Good afternoon, Thomas The Lyondell Environmental Custodial Trust (Trust) is pleased to submit the attached Charlotte Site Environmental Budget Amendment 2024-01 (Amendment) for the North Carolina Department of Environmental Quality (NCDEQ) review and approval. As you are aware, the Trust submitted the 2024 budget on November 2, 2023 and was subsequently approved by the NCDEQ on January 9, 2024. At the time of budget preparation in late 2023, and through conversations with Arcadis, it was thought that substantial completion of the remediation system would be completed and billed by December 31, 2023. Thus, the 2024 budget did not include a carry over to fund remedial action implementation. As noted in the 2024 budget transmittal, see below: Consistent with prior years, the Budget includes the “Environmental Activities as Directed by the Trust” contingency line item to fund currently undefined scopes of work to be utilized as required to advance the project. Although it is anticipated that the remedy construction/system start-up will occur in 2023, this line item would also fund any minor increase in remedy related subcontractor or material costs that may occur for remaining 2023 implementation efforts or the unlikely event final completion extends into early 2024. To accommodate this potential, this budget line item has been increased in 2024 to $150,000 from the $50,000 established in 2023. Absent the continued permitting and contractor delays in Q4 2023 as documented in the monthly project summaries provided by Arcadis, substantial completion of the system installation would have been finished last year. As you are aware, system installation will be completed this year and is on track for start-up/shakedown before the end of this month. As a result of the greater effort required in 2024, and beyond the $150,000 in the Trust held contingency line item, this Amendment is to fund the Remedial Action Implementation line item with $250,000 to allow Arcadis to complete the system construction and start-up. Please note this Amendment does not constitute a request for additional funding, rather this Amendment is to include $250,000 of previously approved and unutilized portion of the 2023 Remedial Action Implementation line item which amounted to $458,900 due to the Q4 2023 delays. Please note that through this adjustment, the actual implementation cost of the remedy will not exceed the remedy implementation budget established in 2022. Please indicate, via reply email, if NCDEQ approves the attached 2024 Amendment.
