider the oil release near the building to be an REC relative to the subject property. Based on the reports reviewed soil contamination remains on the subject property beneath the foundation of the boiler room building at 4,600 ppm. This area represents a condition that could warrant additional investigation if the UST Section should audit the file. 4.1.7 Registered USTs W&R reviewed registered UST databases for Surry County maintained by the NCDENR for the subject property and all surrounding properties, as listed in the EDR Report. The subject property was listed in the EDR report as having a registered UST. According to ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 16 the EDR site report, provided to W&R February 11, 2009, the site previously contained a 20,000-gallon UST containing #6 fuel oil from February 5, 1971 until October 6, 1991 (See the previous section for corresponding LUST information). Two UST sites were also listed in the EDR report within a half-mile of the subject property. General information on these sites can be viewed in the EDR report in the Appendix. Based on these site’s distance and topographic situation from the subject site, W&R feels that the UST sites identified in the EDR report are not RECs and should not interfere with the continued operation of the property with municipal water and sewer service. The Dayton Tire and Exxon service station located on the northern adjacent property is an operating automobile service and gas station with several USTs; however, it was not listed in the EDR Report as having registered USTs. This site is an active gas station with UST systems in operation. As the store does not appear on the LUST portion of the EDR Report, it does not appear that the store has had a reported release of petroleum. This does not mean, however, that a release has not occurred from the UST systems on this property. See the conclusions of this report for additional information. It should be noted that registration with the NCDENR of commercial USTs was not required prior to 1988. Additionally, registration for non-commercial USTs (e.g. residential) less than 1,100 gallons in capacity is not required with NCDENR. Therefore, if a UST system was used to store fuel for any heating system on the property, or to support agricultural or other operations there would be no written public record of its use. 4.1.8 Solid Waste Landfills The North Carolina Solid Waste Section database, as provided in the EDR report, was reviewed to determine if any solid waste facilities are within the vicinity of the subject property. This listing includes domestic waste landfills; industrial waste landfills; construction/demolition landfills; sludge landfills; ash landfills; and land clearing and inert debris landfills greater than 2 acres. The subject property and adjacent properties within a one-half mile radius are not listed as solid waste landfill facilities (SWF/LF). 4.2 Physical Setting and Analysis W&R also examined the U.S. Geological Survey 7.5-minute series topographic maps of the Pilot Mountain and Pinnacle, North Carolina Quadrangles (Figure 1). The subject property ranges in elevation between 1180 and 1200 feet above mean sea level. The site appears to slope to the southeast towards an unnamed tributary of Heatherly Creek situated southeast of the subject property. Surficial drainage from the subject property appears to be directed to the southwest eventually flowing into the aforementioned unnamed tributary. Topographically, it appears that surficial drainage from the eastern adjacent properties has the potential to flow onto the subject property. No obvious signs of contamination were observed on these properties during site reconnaissance or aerial review. Withers & Ravenel feels that groundwater from the subject property would presumably flow toward the aforementioned tributary of Heatherly Creek; however, we cannot accurately predict the direction of groundwater flow based solely on the topographic observations. Please see the “Geocheck – Physical Setting Source” report on pages A-1 through A-14 of the EDR Report in ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 17 the Appendix for information on storm water flow, topographic information, and offsite flow. 4.3 Historical Use Information on the Property 4.3.1 Ownership Review Information on the ownership history of the site was obtained by W&R through a review of the Surry County deed records at the Surry County Register of Deeds Office in Dobson, North Carolina. The ownership history of the property was reviewed for indications of past owners who may have used, stored, or disposed of hazardous substances or petroleum products on the site. The information was assembled for informational and historical purposes only for use in this report and should not be construed as a legal chain-of-title for the site. The chain of ownership became very complex during the review of the parcel due to the property splitting, being willed, and/or lack of previous deed information/lack of information provided in the grantor/grantee books. Due to the nature of the records, information of some deeds was not reasonably ascertainable, as defined in ASTM E 1527-05. Records were reviewed to the extent practical within reasonable time and cost constraints. The following table lists the deed’s book and page number, grantor and grantee, and date. Prior to 1938, it appears that the property was owned by private entities with no industrial or manufacturing operations conducted. Copies of the deeds obtained by W&R from the Surry County Register of Deeds Office in Dobson, NC is provided in the Appendix. 4.3.2 Aerial Photograph Review W&R reviewed aerial photographs from 1998, 2005, and 2008 available at the Surry County GIS Department in Dobson, North Carolina. Aerial photographs from 1936, 1940, 1951, 1955, 1966, and 1977 were obtained from the Surry County Soil and Water Conservation District office in Dobson, North Carolina. In addition, an aerial photograph from 1993 was obtained from the North Carolina Department of Transportation GIS Data Distribution website (http://www.ncdot.org/it/gis/DataDistribution/). Copies of the aerial photographs are provided in the Appendix. No other historical aerial photographs for the subject property were reasonably ascertainable at the time of W&R’s site reconnaissance. Due to road expansions, property changes, and differences in scales in the maps over the years, it is very difficult to establish the exact area of the property lines and locations of structures and roads in comparison to those lines. Therefore, the property line locations were estimated. 1936 Aerial Photograph : Description of Subject Property: • The two residential structures and their respective storage building/barns are visible on the northeast portion of the subject property. • A third residential structure may be located in the vicinity of where the hosiery building now exists. • The subject property primarily consists of open fields possibly used for agricultural purposes with a small woodland area toward the center of the southern boundary. • The Southern Railroad is visible along the southern boundary of the site. • The surrounding area consists of agricultural fields, scattered residential structures, and some undeveloped woodlands. • Due to the scale, age, and condition of the aerial photograph, W&R is unable to determine any further information of the usage of the subject property or surrounding properties. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 19 1940 Aerial Photograph: Description of Subject Property: • The Amos & Smith Hosiery building has been constructed on the western portion of the subject property. • There appears to be a commercial structure located to the north across Main Street. • There were no additional significant changes to the subject property or surrounding properties from the 1936 aerial photograph. 1951 Aerial Photograph: Description of Subject Property: • An addition has been constructed on the eastern side of the hosiery building. • Agricultural fields are visible on the southeastern portion of the site behind the residential structures. • The woodlands behind the hosiery building have increased in size. • Residential and commercial development along Main Street has increased. • There were no additional significant changes to the subject property or surrounding properties from the 1940 aerial photograph. 1955 Aerial Photograph: Description of Subject Property: • An unimproved road is visible extending south from Main Street to a clearing on the southern portion. • The water tower is now visible within the aforementioned clearing. • There were no additional significant changes to the subject property or surrounding properties from the 1951 aerial photograph. 1966 Aerial Photograph: Description and Changes: • An addition has been constructed on the rear of the hosiery building. • The southwest portion of the site has been cleared. • The area west of the hosiery building appears to be used for parking. • The agricultural fields behind the residential structures are now overgrown. • Commercial growth continues in the surrounding area. • There were no additional significant changes to the subject property or surrounding properties from the 1955 aerial photograph. 1977 Aerial Photograph: Description and Changes: • An addition had been added on to the western portion of the building. • The detached boiler room structure is now visible behind the southeast corner of the hosiery building. • Commercial development has taken place across Main Street north of the hosiery building. • There were no significant changes to the subject property or surrounding properties from the 1966 aerial photograph. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 20 1993 Aerial Photograph: Description and Changes: • A parking lot is visible behind the hosiery building. • A possible AST is visible adjacent to the eastern side of the detached boiler room structure. • The Exxon gas station is visible across Main Street north of the hosiery building. • Hamilton Casting Corporation has been constructed on the southern adjacent property. • There were no additional significant changes to the subject property or surrounding properties from the 1977 aerial photograph. 1998 Aerial Photograph (scale 1"= 200’): Description and Changes: • There were no significant changes to the subject property or surrounding properties from the 1993 aerial photograph. 2005 Aerial Photograph (scale 1"= 200’): Description and Changes: • Asphalt parking and driveways are visible around all sides of the hosiery building. • The AST containment area is visible adjacent to the eastern side of the boiler room structure. • There were no significant changes to the subject property or surrounding properties from the 1998 aerial photograph. 2008 Aerial Photograph (scale 1"= 200’): Description and Changes: • There were no significant changes to the subject property or surrounding properties from the 2005 aerial photograph. Aerial Review Summary: Review of the aerial photographs revealed that the subject property consisted of open fields with three residential structures along Main Street from 1936 until prior to 1940. Prior to 1940 the western most residential structure was replaced by the Amos & Smith Hosiery Company building. The subject property remained in this configuration from prior to 1940 to the present with the exception of the following additions: 1) prior to 1951 an addition was constructed on the eastern side of the hosiery building, 2) prior to 1966 an addition was constructed on the southern side of the hosiery building, and 3) prior to 1977 an addition was constructed on the western side of the hosiery building and the boiler room structure was constructed behind the hosiery building. Prior to 1955, a water tower was constructed on the southern boundary of the site. No additional changes were noticeable on the subject property between 1977 and 2008. The surrounding vicinity primarily consisted of scattered residential structures and agricultural fields from 1936 to prior to 1951. From prior to 1951 to the present, commercial and residential development substantially increased throughout the surrounding vicinity. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 21 4.3.3 Sanborn Fire Insurance Maps Sanborn maps originated in the late 1800s and published around 1960. The maps were used by insurance underwriters to determine the risk involved in insuring individual buildings in urban areas against loss in fires or other disasters. These historical maps plot building details and provide comments concerning a building’s former use. The availability of Sanborn Maps is limited to urban areas that historically presented fire hazards. Sanborn Map coverage was not available for the subject property. 4.3.4 City Directory Search W&R attempted to obtain information on the historical use of the subject property by reviewing city directories. W&R contacted both the Dobson Community Library (Dobson, NC) and the Charles H. Stone Memorial Library (Pilot Mountain, NC) and was informed that city directories were not available for Pilot Mountain. Additionally, the Mount Airy Public Library (Mt. Airy, NC) was contacted with the same results. A City Directory review could therefore not be performed for the subject property and vicinity. 4.3.5 History of Property Use Based on the information obtained by W&R from deeds, aerial photographs, and interviews, the subject property appears to have primarily been comprised of residential structures from prior to 1936 to until the construction of the Amos & Smith Hosiery Company around 1939. The Amos & Smith Hosiery Company operated from around 1939 until the late 1980’s at which point a sock company, Wooten Mills, began operation in the hosiery building, presumably around 1991. Wooten Mills operated onsite for approximately nine years before going out of business. The subject property was purchased by the current owner in 2002 at which point the hosiery building was renovated for multi-tenant commercial use. W&R conducted interviews with Mr. Billy Pell, the subject property manager, Mr. Cleve Harris, the present property owner, Ms. Ettie Mae Collins, a former employee of the Amos & Smith Hosiery Company, and Mr. Sanders McHone, an adjacent property/business owner. The aforementioned individuals provided W&R with limited historical information of the site and surrounding areas. 4.4 Historical Use Information on Adjoining Properties Historical use of adjoining properties was obtained from review of available aerial photographs from 1936, 1940, 1951, 1955, 1966, 1977, 1993, 1998, 2005, and 2008, and interviews with individuals familiar with the area. The historical use of the adjoining properties has been provided in the aerial photograph review summary of Section 4.3.2 of the report and interviews presented in Section 6 of the report. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 22 5 Site Reconnaissance 5.1 Methodology and Limiting Conditions On January 22nd & 23rd, 2008, W&R performed a reconnaissance of the subject property that involved traversing the site, observing the interior and exterior of the structures, and observing adjacent properties. Not all areas of the site were observable at the time of W&R’s site visit; see Section 1.3 for a description of the limitations encountered by W&R during its site reconnaissance activities. The site reconnaissance was performed to the extent possible within the means of time and cost. 5.2 General Site Setting Description provided in Sections 2.1 and 2.2 of the report. 5.3 Land Areas Description provided in Section 2 of the report. 5.4 Description of Structures The structures are described in Section 2.3 of the report. 5.5 Utilities Local utility companies provide electricity and telephone services to the subject property and surrounding area. A small high voltage transformer substation was observed on the southern side of the hosiery building surrounded by chain link fence. The transformers did not contain a “blue dot” sticker or any other markings that would indicate that they are PCB free. No indications of leakage, such as staining or stressed vegetation were observed on either of the substation transformers, or the ground surface in the nearby vicinity. Five pole mounted transformers were observed located around the subject property. Four of the transformers were located along the northern boundary of the subject property, adjacent to Main Street. The remaining transformer was located in the asphalt parking area just off the southeast corner of the hosiery building. Not all of the transformers observed contained a blue dot that would indicate that they are PCB free; however, no indications of leakage, such as staining or stressed vegetation, were observed on any of the transformers or the poles. W&R observed indications of public water and sewer service on the subject property. The site and surrounding area utilize municipal water and sewer services. 5.6 Oil and Hazardous Materials Storage and Use USTs No petroleum USTs were discovered during site reconnaissance activities or revealed in the interview process. W&R was informed of a former 20,000 gallon UST located east of the boiler room structure. Information on this UST can be found in Section 4.1.6 and 4.1.7. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 23 ASTs A cinder block and concrete containment basin was observed adjacent to the eastern side of the boiler room structure. Pipes labeled for fuel oil were observed extending from within the containment basin into the boiler room structure. According to Mr. Billy Pell, property manager, the AST had been removed from the subject property when the property was purchased by the current owner in 2002. Mr. Cleve Harris, property owner, stated that the former AST was approximately 7,500 to 10,000 gallons. No obvious signs of leaks or large spills were observed within the containment basin. The distribution of fuel from the tank to the boiler house appears to have been through above ground piping. No staining or obvious signs of leaks or spills were observed on the ground surface in the vicinity of the piping in the containment area. However, obvious staining and petroleum odors were observed inside the boiler room structure beneath the piping and along the cinderblock wall near the piping. W&R considers this area to be a potential REC. Two additional ASTs, approximately 250-gallons each, were observed adjacent to the eastern most residential structure. The ASTs appeared to be currently used for heating oil storage. Above ground piping connected the ASTs to a filter and additional piping was observed extending from the filter underneath the residential structure. The ASTs appeared to be in good condition. No staining or obvious signs of leaks were observed beneath the AST or the ground surface below the ASTs; however, staining and odors typical of petroleum products was observed on the filter and the ground surface below the filter. W&R was informed by both the current property manager and a tenant of the second residence that the additional residence on the subject property likely used fuel oil supplied by an AST in the past. W&R was not able to confirm the exact location of a former AST and no obvious signs of staining or odors typical of petroleum products were observed on the ground surface in the vicinity of this residential structure. W&R was informed by Ms. Ettie Mae Collins, a former employee of the Amos & Smith Hosiery Company that chlorine and peroxide were used in the dyeing process of the hosiery plant. Ms. Collins was not aware of how these chemicals were stored on the subject property but suggested that they would have been stored in the dye house on the western portion of the building. Due to past experience with hosiery manufacturing facilities, W&R feels the potential exist that the chlorine and peroxide could have been stored in ASTs on the subject property. Drums Three plastic 55-gallon drums were observed in the boiler room structure. Each of the drums was capped and full of a liquid substance at the time of W&R’s site reconnaissance. One of the drums was labeled as a Dispersant BL-1340 from ChemTreat Inc. and was listed as containing Sodium Hydroxide and an Acrylade Copolymer. A second drum was labeled as Boiler Water Treatment BL-1253 from ChemTreat Inc. and was listed as containing Sodium Sulfate and Sodium Bisulfate. The third drum was from Water Technology & Controls, Inc. and displayed a placard signifying the contents were corrosive but did not identify the contents by name. All three of the drums viewed appeared to be in good condition and no obvious signs of spills or leaks were noted on the ground around the drums. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 24 W&R also learned through interviews that additional drums had been stored on the subject property for use in the textile manufacturing process. W&R was not able to determine the exact chemicals that were stored on the property other then various dyes as well as chlorine and peroxide that would have been used during the dye process. W&R observed two additional drums on the site. However, these drums appeared to be either too rusted and unidentifiable or used for trash purposes. Of these additional drums that were viewed, W&R does not consider these to be RECs for the site. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 25 6 Interviews 6.1 Interview with Mr. Cleve Harris – Subject Property Owner W&R interviewed Mr. Cleve Harris on January 28th, 2009. Conversation records are available upon request. Mr. Harris stated that he has owned the subject property for approximately 6 years but has been familiar with the subject property for many years. Mr. Harris stated that he was familiar with the property during the time that it was being used as a hosiery mill. Mr. Harris stated that for approximately fifty years the building was primarily a women’s hosiery mill. Mr. Harris stated that he did not know a lot about the hosiery process but he was familiar with the general layout of the building. Mr. Harris stated that the dye house was located on the western end of the building and the majority of the building east of the dye house was knitting area. Mr. Harris stated to the best of his knowledge all trench drains and floor drains located in the dye house and throughout the building were connected to the municipal sewer system. Mr. Harris stated that he was unsure if any of the water from the trench drains was filtered before entering the sewer system. Mr. Harris said that he did not know what types of chemicals or dyes were used during the hosiery process or which parts of the building would have been used to store these types of chemicals. Mr. Harris stated the concrete containment area located inside the eastern end of the hosiery building was the location of an air filter system. Mr. Harris stated that the system used water to trap lint out of the air within the hosiery building. Mr. Harris said that air from inside the hosiery building was pulled into the system and cycled through flowing water, at which point the lint would be collected within a filter for disposal and fresh air blown back into the hosiery building. Mr. Harris stated that the AST that was formerly located within the containment area adjacent to the boiler room structure was approximately 7,500 to 10,000 gallons in size and was removed from the property around the time that he acquired it in 2002. Mr. Harris stated that he was unaware of any other AST that had been used during the hosiery manufacturing process. Mr. Harris stated he was aware that one of the residential structures located on the property utilizes two ASTs for heating fuel storage. Mr. Harris stated that he did not know if the additional residence had ever used fuel oil for heating in the past. Mr. Harris stated that the two houses were currently rental properties and had been rental properties prior to his purchase of the site. Mr. Harris stated that, to his knowledge, no USTs, borrow pits, lagoons, or cracked batteries were ever present on the subject property. In addition, he was not aware of any leaks, spills, or releases of petroleum products or other hazardous substances at the site. Mr. Harris had not heard of any spills, liens, land restrictions, or cleanups associated with the subject property or the adjacent properties. He indicated that he was not aware of landfill or dumping activities having occurred on the subject property. Furthermore, he had not heard of any violations of or lawsuits based on environmental regulations. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 26 6.2 Interview with Mr. Billy Pell – Subject Property Manager W&R interviewed Mr. Billy Pell on January 23rd, 2009. Conversation records are available upon request. Mr. Pell stated that he became the property manager for the subject property when Caro Associates, LLC purchased the property in 2002. Mr. Pell stated that he has been familiar with the property for many years. Mr. Pell stated that his mother worked at the Amos & Smith Hosiery Company from the time she was 18 years old. Mr. Pell stated that he had been the public works superintendent and the town manager form 1986-2003. Mr. Pell stated that the Amos & Smith Hosiery Company began operation on the subject property around 1939 and operated onsite until the late 1980’s. Mr. Pell stated that the property was then purchased by Mr. Robert Wooten who operated a sock company, Wooten Mills, for approximately eight or nine years. Mr. Pell stated that Caro Associates purchased the property in 2002 and removed all the manufacturing equipment and updated the building with additional walls, bathrooms, and other renovations. Mr. Pell stated since 2002 to the present the hosiery building has been used for commercial purposes and currently housed a bakery business, a hair salon, a storage facility for a local rope manufacturer, an auction house, and a flea market with multiple vendors. Mr. Pell stated that he has limited knowledge of the manufacturing processes that had been performed onsite while the building was being used for textile manufacturing; however, Mr. Pell stated he was familiar with the general layout of the building. Mr. Pell stated that to the best of his knowledge the dye house was located on the western end of the building primarily in the area that now houses a bakery. Mr. Pell stated that he was not aware of what types of dyes or chemicals would have been used for the dye processes. Mr. Pell stated that the majority of the building east of the dye house was used for knitting areas with some storage and loading dock areas located along the back and on the eastern end of the building. Mr. Pell stated that all of the floor drains, located throughout the hosiery building, were connected to the municipal sewer system. Mr. Pell further stated that the subject property has been connected to the municipal water and sewer system since it was constructed in the 1930’s. Mr. Pell stated that the hosiery building had two boiler room areas, one located in the back of the hosiery building and a second newer boiler room area in the detached aluminum structure located behind the hosiery building. Mr. Pell stated that an AST containing fuel oil had formerly been within the containment area located adjacent to the aluminum boiler room building. Mr. Pell stated that he was unsure about the size of the AST and stated that the AST had been removed from the property in 2002. Mr. Pell stated that he was unsure what parts of the hosiery building had been used to store chemicals in the past and that he was unsure what types of chemicals had been used on the site. Mr. Pell further stated that he did not know where or if there had been tanks for peroxide and chlorine used in the past on the site. Mr. Pell stated that the basement area located in the back of the hosiery building was currently vacant except for a storage area that is used to store household items by the current property owner. Mr. Pell stated that the basement area was used during the textile process as a maintenance and repair facility for the hosiery equipment and machines. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 27 Mr. Pell stated that the water tower located on the subject property was owned by the Town of Pilot Mountain and that they had a 100 year lease for the right to maintain the water tower on the subject property. Mr. Pell stated that the two residential structures on the subject property had been located on the property for at least the 60 years that he was familiar with the property. Mr. Pell stated that the residential structures were currently used as rental properties. Mr. Pell stated that one of the houses is currently using wood and fuel oil for heating purposes and two ASTs were located on the side of the house. Mr. Pell stated that the other house was currently only using wood for heat although he would assume that fuel oil supplied by an AST had been used in the past. Mr. Pell stated that both of the residential structures were currently connected to city water and sewer and that he was unaware of any septic tanks located in that area or any area of the subject property. Mr. Pell stated that, to his knowledge, no USTs, borrow pits, lagoons, or cracked batteries were ever present on the subject property. In addition, he was not aware of any leaks, spills, or releases of petroleum products or other hazardous substances at the site. Mr. Pell had not heard of any spills, liens, land restrictions, or cleanups associated with the subject property or the adjacent properties. He indicated that he was not aware of landfill or dumping activities having occurred on the subject property. Furthermore, he had not heard of any violations of or lawsuits based on environmental regulations. 6.3 Interview with Ms. Ettie Mae Collins – Former Employee of Amos & Smith Hosiery Company W&R interviewed Ms. Ettie Mae Collins on January 23rd, 2009. Conversation records are available upon request Ms. Ettie Mae Collins stated that she was employed by the Amos & Smith Hosiery Company for approximately 21 years from 1945 through 1966. Ms. Collins stated that she worked in the knitting room of the factory seaming full fashion hosiery and eventually began looping. Ms. Collins stated that the knitting areas were located in the center sections of the building and that the dye house was located on the western end of the building. Ms. Collins said that she was not very familiar with the dyeing processes used at the hosiery plant and was unsure the types of dyes that were used and how they were stored. Ms. Collins further stated that she would assume the dyes were stored somewhere in the dye house area. Ms. Collins stated that she was aware of tanks used to store chlorine and peroxide located in the dye house. Ms. Collins stated that she was not aware of any landfill or dumping activities ever occurring on the subject property. Ms. Collins further stated that she remembers all the waste from the manufacturing process being collected and hauled to the dump. 6.4 Interviews with Mr. Sanders McHone – Adjacent Property/Business Owner W&R interviewed Mr. Sanders McHone on January 22nd, 2009. Conversation records are available on request. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 28 Mr. Sanders McHone stated that he has owned and operated the farm service and agricultural supply business across the street from the subject property for over 30 years. Mr. McHone stated that he had been in the hosiery building on the subject property when it first opened but had not been in the building since that time. Mr. McHone stated that he did not know much about the hosiery manufacturing process and that he did not know what types of chemicals or dyes had been used on the property. Mr. McHone stated that no textile manufacturing had taken place on the subject property since the 1980’s and that the primary use of the hosiery building has been for the local flea market since that time. Mr. McHone stated that to his knowledge there had never been any sort of leaks or spills of petroleum products or hazardous chemicals on the subject property. Mr. McHone stated that he was unaware of any environmental problems associated with the subject property. Mr. McHone stated that, to his knowledge, no USTs, borrow pits, lagoons, batteries, or hazardous chemicals other then the dyes used for textile manufacturing were ever present on the subject property. In addition, he was not aware of any leaks, spills, or releases of petroleum products or other hazardous substances at the site. He indicated that he was not aware of landfill or dumping activities having occurred on the subject property. Mr. McHone stated that he was unaware of any environmental problems associated with the subject property or the surrounding area. 6.5 Interviews with Local Government Officials W&R contacted the Surry County Emergency Services Department to ascertain if there had been any reported environmental incidents (leaks, spills or dumping of petroleum liquids or hazardous substances) for the subject property or surrounding properties. W&R was directed to Mr. John Shelton, the Emergency Management Coordinator for Surry County. Mr. Shelton stated that he has been the emergency coordinator since 1985 and that he was familiar with the subject property. Mr. Shelton stated that to his knowledge no emergency responses due to hazardous material spills, leaks, or other incidents of an environmental nature had occurred on subject property or in the surrounding vicinity. In addition, Mr. Shelton searched the emergency response database for any records of petroleum spills or other incidents of an environmental nature. Mr. Shelton stated the only response listed for the subject property pertained to a leak in the city water tower located on the property. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 29 7 Data Gaps In accordance with the Standards and Practices for All Appropriate Inquiries (Title 40 of the CFR, Part 312) and Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM Standard E-1527-05), data gaps should be identified in the Phase I ESA report. Withers & Ravenel identified the following data gaps during Phase I ESA activities: 1. Past Owner Interview W&R could not complete an interview with either Mr. Robert Amos or Mr. Robert Wooten, who previously owned the subject property and operated textile manufacturing companies on the property. W&R learned that both Mr. Amos and Mr. Wooten have died. Obviously, these individuals would have been the people most familiar with this site and the processes involved in the textile manufacturing operations. An interview with Mr. Amos or Mr. Wooten would provide accurate and very reliable historical information regarding the former condition and use of the subject property. W&R also learned that one of the Plant Managers, who lived adjacent to the site, recently died. W&R did obtain very limited historical information since 1945 regarding the subject property through an interview with a former employee. However, W&R could not locate additional informed representatives for interviews in conjunction with the Phase I ESA. This data gap renders the environmental professional without and interview with an individual knowledgeable of the daily textile operations, chemical/petroleum handling operations, locations of all drains and chemicals used the utilization of drums and tanks, etc. Without this information it is difficult to conclude that the RECs listed in the Conclusions section of this report are all-inclusive. Therefore, W&R believes that this lack of information affects the ability of the environmental professional to identify RECs for this site. 2. Aerial Photograph or Interview Covering the Subject Property’s Original Development W&R was unable to obtain aerial photographs or an interview that covers the time period of the initial development of the subject property. According to Surry County information the subject property was first developed with an existing residence in 1929. W&R was able to obtain aerial photographs dating back to 1936. W&R was informed that former owners of the subject property that would have been familiar with the initial development have died. Although we did not document it in the deed table due to the parcel splitting into 3 separate tracts, which was not reasonably obtainable in terms of time and cost, W&R was able to view title information back to the early 1920’s indicating only private ownership of the subject property during the time of the initial development. Based on the historical information gathered, W&R cannot conclude that the data gap of an aerial photograph or an interview covering the initial development of the subject property will ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 30 be detrimental to the results of this Phase I ESA at this time. This does not preclude that the aerial photograph would not show information regarding a past REC on the subject site. At this time, this information is not reasonably ascertainable to W&R. W&R does not recommend further investigation of the site based on this data gap. ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 31 8 Findings and Conclusions Withers & Ravenel has performed a Phase I Environmental Site Assessment at the request of Mr. Blair Knox on behalf of the Town of Pilot Mountain. The Phase I Site Assessment involved a site reconnaissance and review of public records for a ±8.29-acre site located approximately 1,000 feet west of the intersection between East Main Street and Old US Highway 52 Bypass in Pilot Mountain, Surry County, North Carolina (Figure 1). According to Surry County GIS records the site is addressed as 612 East Main Street and is currently owned by Caro Associates, LLC. The findings contained herein are based on the results of the Phase I ESA performed by Withers & Ravenel in accordance with Withers & Ravenel’s Standard Contract Conditions for Engineering Services. All conclusions made in this report are based upon the assessment performed by Withers & Ravenel and are subject to the Special Terms and Conditions outlined in Section 1.4 of this report. Any exceptions to, or deletions from, this practice are described in the report. The environmental assessment activities completed on the subject property by previous consultants in the early 1990’s did not identify gross levels of targeted constituents in groundwater on the property. Likewise, the assessment of the former petroleum UST system suggests that the investigation area was not grossly impacted by petroleum constituents. The North Carolina Department of Environment and Natural Resources subsequently issued correspondence that indicated the UST closure was completed within the provisions of 15A NCAC Subchapter 2N. It is our opinion that other operations on the property have the potential to have created subsurface contamination, including the dyehouse drains, coal pile, boiler rooms, and maintenance area. The consulting firms completing environmental studies of the property in the early 1990’s did not feel that those areas warranted active investigation at that time. It is unknown whether the sock manufacturing plant, which operated subsequent to the original investigation and up until 1999, caused the environmental condition of the property to change over that period. However, the original subsurface assessment, as previously stated, did not identify gross levels of targeted constituents in groundwater. As this property may contain subsurface impacts from the previous manufacturing operations, the Town should consider completing additional subsurface investigation of those potential impacts. Another alternative is to consider obtaining a Brownfield’s agreement from the State of North Carolina prior to purchase of the property. If the Town desires to pursue obtaining a Brownfield’s agreement from the North Carolina Division of Waste Management to obtain protection from future regulatory concerns for this property related to undiscovered or unresolved contamination, please notify our office as we have experience with this program and can assist the Town with completion of the application package. This is not a requirement but an option for the Town to consider. It is our opinion that with the contents of this study and the previous assessment data you have the majority of information required to apply for the Brownfield’s agreement. Likewise, if you desire to pursue additional investigation of any of the potential sources of contamination not previously investigated at the site, including the residential properties, ±8.29-Acre Caro Associates, LLC Property W&R Project No. 02090017.0 Phase I Environmental Site Assessment February 2009 32 please contact our office. Finally, any demolition or renovations of the property should include an inspection for asbestos containing materials and lead based paint so that those hazards may be identified and properly managed.
