Thank you for the update. That’s great to hear the draft BFA is almost ready!
I checked our files and I also checked with the PD. Neither of us had copies of the pages you
provided. I went to the DWM site locator tool and found those pages on Laserfiche under the
old (~2011) Brownfields application at this site (11023-07-032). Sorry, we can’t be of more
help. We only have the same copies you have.
The surveyor hasn’t ben engaged, yet. I just corresponded with the PD and got his ok on which
surveyor he wants to use. I’ll email them preliminary information and get them started this
week. They recently did a recombination of the parcels. So it shouldn’t be difficult for them to
pull together the Brownfield Plat. I’ll email you as soon as I have an estimated schedule from
the surveyor.
Construction schedule & finalizing the EMP have been delayed for a number of reasons. EMP
was delayed because we had not figured what to with contaminated groundwater at the site.
The finished floor elevation (FFE) of the lowest level will be lower than the groundwater table,
requiring the building foundation have a permanent dewatering/drainage system. We’ve made
inquiries with the City of Durham and applied for an Industrial Wastewater Discharge Permit to
discharge the groundwater to their sanitary sewer. The City will not allow.
January 2024, we met with the PD and their civil engineer to explore alternatives. Based on the
building elevations, there are no alternatives to collecting the groundwater around the building
foundation. The PD will have to collect and perform on-site treatment of the contaminated
groundwater collected by the foundation drainage system. The PD will have to obtain a NPDES
Permit to discharge the ‘clean’ treated water to the City’s storm sewer. They’ll also have to get
a permit from the City to discharge the ‘clean’ water to the City’s storm sewer.
S&ME needs to do a preliminary feasibility study to figure out approximate size of a treatment
system. And the civil engineer needs to find some extra space on the ground level for a
permanent treatment system. We plan to incorporate details of the on-site groundwater
treatment into the EMP when we address the EMP review comments Brad provided on
5/5/2023. Likely, it’ll be ~2 months till we re-submit the EMP.
The latest schedule from the PD, estimates construction will start September 2024, with an
estimated duration of ~26 months.

We are wrapping up drafting the N. Mangum Brownfields Agreement, which we are hoping to
provide soon and complete the Brownfields Agreement process this quarter, but we have a
question. Please see the attached excerpts from the lab report from 2007; we are interpreting the
values in the attached report to be in ug/L, but it is hard to tell because it is not very legible. Do you
have a clearer copy of this report?
Do you know the status of the plat? We have found it works best to have us communicate directly
with the surveyor. Has a surveyor been engaged yet?
Where are you in the construction schedule? We note that the draft EMP has not yet been revised.
Also, we understand from Brad that you are working on a revised EMP and a draft VIMP; where are
you in that process?
