A Brownfields Agreement (Brownfields Project No. 22004-18-032) between the Prospective Developer (PD) and the North Carolina Department of Environmental Quality (DEQ) was executed for the Witherspoon Nursery Brownfields property on January 9, 2020. The Brownfields property totals approximately 8.0 acres on two parcels of land, located at 3312 and 3330 Watkins Road in Durham, Durham County, North Carolina (Site or subject Site). The PD sold 3.7 acres of the Brownfields Site (i.e., the western parcel) to Crowne at 501, Limited Partnership (hereinafter referred to as the Witherspoon Nursery West property at 3312 Watkins Road), and the PD retained the eastern 4.3 acres of the Brownfields Site (hereinafter referred to as the Witherspoon Nursery East property at 3330 Watkins Road). As it relates to the Witherspoon Nursery West property during the 2022 redevelopment time period, this report has been prepared in accordance with Land Use Restrictions (LURs) set forth 2923 South Tryon Street, Suite 100 3921 Sunset Ridge Rd, Suite 301 Charlotte, NC 28203 Raleigh, NC 27607 www.harthickman.com 704.586.0007 main 919.847.4241 main Ms. Sarah Hardison Young January 30, 2023 Page 2 in paragraph 15(c) (environmental -related reporting requirements associated with ongoing redevelopment activities) included in the executed Brownfields Agreement for the Site. Proposed redevelopment of the Witherspoon Nursery West property includes the construction of residential apartments and commercial, retail, office, and open spaces. Details pertaining to redevelopment activities for the 2021 redevelopment time period are provided in H&H's Annual Redevelopment Summary Report — Witherspoon Nursery West dated January 28, 2022. A Site map depicting the proposed redevelopment plan is included as Figure 2. Redevelopment activities at the Site have been conducted in accordance with the DEQ approved Environmental Management Plan (EMP) dated April 24, 2019, and revised on May 27, 2020. The sections below outline activities completed to satisfy the requirements of the executed Brownfields Agreement and DEQ approved EMP. 1.0 Environmental -Related Reporting Requirements In accordance with LUR paragraph 15(c) in the executed Brownfields Agreement for the Site, redevelopment activities at the Witherspoon Nursery West property are ongoing and have included the following activities: • Soil management during excavation and grading activities, including off -Site export; and • Installation of hardscaped and landscaped areas. In accordance with the DEQ-approved EMP, stockpiles were evaluated by collecting soil samples at a frequency of one sample per approximately 1,000 cy or at minimum, one sample per stockpile. As such, H&H mobilized to the Site on May 3, 2022, and August 31, 2022, to collect stockpile samples (Stockpile-14 and Stockpile-15, respectively) for waste characterization purposes to evaluate potential off -Site export disposal facilities. Note that management of soil associated with Stockpiles-1 through 8, and Stockpile-10, was documented in H&H's Annual Redevelopment Summary Report — Witherspoon Nursery West dated January 27, 2021, and management of soil associated with Stockpiles 9 and 11 through 13 was documented in H&H's Annual Redevelopment Summary Report — Witherspoon Nursery West dated January 28, 2022. The soil samples were collected directly into laboratory supplied glassware, labeled with the sample identification, dates, times, requested analyses and placed on ice in laboratory supplied coolers under standard chain of custody protocols. The soil samples were submitted to Pace Analytical (Pace) for analysis specified in the EMP: volatile organic compounds (VOCs) by EPA Method 8260, semi-VOCs (SVOCs) by EPA Method 8270, Resource Conservation and Recovery Act (RCRA) metals by EPA Methods 6020/7471, and organochlorine pesticides by EPA Method 8081. Copies of the laboratory analytical reports and chain of custody records are provided in Appendix A. 1.2 Stockpile Sampling Results Laboratory analytical results were compared to the July 2022 DEQ Protection of Groundwater, Residential, and Industrial/Commercial Preliminary Soil Remediation Goals (PSRGs) and are summarized in Table 1. In addition to the PSRGs, metals results were compared to published background ranges for North Carolina soils published in Elements in North American Soils authored by Dragun and Chekiri (2005). https://hardiick.shmepoint.com/sites/MasterFiles-I/Shared Documents/AAA-Master Projects/Crowne hart : h i c k m a n Partners Inc - CRP/CRP-003 Brownfields Assistance/2022 Redevelopment Activities/Final to DEQ/Redevelopment Summary Report_ Witherspoon.doc SMARTER ENVIRONMENTAL SOLUTIONS Ms. Sarah Hardison Young January 30, 2023 Page 4 Laboratory analytical results indicated that low levels of chlorobenzene (0.0033 J mg/kg), ethylbenzene (0.0035 J mg/kg), isopropylbenzene (0.0027 J mg/kg), total xylenes (0.011 mg/kg) and organochlorine pesticide 4,4'-DDE (0.024 mg/kg) were detected in Stockpile-15 at concentrations above laboratory method detection limits, but below the DEQ PSRGs As expected, naturally occurring levels of some metals were detected at concentrations above the laboratory method detection limits in each soil sample. Arsenic was detected at concentrations up to 3.4 mg/kg, which exceeds the Residential PSRG of 0.68 mg/kg. However, the detections of arsenic are consistent with published background ranges for North Carolina soils. No other metals were detected at concentrations exceeding the DEQ PSRGs. 1.3 Export Soil Activities On behalf of Crowne at 501, H&H submitted a soil transfer request to the DEQ Brownfields Program on March 4, 2020, for approval to export soil to Fogleman and Fogleman Soils, Inc. (Fogleman), a Land Clearing and Inert Debris (LCID) landfill located at 4005 Intermere Road in Durham, North Carolina. Initial export activities to Fogleman were approved in a letter provided by DEQ Brownfields dated March 18, 2020. Subsequent export activities to Fogleman were approved by Fogleman in a letter provided by Smith Gardner, Inc. (S+G) on behalf of Fogleman, dated November 30, 2020, and subsequent emails from S+G dated March 29, 2021, May 11, 2022, and September 20, 2022. In total, approximately 550 cy of soil associated with Stockpile- 14 and Stockpile-15 were exported to Fogleman's facility in Durham, North Carolina during the months of May and October 2022. Export approval letters and emails can be provided upon request.
