Dear Ms. Seaberg:
I appreciate your prompt efforts to correct the recently discovered issue caused by Holden
Business Parks, LLC’s failure to file the full-sized brownfields survey plat, Exhibit B to the
Notice of Brownfields Property (Notice), at the time the Notice and its other Exhibits (Exhibit
A, the Brownfields Agreement, and Exhibit C, the Legal Description) were filed for recordation.
The mylar copies of the original survey plat was received in our office on Sept. 30, 2015. Upon
inspection, the plat was deemed “Acceptable” to the Department of Environmental Quality
(DEQ) by Michael M. Scott, Deputy Director of the DEQ’s Division of Waste Management
(DWM), and was subsequently signed by Mr. Scott.
You are responsible for filing the survey plat with the Mecklenburg County Register of Deeds
(ROD) office for recordation as soon as possible. Upon your filing of the Notice, the Register
of Deeds is required by N.C.G.S. § 130A-310.35(c) to record it and index it in the grantor index
under the names of the owners of the land, and, if different, also under the name of the Prospective Developer.
Pursuant to paragraph 24 of the Agreement, within three days after the Register of Deeds has
recorded the Notice of Brownfields Property you must furnish DEQ a the full-sized plat with
notations by the Register of Deeds indicating its recordation. Please send these items to:
