(MACTEC) submits this report documenting the abandonment of four water-supply wells at and adjacent to the “Property” as defined in the Brownfields Agreement dated April 3, 2003 (“BFA”). Under the terms of the BFA, the Prospective Developer agreed to abandon “the two private water supply wells currently in use in the vicinity” of the Property. See BFA at H 13(d). As required by North Carolina well construction regulations in 15A NCAC 2C, McCall Brothers is sending the original copies of these records directly to the Division of Water Quality of the North Carolina Department of Environment and Natural Resources (DENR). Pete Flores, McCall Brothers’ driller, signed the Well Abandonment Records, certifying that each well was abandoned first by disinfecting with a 70% hypochlorite solution, then by pumping Portland cement from the bottom of each well to the surface using the tremmie method, in accordance with the regulations. Principal Geologist In addition to the above described wells, McCall Brothers attempted to locate and close two other wells in the vicinity of the Property. First, the Prospective Developer recently became aware of a second water- supply well at the Baucom residence. MACTEC inadvertently failed to include this well in its prior reports. Unfortunately, Mr. Baucom has refused to permit abandonment of this second water-supply well. As we discussed on the telephone, we understand that Mecklenburg County does not have a law that would require abandonment of this well. You indicated that we could attempt to persuade Mr. Baucom to abandon the well, but that you could not require that he do so. We will meet with Mr. Baucom to try and persuade him to abandon the well. We understand that you will attend that meeting with us, as the State’s representative, when we talk to him. MACTEC attempted on two occasions to find the well at the John Harvey Alexander residence referenced in the BFA. McCall Brothers also attempted to locate a well at the John Harvey Alexander residence at 10108 Mallard Creek Road. MACTEC’s Limited Site Assessment had indicated that a water supply well was located at this address, but upon further review, we have determined that our prior conclusion was based on a misreading of the field notes of Ms. Flora Elliot, the well surveyor. During a recent site visit, we were unable to locate a well at that address. We observed one vacant residence without an address in the approximate location of the address for the Alexander residence. Mr. Rob Foster and Ms. Elliot of MACTEC and Mike Holcomb of McCall Brothers walked around this residence searching for a water- supply well but could not find one. Mr. Foster spoke to Mr. Alexander in person and was told that the residence at that address had been demolished for construction of the office complex presently located on and north of the residence. During a follow up site visit on May 30, 2003, one additional water-supply well was identified at the former Bonds residence at 10201 Mallard Creek Road. This well is located adjacent to the garage at that address and is completely obscured by landscaping, which is why it was not identified during McCall’s Brothers visit on May 2nd. Now that this well has been located, it will be abandoned in accordance with state requirements. MACTEC Engineering and Consulting of Georgia, Inc. permission Richard A. Kolb, L.G.
